Sole Source Justification. The BOND Rxm staining module is manufactured and sold by Leica Microsystems. The repair requires personnel who are familiar with the instrument and have had training by Leica. Leica also does not sell their parts to third parties and if a vendor was able to be found, there would be a delay in repairing because the vendor would have to order the part from Leica. The service agreement also includes unlimited technical telephone and web support. To find other vendors who also repair Leica instruments, a Google search was performed. No vendors appeared on the search. The MIB has had Leica as the service vendor since the instrument was initially purchased in 2017. Sole Source Justification. Sole source justification should be thoroughly documented. What is sole source justification? It's the rationale of the decision to use sole source solicitation as a procurement process. The burden of proof to justify sole source procurement falls to the requester who should prepare a document called Sole Source Justification and Approval (J&A). (SEE ATTACHMENT) The Federal Acquisition Regulation (FAR 6.302, Circumstances permitting other than full and open competition) describes the seven exceptions that can be invoked as sole source justification: • Competition Requirements (FAR Part 6) • Other Than Full and Open Competition (FAR Subpart 6.3) • Circumstances permitting other than full and open competition (FAR 6.302): • Only one responsible source and no other supplies or services will satisfy agency requirements. • Unusual and compelling urgency. • Industrial mobilization; engineering, developmental, or research capability; or expert services. • International agreement. • Authorized or required by statute. • National security. • Public interest. The most frequently invoked justification for adopting a sole source procurement process is the first exception (FAR 6.302-1), i.e. when there is only one responsible source and no other supplies or services satisfy requirements usually defined in the statement of work (SOW). Sole Source Justification. Xxxx Xxxx has 34 years of professional experience in the field of fisheries science (see appended resume) and was previously involved with the Eastern Xxxxx Xxxxx Joint Venture (EBTJV) having served on the partnership’s Steering Committee, its Science and Data Sub- Committee and he led the original range-wide Xxxxx Xxxxx status assessment in the eastern portion of the U.S. Xxxx is particularly well suited to perform the scope of work described in this agreement as he has provided valuable advice and support to the EBTJV and its partners for map making; methods documentation; and, development of databases (e.g. occupancy, GIS layers, catchment and patch databases). Xxxx has established effective working relationships with many landscape-scale conservation organizations operating within the EBTJV’s geographic scope. This is demonstrated by the national award he received from the National Fish Habitat Partnership in recognition of the scientific support he provided towards implementing the National Fish Habitat Action Plan; the work he’s done for the Appalachian Land Conservation Cooperative in assisting with the development of a riparian restoration decision support tool; administrating the US Geological Survey’s Fisheries Research Program that included the development of a Xxxxx Xxxxx research plan; and, developing a climate change model for xxxxx xxxxx and catchment assessment methods/patch metrics being used by the Chesapeake Bay Program. Xxxx was instrumental in leading the development of the EBTJV’s initial status assessment of Xxxxx Xxxxx (2005) as well as the partnership’s most recent assessment at a finer scale. As a result of his efforts, Xxxx has hands on experience working with all the EBTJV state agencies responsible for managing the Xxxxx Xxxxx resources within their respective jurisdictions. Xxxx participated as a member of the original work groups that established the EBTJV’s initial set of conservation priorities, as well as range-wide and regional metrics for success. Additionally, he has developed models and publications aimed at identifying priority focus areas for Xxxxx Xxxxx restoration and enhancement activities.
