Equipment Failure. In the event of a mechanical breakdown or failure of communication or power supplies beyond its control, Administrator shall take all reasonable steps to minimize service interruptions for any period that such interruption continues beyond Administrator’s control. Administrator shall make every reasonable effort to restore any lost or damaged data and correct any errors resulting from such a breakdown at the expense of Administrator. Administrator agrees that it shall, at all times, have reasonable contingency plans with appropriate parties, making reasonable provision for emergency use of electrical data processing equipment to the extent appropriate equipment is available. Representatives of the Trust shall be entitled to inspect Administrator’s premises and operating capabilities at any time during regular business hours of Administrator, upon reasonable notice to Administrator.
Equipment Failure. In the event that any of the Equipment fails to start, breaks, becomes unsafe or is in need of maintenance or repair, you agree to immediately discontinue use, notify us and, if directed to do so, return the Equipment to us. You further agree not to repair or have anyone else repair any Equipment. Failure to timely notify us will result in your being charged for all time for which the Equipment is outstanding.
Equipment Failure. The Center will not be responsible for the replacement of any of its equipment, which may be out of service. Should the Center assume any costs for equipment rental necessary for the User’s event, the User will reimburse the Center for payment in full.

Equipment Failure. Customer must promptly notify Motorola of any Equipment failure. Motorola will respond to Customer's notification in a manner consistent with the level of Service purchased as indicated in this Addendum and applicable SOW.

In the event of equipment failure or any failure at the Facility, the Power Authority shall be solely responsible to pursue any applicable claims for warranty and/or reimbursement from the manufacturer, vendor, contractors who built the Facility or otherwise. The Power Authority shall not delay payment of a Con Edison invoice during the pendency of any such claim.

Jumporee has the authority to immediately discontinue the use of the rented equipment should it, at any time, become unsafe or in a state of disrepair, and to immediately (one hour or less) notify customers of the facts. Jumporee agrees, in our discretion, either to: repair the rented equipment, or provide the customer with a similar rental or make like inflatable available to you at another time (if acceptable by customer) or adjust the rental charge. This provision does not relieve the customer from your other obligations under this rental contract.
Equipment Failure. USASA shall in no circumstances be liable for any loss or distress sustained by the Hirer caused directly or indirectly by hire equipment failure.

The Hirer will on no account attempt to repair the equipment without the consent of the Owner and will immediately return the equipment to the Owner’s premises if required to do so by the Owner. If the failure is caused by reasonable wear and tear and for no other reason including the Hirer’s negligence or misuse, the Owner agrees, in its discretion, to:-
10.1 Repair the equipment within a reasonable time;
10.2 Make similar equipment available, or
10.3 Adjust the rental charge. The Owner shall in no circumstances be liable for any loss sustained by the Hirer.
