SOLICITATION REQUIREMENTS, TERMS AND CONDITIONS. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical/management requirements, in addition to those identified as factors or subfactors. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being ineligible for award. In addition to conforming to all the requirements specified in this solicitation, an Offeror’s proposal will not be eligible for consideration for award unless the following conditions are met:

SOLICITATION REQUIREMENTS, TERMS AND CONDITIONS. Offerors are required to meet all solicitation requirements, such as terms and conditions, representations and certifications, and technical/management requirements, in addition to those identified as factors or subfactors. Failure to comply with the terms and conditions of the solicitation may result in the Offeror being ineligible for award. A Contract may be awarded to the Offeror who is deemed responsible in accordance with the FAR, as supplemented, whose proposal conforms to the solicitation’s requirements (to include all stated terms, conditions, representations, certifications, and all other information required by Section L of this solicitation) and is judged, based on the evaluation factors and subfactors, to represent the best value to the Government. The Government seeks to award to the Offeror who gives DISA the greatest confidence that it will best meet, or exceed, the requirements.

SOLICITATION REQUIREMENTS, TERMS AND CONDITIONS. The Government will only evaluate a proposal received in accordance with Section L. Proposals received that do not address all aspects of Section L may be considered non-compliant and costs incurred in the resubmission of a compliant proposal may be deemed unallowable. Offerors must clearly identify any exception to the solicitation terms and conditions and must provide complete supporting rationale. An award will only be made to the Offeror if the proposal represents a technically acceptable and reasonably priced offer.   • Terms and Conditions of Use NASCAR shall have the right to use and sublicense PROMOTER’s Marks in connection with publicity, promotion or advertising of the Event and the NASCAR Sprint Cup Series, and the exploitation of Live Broadcast Rights and Ancillary Rights, provided, however, that NASCAR shall not, without the prior written consent of PROMOTER, use or sublicense the use of PROMOTER’s Marks on the branding of any retail package product, unless otherwise expressly permitted in this Agreement.
