Common use of Special Rates Not Cumulative Clause in Contracts

Special Rates Not Cumulative. Where more than one of the disabilities set out in subclause 5.9.3 entitles an employee to extra rates, the employer shall be bound to pay only one rate, namely the highest rate for the applicable disabilities. This does not apply in relation to cold places, hot places, wet places, confined spaces, dirty work or height money, the rates for which are cumulative.

Where more than one of the disabilities set out in subclause 5.9.3 sub-clause 39.4 entitles an employee to extra rates, the employer Company shall be bound to pay only one rate, namely the highest rate for the applicable disabilities. This does not apply in relation to cold places, hot places, wet places, confined spaces, dirty work or height money, the rates for which are cumulative.

Where more than one of the disabilities set out in subclause 5.9.3 sub clause 16.3 entitles an employee to extra rates, the employer shall be bound to pay only one rate, namely the highest rate for the applicable disabilities.
