SPECIAL STATE REQUIREMENTS. Regulation of Service Agreements may vary widely from state to state. Any provision within this Service Agreement which conflicts with the laws of the state where You live shall automatically be considered to be modified in conformity with applicable state laws and regulations as set forth below. The following state specific requirements apply if Your Service Agreement was purchased in one of the following states and supersede any other provision within Your Service Agreement terms and conditions to the contrary.
SPECIAL STATE REQUIREMENTS. State amendments to specific provisions of the terms of this CONTRACT are as follows: Connecticut only: In the event of a dispute with ADMINISTRATOR, YOU may contact The State of Connecticut, Insurance Department, X.X. Xxx 000, Xxxxxxxx, XX 00000-0000, Attn: Consumer Affairs. The written complaint must contain a description of the dispute, the purchase or lease price of the EQUIPMENT, the cost of repair of the EQUIPMENT and a copy of the CONTRACT. YOU may cancel YOUR CONTRACT if the covered EQUIPMENT is sold, lost, stolen, or destroyed. If YOUR EQUIPMENT is being repaired for a MECHANICAL BREAKDOWN or FAILURE covered by the CONTRACT, and the CONTRACT plan expires during the repair, the CONTRACT plan is extended until the repair is completed. CANCELLATION - If WE cancel this CONTRACT for non-payment, WE must provide YOU with a written notice at least 10 days prior to cancellation at YOUR last known address, with the effective date for the cancellation and the reason for cancellation. If WE cancel this CONTRACT for any other reason, WE must provide YOU with a written notice at least 30 days prior to cancellation at YOUR last known address, with the effective date for the cancellation and the reason for cancellation. CONTRACT HOLDER’S RESPONSIBILITY: It is the responsibility of the CONTRACT HOLDER to follow the manufacturer’s specifications for the use and care/maintenance of the covered EQUIPMENT.
SPECIAL STATE REQUIREMENTS. Changes to established requirements of this MCCA made necessary by governing state statutes will be processed in accordance with NGR 5-1, Chapter 3. Upon approval, a statement of alterations or changes, along with justification, shall be attached to this MCCA and will be considered a part thereof. If none, state NONE.
SPECIAL STATE REQUIREMENTS. State amendments to specific provisions of the terms of cancellation are as follows: $25.00. Any refund may be credited to any outstanding balance of your account and the excess, if any, returned to you. A 10% penalty per month will be added to a refund that is not paid or credited within 45 days after return of the service contract to us. In the event we cancel this service contract, we will mail a written notice to you at your last known address at least 5 days prior to cancellation with the effective date for the cancellation and the reason for cancellation. But, we are not required to mail you written notice if the reason for cancellation is nonpayment of the Provider fee or a material misrepresentation by you to the Provider relating to the covered property or its use.
SPECIAL STATE REQUIREMENTS is amended as follows: No administrative fee will be assessed for cancellations made during the Free Look Period. Any refund for a Contract cancelled by You during the Free Look Period will be paid within thirty (30) days of receiving notice of cancellation from You or a ten (10%) percent penalty per month will be added to the refund. The right to void this Contract is not transferrable and applies only to the original Contract Holder. If We cancel this Contract We will mail to You a written notice of cancellation at Your last known address as reflected in Our files at least fifteen (15) days prior to the effective date of cancellation stating the effective date and reason for cancellation unless We are cancelling the Contract for nonpayment, material misrepresentation, or substantial breach of Your duties hereunder in which case We will not provide You with prior notice of cancellation.
