MECHANICAL BREAKDOWN or FAILURE definition

MECHANICAL BREAKDOWN or FAILURE. Means the MECHANICAL BREAKDOWN or FAILURE of any original or like replacement part covered by YOUR CONTRACT to work as it was designed to work in normal service, providing the VEHICLE has received required maintenance as defined in Section E of this CONTRACT entitled “VEHICLE MAINTENANCE REQUIREMENTS” and does not include worn parts that are within manufacturer tolerances. Please refer to the wording under exclusions for a listing of conditions under which the FAILURE of a COVERED PART is not considered a covered MECHANICAL BREAKDOWN or FAILURE.

MECHANICAL BREAKDOWN or FAILURE. Means the MECHANICAL BREAKDOWN or FAILURE of any original or like replacement part covered by YOUR CONTRACT to work as it was designed to work in normal service, providing it has received required maintenance as defined under Section I of this CONTRACT (“YOUR RESPONSIBILITIES”) and does not include worn parts that are within manufacturer tolerances.

Examples of MECHANICAL BREAKDOWN or FAILURE in a sentence

  • YOU agree that WE, after honoring a claim on YOUR CONTRACT, have all rights of subrogation against those who may be responsible for YOUR MECHANICAL BREAKDOWN or FAILURE.

  • This CONTRACT applies only to a MECHANICAL BREAKDOWN or FAILURE occurring within the United States and Canada.

  • This CONTRACT applies only to a MECHANICAL BREAKDOWN or FAILURE occurring within the Continental United States, Alaska, Hawaii and Canada.

  • If YOUR VEHICLE becomes inoperable and must remain at the REPAIR FACILITY and the MECHANICAL BREAKDOWN or FAILURE has been authorized by the ADMINISTRATOR for four (4) or more hours of labor, the ADMINISTRATOR agrees to reimburse YOU for rental car transportation from a licensed vehicle rental company (except where prohibited by law).

  • Any operation of the VEHICLE that results in further damage related to the original MECHANICAL BREAKDOWN or FAILURE shall be considered negligence on YOUR part and any such further damage shall not be covered under this CONTRACT.

  • YOU shall protect the VEHICLE from further damage whether or not such MECHANICAL BREAKDOWN or FAILURE is covered by YOUR CONTRACT.

  • Neither WE nor this CONTRACT will not be responsible for authorization or payment for any MECHANICAL BREAKDOWN or FAILURE to YOUR VEHICLE after the cancel date or during the first ninety (90) days and 3,000 miles from the effective date of the Reinstatement Notice.

  • WE agree to repair, replace or reimburse YOU for the reasonable cost to repair or replace any of the parts covered by YOUR CONTRACT, if required, due to a MECHANICAL BREAKDOWN or FAILURE.

  • If YOUR VEHICLE becomes inoperable more than one hundred (100) miles from YOUR home and must remain at the REPAIR FACILITY overnight as a result of a MECHANICAL BREAKDOWN or FAILURE authorized by the ADMINISTRATOR, WE will reimburse YOU for motel and restaurant expenses up to fifty (50) dollars per day for a maximum of three (3) days.

  • If the MECHANICAL BREAKDOWN or FAILURE of a covered component of YOUR CONTRACT disables YOUR VEHICLE, and YOU are required to remain overnight more than 200 miles from YOUR residence while repairs are completed, WE will reimburse YOU up to $225.00, not to exceed $75.00 per day, for the first three consecutive days, for costs incurred by YOU for meals and lodging between the date of MECHANICAL BREAKDOWN or FAILURE and the date repairs are completed.


More Definitions of MECHANICAL BREAKDOWN or FAILURE

MECHANICAL BREAKDOWN or FAILURE means the failure of YOUR EQUIPMENT to perform its intended function due to mechanical or electrical breakdown resulting from defects in materials or workmanship during normal usage of the EQUIPMENT.
MECHANICAL BREAKDOWN or FAILURE. Means the inability of any covered part (s) to perform the function(s) for which it was designed due to defects in material or workmanship. Mechanical Breakdown does not include the gradual reduction in operating performance due to normal wear and tear where a Failure has not occurred. The manufac- turer has established tolerances for the express purpose of defining Failure and serviceability. When specifications exceed these manufacturer’s tolerances a Failure will be considered to have occurred. Under CANCELLATION OF YOUR AGREEMENT, paragraph e. is deleted and replaced with the following: e. If this Agreement is canceled within the first sixty (60) days, We will refund the entire Agreement price paid, less any claims paid or pending. If this Agreement is canceled after the first sixty (60) days, We will make a pro rata refund based on time or mileage, whichever refund is less, less an administration fee of fifty ($50) or ten percent (10%) of the Agreement price, whichever is less. The Administrator is responsible for honoring cancellation requests.

  • Malfunction means any sudden, infrequent, and not reasonably preventable failure of air pollution control equipment, process equipment, or a process to operate in a normal or usual manner. Failures that are caused in part by poor maintenance or careless operation are not malfunctions.

Rain, snow, wind, high water or any other natural phenomenon, which might reasonably have been anticipated from historical records of the general locality of the City, shall be deemed not to be acts of God;
