Standards, Specifications and Procedures. You agree to comply with all System specifications, standards, and operating procedures (whether contained in the Manual or any other written communication) relating to the appearance, function, cleanliness, and operation of a URBAN AIR TRAMPOLINE PARKTM Store including, without limitation: (1) type, quality, taste, weight, dimensions, uniformity, pricing, and sale of all products sold at the Store; (2) sales and marketing procedures and customer service; (3) advertising and promotional programs; (4) layout, décor, and color scheme of the Store ; (5) appearance and dress of employees; (6) safety, maintenance, appearance, cleanliness, sanitation, standards of service, and operation of the Store; (7) submission of requests for approval of brands of products, supplies, and suppliers; (8) use and illumination of signs, posters, displays, standard formats, and similar items; (9) use of audio equipment and type and decibel levels of music; (10) use of video equipment and type and decibel level of television broadcasts (including closed captioning requirements); (11) types of fixtures, furnishings, equipment, smallwares, and packaging; and (12) the make, type, location, and decibel level of any game, entertainment, or vending machine. Mandatory specifications, standards, and operating procedures, including upgraded or additional equipment, that Franchisor prescribes from time to time in the Manual or otherwise communicates to you shall constitute provisions of this Agreement as if fully set forth in this Agreement. All products, merchandise, advertising materials, furniture, fixtures, equipment, smallwares, supplies, and stationery used in connection with the operation of the Store must meet Franchisor’s standards and specifications, as promulgated from time to time. Such specifications may include brand specifications (“Approved Brands”), and to the extent that Approved Brands have been identified, you may purchase and use only the Approved Brands. Franchisor may from time to time modify its specifications, and you shall promptly comply with all such modifications.

Standards, Specifications and Procedures. Freshslice and the Brand have a reputation for high quality. This reputation has been developed and maintained by Freshslice, and it is of the utmost importance to Freshslice that this reputation be maintained. In recognition of the mutual benefits that come from maintaining the reputation for high quality enjoyed by Freshslice and the Brand, Market Partner covenants and agrees that Market Partner and its employees shall strictly comply with this Agreement and the Materials in carrying out the Services. Market Partner shall only prepare and package Orders through Freshslice’s account on the Platform and shall not otherwise prepare, package, advertise, market, offer, provide, or sell Brand products. In order to ensure that all Orders produced by Market Partner meet Freshslice’s high standards of taste, texture, appearance, and freshness, and in order to protect Freshslice and the Brand’s goodwill, all Orders shall be prepared by Market Partner using properly trained personnel in accordance with Freshslice’s recipes, preparation techniques, processes, and other Materials. In providing the Services, Market Partner acknowledges that such recipes, preparation techniques, and processes are integral to the Services and failure to adhere to such recipes, preparation techniques, and processes shall be detrimental to the Services, the Brand, and Freshslice. Freshslice shall be solely responsible for determining the prices of all Brand products, which may vary by location, time, and Platform and change from time to time. Market Partner shall have no role in the influencing or setting of the prices of Brand products, and Freshslice has no obligation to advise or update Market Partner on price changes. Market Partner shall in the provision of the Services use only boxes, bags, wrapping paper, labels, forms, and other paper, plastic or similar packaging materials for the Orders as prescribed from time to time by Freshslice (collectively, “Packaging Materials”). In no circumstance may Market Partner use any other boxes, bags, wrapping paper, labels, forms, or other paper and plastic products not prescribed by Freshslice. Freshslice shall provide to Market Partner a list of approved suppliers (“Suppliers”), and Market Partner shall purchase all Supplies used in the preparation of Orders, including Packaging Materials, only from Suppliers. Market Partner is solely responsible to determine the quantities and timing of ordering Supplies in order to fully perform the Services...
Standards, Specifications and Procedures. Franchisee acknowledges that each and every detail of the appearance, layout, decor, services and operation of the Franchised Restaurant is important to HFS and other Hardee's Restaurants. Franchisee agrees to cooperate with HFS by maintaining these high standards in the operation of the Franchised Restaurant. Franchisee further agrees to comply with all System specifications, recipes, standards and operating procedures (whether contained in the Manual or any other written communication to Franchisee) relating to the appearance, function, cleanliness and operation of a Hardee's Restaurant, including, but not limited to: (1) type, quality, taste, weight, dimensions, ingredients, uniformity, manner of preparation, and sale of all food products and beverages sold at the Franchised Restaurant and all other products used in the packaging and sale of those products and beverages; (2) sales and marketing procedures and customer service; (3) advertising and promotional programs; (4) layout, decor and color scheme of the Franchised Restaurant; (5) appearance and dress of employees; (6) safety, maintenance, appearance, cleanliness, sanitation, standards of service, and operation of the Franchised Restaurant; (7) submission of requests for approval of brands of products, supplies and suppliers; (8) use and illumination of signs, posters, displays, standard formats and similar items; (9) identification of Franchisee as the owner of the Franchised Restaurant; (10) types of fixtures, furnishings, equipment, smallwares and packaging; and (11) the make, type, location and decibel level of any game, entertainment or vending machine. Mandatory specifications, standards and operating procedures, including upgraded or additional equipment, that HFS prescribes from time to time in the Manual, or otherwise communicates to Franchisee in writing, shall constitute provisions of this Agreement as if fully set forth in this Agreement.

  • Quality Specifications SANMINA-SCI shall comply with the quality specifications set forth in its Quality Manual, incorporated by reference herein, a copy of which is available from SANMINA-SCI upon request.

  • Technical Specifications The Technical Specifications furnished on the CD are intended to establish the standards for quality, performance and technical requirements for all labor, workmanship, material, methods and equipment necessary to complete the Work. When specifications and drawings are provided or referenced by the County, these are to be considered part of the Scope of Work, and to be specifically documented in the Detailed Scope of Work. For convenience, the County supplied specifications, if any, and the Technical Specifications furnished on the CD.

  • Changes to Specifications All Specifications and any changes thereto agreed to by the parties from time to time shall be in writing, dated and signed by the parties. Any change to the Packaging process shall be deemed a Specification change. No change in the Specifications shall be implemented by PCI, whether requested by Client, requested by PCI or requested or required by any Regulatory Authority, until the parties have agreed in writing to such change, the implementation date of such change, and any increase or decrease in costs, expenses or fees associated with such change (including any change to Pricing). PCI shall respond promptly to any request made by Client for a change in the Specifications, and both parties shall use commercially reasonable, good faith efforts to agree to the terms of such change in a timely manner. As soon as possible after a request is made for any change in Specifications, PCI shall notify Client of the costs associated with such change and shall provide such supporting documentation as Client may reasonably require. Client shall pay all costs associated with such agreed upon changes. If there is a conflict between the terms of this Agreement and the terms of the Specifications, this Agreement shall control. PCI reserves the right to postpone effecting changes to the Specifications, or in the case of changes requested or required by any Regulatory Authority postpone Packaging under this Agreement, until such time as the parties agree to and execute the required written amendment.

  • Product Specifications The Company agrees that all Products sold to Xxxx hereunder shall conform to the respective specifications set forth on Schedule A or to such other specifications as are from time to time agreed upon by the Parties.

  • Quality Standards Each Party agrees that the nature and quality of its products and services supplied in connection with the other Party's Marks will conform to quality standards set by the other Party. Each Party agrees to supply the other Party, upon request, with a reasonable number of samples of any Materials publicly disseminated by such Party which utilize the other Party's Marks. Each Party will comply with all applicable laws, regulations, and customs and obtain any required government approvals pertaining to use of the other Party's marks.

BBH&Co will upon request provide the Fund with information about our compliance program as mutually agreed.
