Standby Pay. (Applies a) Where the Employer requires an employee to SB1be available on standby during the off-duty hours, SC1, and SD1 only) When a department head or designee assigns a unit member to standby, the unit member an employee shall be paid an amount equivalent entitled to a standby pay equal to one and seventy-five hundredths (1.75) hours straight time pay hour for each eight (8) hour consecutive hours, or portion thereof, that he/she is on standby, except on his/her day of rest and designated paid holiday. For any period of standby assignmenton a day of rest or designated paid holiday, the employee shall be entitled to standby pay equal to three hours.
(i) In lieu of standby pay specified in Article 26.01(a) and overtime pay specified in Articles 22 and 26 for regular plant checks, Superintendents, Operators and/or Assistant Operators shall be paid a daily allowance of one (1) hour pay at their regular rate of pay for each day a plant check is performed, payable bi- weekly.
(ii) Where operational requirements permit, these employees shall be entitled at their request and with prior approval of the Employer, to time off from performing standby. The employee must request a minimum of one day of relief from standby.
(iii) Plant Superintendents and Assistant Operators are required as a condition of employment to have a telephone installed at home and therefore the Employer will arrange to have telephones installed in the homes of the Plant Superintendents and the Assistant Operators and the Employer shall pay for the monthly charges. The telephones services shall be long distance restricted and designated for the business purposes of the Employer.
26.02 An employee designated by letter or by list for standby duty shall be available and fit for duty during the period of standby at a known telephone number or location and be available to return for duty as quickly as possible if called. In selecting unit members designating employees for standby, the Employer will endeavor to provide for the equitable distribution of standby duties.
26.03 No standby payments shall be granted if any employee is unable or unfit to report for duty when required.
26.04 An employee on standby who is required to report for work and who reports for work shall be paid in addition to standby pay, the department head or designee shall determine which unit members are qualified for the standby assignment. Every six (6) months, qualified unit members performing the work during regular work hours shall be provided the opportunity to be placed on the standby rotation list for the next six (6) months. Standby will be offered to unit members on the standby rotation list in the order of seniority. The most senior unit member, based on initial hire date into the most recent Civil Service classification, will be placed at the top of the standby rotation list. Standby Pay. (Applies Section 1 - The city may, at its discretion, institute a standby pay program in each applicable division when, in the sole judgment of management, essential operation situations require immediate response to SB1, SC1, and SD1 only) When a department head or designee assigns a cover frequent but unpredictable emergency situations involving bargaining unit member to standby, the unit member employees.

Section 3 - Employees on standby assignmentwill make their cell phone numbers available to the employer so they can respond in a timely fashion to the service needs of their department. Section 4 - The city shall prepare a list for each division of all classifications and qualified persons within those classifications where the standby pay, coverage is needed. The city shall then determine the department head or designee shall determine which unit members are qualified number of persons needed for the standby assignmentperiod, which will be determined by the city. Every six Winter weekend standby periods may be cancelled due to favorable weather forecasts, but if cancelled, both Saturday and Sunday will be included in the cancellation. Cancellation will be made by 10:00 a.m. on Friday or as so as possible thereafter, but at least by noon. The initial list of covered divisions and classifications is as follows:
Section 5 - When a specific job classification is needed to perform a task, the appropriate employee on stand-by will be called.
Section 6 - Employees who desire to trade assigned weeks or days are responsible for notifying management in writing at least twenty-four (624) monthshours in advance of who will be covering his/her standby obligation.
Section 7 - If an emergency occurs when employees are working their regular shift, qualified unit members performing the emergency will be covered by holding over employees in accordance with the regular overtime assignment procedure rather than standby employees wherever possible.
Section 8 - Employees are required to report as quickly as possible when on standby, within one (1) hour from the time of being called. Failure to respond to a phone call within one (1) hour, or failure to respond to a call to work during regular work as promptly as possible, shall result in a loss of standby pay for that day (three hours straight time). Repeated failure to respond will result progressively in a written reprimand, a short-term suspension, and if warranted further, more severe disciplinary action up to and including discharge.
Section 9 - The employer will determine its standby needs. Employees who are interested shall be provided the opportunity to be placed on sign a list so indicating. Employees who have signed the standby rotation list for the next six (6) months. Standby needs posting will be offered to unit members on the standby rotation list in the order of seniority. The most senior unit member, based on initial hire date into the most recent Civil Service classification, will be placed at the top of the standby rotation list. Standby Pay. The City shall pay five hundred and twenty-five (Applies $525) dollars per week for Standby Pay to SB1any member who is assigned to Standby duty during the week. The City will fill Standby assignments with volunteers when possible. The City shall provide a cell phone or a cell phone stipend to such members. Members on Standby are required to answer the phone when called and must respond to their regularly assigned work location within thirty (30) minutes. However, SC1if the supervisor determines that the work can be completed remotely (e.g., and SD1 onlyIT, Alarms, or Treatment Plant Maintenance), the member must begin working within twenty (20) minutes. A member shall code all time worked during a Standby assignment, consistent with MOU Section 5.3(a). When a department head member is called back to a work site and performs work in-person, they shall be entitled to the appropriate Call-Back minimums under MOU Section 5.8. In the case of a member on a Standby assignment the call back minimums under section 5.8 shall begin at the time the member receives a call requiring them to perform work in-person and shall end once the work is completed at the work site. The Standby assignment will be reassigned if the assigned member is off duty due to their own illness or designee assigns injury during their regular shift immediately preceding a unit standby assignment. The assignment will revert to the original assigned individual as soon as the member is no longer on sick leave. B. Court Standby Whenever an employee has been placed in an on-call or designee shall determine which unit members standby status while off duty in response to a subpoena or directive in relation to a matter that arose during the course and scope of employment, the following applies:
(1) For (1) the first court session (either morning or afternoon) during a calendar day and (2) the second court session during a calendar day where the required court appearance is in connection with a different matter than was involved in the first court appearance, employees receive compensation as follows:
a. Employees who are qualified off-duty for the standby assignment. Every six (6) months, qualified unit members performing entire period of the work during regular work court session shall receive three hours shall be provided of compensation at the opportunity to be placed on straight time rate.
b. Where the standby rotation list for or on-call assignment commences within three hours before the next six (6) months. Standby will be offered to unit members on beginning of the standby rotation list in employee’s regularly scheduled work shift, the order of seniority. The most senior unit member, based on initial hire date into the most recent Civil Service classification, will be placed employee shall receive compensation at the top applicable hourly rate of pay for all time transpiring between the commencement of the standby rotation list. c. The provisions of this Section apply if a standby or on-call assignment that is scheduled to occur on an employee’s scheduled day off (e.g., an approved vacation day) is canceled less than 12 hours in advance of the time the assignment is scheduled to begin.
d. The provisions of this paragraph (1) do not apply if a standby or on-call assignment that is scheduled to occur on an employee’s scheduled work day is canceled any time before the commencement of the standby or on-call status.
(2) For the second court session in connection with the same Civil Service hire date into the most recent classification, those employees will then be placed matter on the standby list based on their initial Civil Service hire date with the City. A unit member assigned standby duty who fails to comply with these two conditions shall not be paid standby pay during any such period of time. Standby Pay. 22.1. At the Employer's option, an employee may be placed on "standby" status. This status requires the employee be available on a twenty-four (Applies 24) hour basis for emergency work at a Wastewater or Stormwater facility. The employee must be in a position to SB1, SC1, and SD1 onlyrespond by telephone within fifteen (15) When a department head or designee assigns a unit member minutes to standby, any summons at any time during the unit member shall twenty-four hour period. The standby personnel shall carry the pager at all times and shall have the radio and portable phone immediately available. Standby personnel when called out to respond to an emergency shall ensure that their radio and portable phone is turned on in order that they may be contacted by the plant personnel or duty supervisor if necessary.
22.3. Employer will post a standby duty roster monthly.
22.4. An employee on standby status shall be subject to call back duty as described in Article 24.
22.5. If the employee who is scheduled on standby status is unable to meet the requirements for the full standby period, it is his/her responsibility to find a replacement in advance of the scheduled period and notify the Public Works Director or designee in writing no less than seven (8) hour 7) days prior to starting date of scheduled standby status.
22.6. Duration of standby shall be no more than one week at a time and divided equally amongst those qualified as determined by the Public Works Director or designee. Employees placed on Standby Status may be provided, at their option, the take home use of a county vehicle to use for emergency call back situations while on standby. The employee will be paid for time spent driving their assigned county vehicle to respond to an emergency call back at a location other than their normal work site. Such paid travel time will be part of the minimum period of standby assignmentpay that may be due for a call back under the Agreement. 9.4.1 Employees who are released from active duty but who are required by their departments to SB1leave notice where they can be reached and be available to return to active duty when required by the department, SC1, and SD1 only) When a department head or designee assigns a unit member to standby, the unit member shall be paid considered to be on standby duty.
9.4.2 Standby duty shall, whenever possible, be assigned to employees on a voluntary basis. When volunteer assumption of standby duty by employees is insufficient to meet the needs of the department, then such duty shall be assigned on a rotational basis whenever possible within affected work units.
9.4.3 Standby duty requires that employees so assigned shall respond as soon as possible and within no more than sixty (60) minutes (unless other arrangements are made with the supervisor). Employees on standby shall make themselves available to be reached by telephone or other communicative devices and refrain from activities which might impair their ability to perform assigned duties. Employees not obligated to remain on standby have no obligations to meet these requirements. Employees accepting standby assignments not able to meet the above criteria due to distance, must make prior arrangements with management before accepting the standby assignments.
9.4.4 Standby duty occurs after the employee’s regular hours are completed and is not an amount extension or continuation of a regular shift.
9.4.5 Standby duty is a seven (7) day, Thursday to Wednesday, assignment.
9.4.6 Standby duty shall be compensated at the hourly rate of the “top” step of the salary range to which the classification of “Senior Street Maintenance Worker” is assigned. 9.4.8 City agrees to compensate those employees will then be placed on the standby list based on their initial Civil Service hire date with the City. If a unit member on the standby rotation list refuses a standby rotation, the rotation will be offered to the next senior unit member on the standby rotation list. If all unit members on the standby rotation list refuse the standby rotation, the least senior and qualified unit member must accept the standby. During all hours when assigned to standby duty, a unit member shall
(a) keep the supervisor informed of the City issued mobile number at which the unit member can be reached, and (b) be available to report within a reasonable time in the event of a call-out. Standby Pay. A. Employees may be required to make themselves available to report to work immediately if called at times other than their regularly scheduled work hours. O & M Tech employees shall be offered by seniority on a weekly basis, to be on standby status. The employee on standby may be required to make themselves available to report to work immediately if called at times other than their regularly scheduled work hours. Such employees, when placed in standby status, will receive 9 hours standby pay per week, at the employee's applicable regular base rate of pay.
B. When placed in standby status, it is the employee's responsibility to be able to immediately and effectively perform the required job duties. Voice contact must be established within fifteen (Applies to SB1, SC115) minutes of receiving a pager signal or telephone call, and SD1 onlythe employee must arrive at the job site as soon as possible but no later than one (1) When hour after receiving the pager signal or telephone call. An employee in standby status must remain in close geographical proximity and must not consume alcohol or other substance, which could impair his ability to perform job duties. If the employee fails to respond as described above to a department head call-in while in standby status or designee assigns a unit member fails to standbynotify his supervisor or other designated individual that he is for any reason unable to carry out his standby responsibilities, he will forfeit the unit member right to receive standby pay on that day and will be subject to disciplinary action.
