STATUS OF PROVIDER. 16.1.1 For the avoidance of doubt, any individual Provider is an independent contractor and is not an employee of the Commissioner and must not represent him/herself as such. Any individual Provider is responsible for the payment of national insurance contributions, personal tax and social security payments due in respect of any sum paid to an individual Provider under this Contract. Sums paid to individual Providers will be paid without deduction of tax.

STATUS OF PROVIDER. The Provider and his agents and employees are independent providers performing professional services for the City and are not employees of the City of Gallup. The Provider, and his agent and employees shall not accrue leave, retirement, insurance, bonding, use of City vehicles, or any other benefits afforded to employees of the City of Gallup as a result of this Agreement. Neither shall the City be liable to the Provider nor its Agents, nor their estates for any injury to person or property incurred in the course of the performance of this Agreement unless such injury shall have directly and proximately resulted from grossly negligent or reckless conduct on the part of the City or its Agents acting within the scope of their employment and official duties.
STATUS OF PROVIDER. The PROVIDER, its agents, and employees are independent contractors who perform professional services for eligible recipients served through health care programs administered by the DEPARTMENT or its AUTHORIZED AGENTS are not employees of the DEPARTMENT or its AUTHORIZED AGENTS. The PROVIDER shall not purport to bind the DEPARTMENT nor the State of New Mexico to any obligation not expressly authorized herein unless the DEPARTMENT has given the PROVIDER express written permission to do so.

STATUS OF PROVIDER. 4.1 In carrying out its obligations under this Agreement the Provider agrees that it will be acting as principal and not as the agent of Kent County Council and the Provider shall not say nor do anything that may lead any other person to believe that the Provider is acting as the agent of Kent County Council.

STATUS OF PROVIDER. 5.1 In carrying out this Agreement the Provider is acting in its own right and not as an agent of the Council and accepts responsibility for the quality of the provision for *INSERT CHILD’S NAME including the appointment of representatives to deliver specific tasks within a defined programme.
STATUS OF PROVIDER. In providing Provider services pursuant to this Agreement, Provider will be acting as an independent contractor, not as an employee of Client. In that regard, Provider and its employees will not be eligible for any employment-related benefits or be supervised by Client, and Client will not control the means and methods by which Provider and its employees provide the Services. Provider shall be solely responsible for any and all taxes due as an independent contractor and shall indemnify and hold Client harmless for all such taxes. Provider may perform services for other Clients, but only if doing so does not interfere with its ability to perform the Services provided for herein to Client. Provider and Client acknowledge that this Agreement does not create a partnership or joint venture between them.
STATUS OF PROVIDER. It is agreed and understood by and between the parties hereto that the status of Provider shall be an independent contractor retained on a contractual basis to perform professional or technical services for limited periods of time as described in §9.1.2 (C) of the Charter of City and County of Denver, and it is not intended, nor shall it be construed, Provider or its personnel are employees or officers of City under D.R.M.C. Chapter 18 for any purpose whatsoever.
