STORMS AND HURRICANES. In case of a storm or hurricane, the Environmental Manager may grant the FRANCHISEE reasonable variance from regular schedules and routes. As soon as practicable after such storm, the FRANCHISEE shall advise the Environmental Manager and the customer of the estimated time required before regular schedules and routes can be resumed. In the event the COUNTY desires that FRANCHISEE aid the COUNTY's storm cleanup contractor, FRANCHISEE's cleanup activities shall be by way of a written contract specific to that event. Rates, costs and specific cleanup activities shall be set forth. In the event of such storm or hurricane emergency, the COUNTY reserves the right to assign route or pick-up priorities as deemed necessary by the Environmental Manager.

STORMS AND HURRICANES. The Marina docks and seawall are not safe locations for vessels during tropical storms or hurricanes, and the MARINA believes significant damage to vessels and to the Marina will likely occur in a major storm if a vessel remains at the Marina docks. OWNER agrees that it is his/her sole responsibility to be aware of the threat or approach of a tropical storm or hurricane.
STORMS AND HURRICANES. (a) Marina moorings are not rated for wind-speed or hurricane categories because of the variety of vessel weights, windage and an array of stress factors. During major storms or hurricanes, the MARINA cannot assure that the moorings will hold in high wind conditions. As soon as practicable after such storm, the Franchisee shall advise the City manager and the customer of the estimated time required before regular schedules and routes can be resumed. In the case of a storm where it is necessary for the Franchisee to acquire additional equipment and to hire extra crews to clean the service area of debris and refuse resulting from the storm, the Franchisee shall work with the City in all possible ways for the efficient and rapid cleanup of the service area. The Contract shall receive extra compensation, above that provided for by the Contract agreement, for additional personnel, overtime, and cost of rental equipment, provided it has first secured prior written authorization from the City Manager, or his or her designee. The total cost for such service shall be based on rates jointly agreed upon in advance by the City and the Franchisee. In the event of such storm or hurricane emergency, the City reserves the right to assign route or pick-up priorities as deemed necessary by the City Manager. Notwithstanding the above, the Franchisee shall not be responsible for nor have an obligation to collect transport or dispose or debris or other waste material from a hurricane, severe storm or other natural or man-made disaster unless the City enters into a written agreement with Franchisee specifying the terms and compensations for such services.

Failure to comply with the foregoing will result in immediate termination of the Tenant’s Lease Agreement.

  • Vandalism Vandalism is defined as any malicious attempt to harm or destroy property of the user, another user or of any other agencies or networks that are connected to the Network or the Internet system. Vandalism also includes, but is not limited to: abusive overloading of data on the server, or the uploading, downloading or creation of computer viruses. Any engagement in network vandalism constitutes unacceptable use and will subject the student to appropriate disciplinary action.

  • Accidents and Dangerous Occurrences The Hirer must report all accidents involving injury to the public to a member of the Village Hall management committee as soon as possible and complete the relevant section in the Village Hall’s accident book. Any failure of equipment belonging to the Village Hall or brought in by the Hirer must also be reported as soon as possible. Certain types of accident or injury must be reported on a special form to the local authority. The Hall Secretary will give assistance in completing this form. This is in accordance with the Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995 (RIDDOR).
