Section B. It is recognized that discipline problems are less likely to occur in classes where a high level of student interest is maintained. It is likewise recognized that when discipline problems occur, they may most constructively be dealt with by encouragement, praise and emphasis upon the child’s desirable characteristics. Each teacher bears the primary responsibility for maintaining proper control and discipline in the classroom. The teachers recognize that all disciplinary action and methods invoked by them shall be reasonable and just.
C. A teacher may remove exclude a pupil from one class period when the grossness of the offense, the persistence of the misbehavior or the disruptive effect of the violation makes the continued presence of the student in the classroom intolerable. In such cases, the teacher will notify furnish the principal immediately and then furnish their principal principal, as promptly as his teaching obligations will allow, full particulars of the incident in writing writing. The administrator shall provide to the teacher a written explanation of the action taken by the end principal and of said school dayany follow-up the principal may expect from the teacher.
D. The employer recognizes the need to have reasonable rules established for student conduct. At the beginning of each school year, the district will publish to all students and staff of the district a copy of all rules of conduct for students as shall be in effect at the time. Any change in the rules during the school year shall be similarly published before said rules shall become effective. Students enrolling after the beginning of the year will be provided a copy of the rules by the administration on or before the student’s first day of attendance. In addition to the rules set forth above, subject to prior approval of the administration, each teacher may establish additional rules for students during the time said students are in his/her charge. Such teacher-imposed rules shall be published to the students with an indication of penalty for violation of each such rule.
E. Teachers may use such reasonable physical force as may be necessary to:
1. Protect himself/herself, pupils or others from physical injury.
2. Obtain possession of a weapon or other dangerous objects upon or within the control of a pupil.
3. Protect property from physical damage.
F. Teachers may use reasonable physical force for the purposes set forth in Section C. E above but shall not be obligated to risk his/her safety to perform such function.
G. Teachers shall not inflict, threaten to inflict or cause to be inflicted corporal punishment. Corporal punishment means the deliberate infliction of physical pain by any means upon the whole or any part of a pupil’s body as a penalty or punishment for a pupil’s offense.
H. Any case of assault or legal action upon a teacher while acting within the scope of his duties which has its inception in a school centered problem shall promptly be reported immediately in writing to the Board of its Superintendent or his designated representative. The Board will provide legal counsel to advise the teacher of his rights and obligations with respect to such assault and shall promptly render all reasonable assistance to the teacher and judicial authorities. A teacher may use such force as is necessary to protect himself from attack or to prevent injury to another student.
I. If a civil law suit is filed against a teacher as a result of disciplinary action taken by a teacher with a pupil while the teacher is acting in proper performance of his/her duties for the Board of Education, to the extent that coverage therefore does not exist under the teacher’s professional liability coverage, the Board or its insurer will provide legal counsel for the defense of any such suit or complaint and the Board of Education will render all reasonably necessary assistance to the teacher in his/her defense such as but not by way of limitation, granting leave to the teacher for court appearances, payment of court costs in cases where the defense prevails, excusing the absence of pupils who may be called as witnesses.
J. Time lost by a teacher in connection with handling of any incident mentioned in this Article shall not be charged against the incident by law enforcement and judicial authoritiesteacher.

STUDENT DISCIPLINE AND TEACHER PROTECTION. Section A. The teacher's authority and effectiveness Each teacher will be responsible for maintaining proper discipline over students in the classroom building and on school grounds during the school day. Teachers must maintain discipline of a nature conducive to study by whatever method is strengthened when there is positive most successful for that teacher within administrative guidelines set forth. When efforts to maintain student control have been exhausted, the Administration and Board recognize a responsibility to support from and assist teachers.
B. When the Administrationbuilding principal judges a teacher to be deficient in maintaining proper discipline, the following steps will be taken:
a. Informal counseling along with a written plan for improvement shall be provided by the building principal.
b. If no significant change occurs, the principal will again counsel the teacher, as well as provide a written reprimand. The teacher may respond, in writing, within ten (10) school days. This response shall be attached to the reprimand.
c. If no significant improvement occurs within ten (10) school days, the teacher shall be counseled by the principal and the superintendent.
d. If a teacher fails to improve, the Board recognizes its responsibility reserves the right to give all enforce dismissal under the Teacher Tenure Act.
C. Whenever it appears that a particular pupil requires the attention of special counselors, social workers, law enforcement personnel, physicians or other professional persons, the Board will take reasonable support and assistance steps to assist the teacher with respect to the maintenance of control and discipline in the classroomsuch pupils.
Section B. A teacher D. It is recognized that discipline problems are less likely to occur in classes which are well taught and where a high level of student interest is maintained. Teachers may remove use such force as is reasonably necessary to protect themselves from attack or to prevent injury to another student, provided such is consistent with Public Act 521 of 1989 prohibiting the use of physical force as a disciplinary measure.
E. Teachers may exclude a pupil from one class period, with the knowledge of the principal, when the grossness of the offense, the persistence of the misbehavior or the disruptive effect of the violation makes the continued presence of the student in the classroom intolerable. Section D. G. Time lost by a teacher in connection with any incident mentioned in this Article shall not be charged against the teacher, provided the teacher is not found negligent in a court of jurisdiction.
H. The Board will reimburse teachers for any unusual loss, damage or destruction of clothing or personal property (excluding car) of the teacher while on duty during normal teaching day in the school or supervision on school premises, resulting from incidents covered in this article. In the event a teacher desires to bring to class personal property of extra-curricular activities providing no negligence was shown on unusual value, it must be approved by the part of the teacher. If there is a cash amount it can not exceed $200 dollarsprincipal.
Section E. If I. No action shall be taken upon any teacher is complained against or sued by reason of disciplinary action taken by the teacher against a student, the Board will provide legal counsel in the event the action was in accordance with rules and regulations of the Board.
Section F. The Board will provide without cost to the teacher, public liability and accident coverage in an amount of not less than $100,000.00 for each accident in the course of their work, including driver education teachers, athletic coaches, and faculty sponsors of extra-curricular activities.
Section G. When a complaint is received and/or when questionable methods of discipline and/or instruction have been used by directed toward a teacher, nor shall any notice thereof be included in the teacher will be notified by the Administration within three (3) school calendar days following teacher's personnel file, unless such complaint. The following procedure will be followed:
1. If the complaint is by a parent of a student, the Administration will refer the parent matters are promptly reported in writing to the teacher involved as concerned. Should such a first step toward resolving the problem.
2. The Administration will hold a conference or conferences with the teacher, and the complaint and/or questionable methods result in active consideration of discipline and/or instructions will be discussed. No written record other than the date and nature of the conference will be kept.

If the same complaints and/or questionable methods of discipline and/or instruction continue to be used by the teacher, another conference will be called and a complete written report will be given to the teacher within three (3) school calendar days following said conference. A designated building representative of the BOEA(SMEA) will be notified of this conference by the Administration, and a designated representative of the BOEA (SMEA) will attend the conference if the teacher so desires. The teacher may file a written response to the complaint and/or questionable methods of discipline and/or instruction which will be attached to said written report.
4. Specific instructions will be given in writing and verbally to help this teacher to correct the improper procedures. It will then be expected by the Administration that the specific written instructions will be followed.
5. If further complaints are receiveddisciplinary action, the Board of Education may proceed with disciplinary procedures against the teacher as outlined by the Teacher Tenure Act.
Section H. Teachers Association shall be expected to exercise reasonable care with respect to the safety of pupils and propertynotified.
Section I. Placement of students with discipline problems is up to the Board and superintendent as by law.

The teacher must have been acting within the boundaries established by the Board and/or in a reasonable manner, as determined by the Board.
E. Time lost by a teacher in connection with any incident mentioned in Section D. C and D shall not be charged against the teacher.
F. The Board will reimburse teachers for any loss, damage or destruction of clothing or personal property of the teacher while on duty during normal teaching day or supervision of extra-curricular activities providing no negligence was shown which results from an assault on the part of teacher or an altercation in which the teacher is carrying out the teacher. If there is a cash amount it can not exceed $200 dollars’s duties, as prescribed by the Board policies.

Section H. Teachers shall be expected to exercise reasonable care with and respect to the safety of pupils and property, but shall not be individually liable, except in the case of negligence or neglect of duty, for any damage or loss to person or property.
Section I. Placement No material or complaints originating after initial employment will be placed in the teacher’s personnel file unless the teacher has had an opportunity to review the material. If such complaints are to be placed in the teacher’s personnel file the following shall take place:
1. The complaints will be put in writing.
2. Names of students with discipline problems is up complainants and Administrative action will be stated.
3. The teacher may submit a written statement regarding any material, which shall be attached to the Board file copy of the material in question.
4. If said material is deemed inappropriate by the teacher, said teacher may challenge the material through the grievance procedure.
J. Each teacher shall have the right, upon request, to review the contents of his/her own personnel file within the established guidelines of the Freedom of Information Act. A representative of the Association may be requested to accompany the teacher in such review. A representative of the Administration shall also be present during the review of personnel files.
K. Material of a derogatory nature will be removed from a teacher’s personnel file after five (5) years.
L. If the district receives an FOIA (Freedom of Information Act) request for any information concerning a teacher the District will provide the teacher with a list of what is being requested. The teacher shall have the opportunity to review the District’s proposed response and superintendent as by lawprovide input concerning the proposed response.

Section B. It is recognized that discipline problems are less likely to occur in classes where a high level of student interest is maintained. It is likewise recognized that when discipline problems occur, they may most constructively be dealt with by encouragement, praise and emphasis upon the child’s desirable characteristics. Each teacher bears the primary responsibility for maintaining proper control and discipline in the classroom. The teachers recognize that all disciplinary action and methods invoked by them shall be reasonable and just.
C. A teacher may remove exclude a pupil from one class period when the grossness of the offense, the persistence of the misbehavior or the disruptive effect of the violation makes the continued presence of the student in the classroom intolerable. In such cases, the teacher will notify furnish the principal immediately and then furnish their principal principal, as promptly as his teaching obligations will allow, full particulars of the incident in writing writing. D. The employer recognizes the need to have reasonable rules established for student conduct. At the beginning of each school year, the district will publish to all students and staff of the district a copy of all rules of conduct for students as shall be in effect at the time. Any change in the rules during the school year shall be similarly published before said rules shall become effective. Students enrolling after the beginning of the year will be provided a copy of the rules by the administration on or before the student’s first day of attendance. In addition to the rules set forth above, subject to prior approval of the administration, each teacher may establish additional rules for students during the time said students are in his/her charge. Such teacher-imposed rules shall be published to the students with an indication of penalty for violation of each such rule.
E. Teachers may use such reasonable physical force as may be necessary to:
1. Protect himself/herself, pupils or others from physical injury.
2. Obtain possession of a weapon or other dangerous objects upon or within the control of a pupil.
3. Protect property from physical damage.
F. Teachers may use reasonable physical force for the purposes set forth in Section C. E above but shall not be obligated to risk his/her safety to perform such function.
G. Teachers shall not inflict, threaten to inflict or cause to be inflicted corporal punishment. Corporal punishment means the deliberate infliction of physical pain by any means upon the whole or any part of a pupil’s body as a penalty or punishment for a pupil’s offense.
H. Any case of assault or legal action upon a teacher while acting within the scope of his duties which has its inception in a school centered problem shall promptly be reported immediately in writing to the Board of its Superintendent or his designated representative. The Board will provide legal counsel to advise the teacher of his rights and obligations with respect to such assault and shall promptly render all reasonable assistance to the teacher and judicial authorities. A teacher may use such force as is necessary to protect himself from attack or to prevent injury to another student.
I. If a civil law suit is filed against a teacher as a result of disciplinary action taken by a teacher with a pupil while the teacher is acting in proper performance of his/her duties for the Board of Education, to the extent that coverage therefore does not exist under the teacher’s professional liability coverage, the Board or its insurer will provide legal counsel for the defense of any such suit or complaint and the Board of Education will render all reasonably necessary assistance to the teacher in his/her defense such as but not by way of limitation, granting leave to the teacher for court appearances, payment of court costs in cases where the defense prevails, excusing the absence of pupils who may be called as witnesses.
J. Time lost by a teacher in connection with handling of any incident mentioned in this Article shall not be charged against the incident by law enforcement and judicial authoritiesteacher.
Section D. K. The Board will reimburse teachers teachers, not to exceed the teacher’s deductible, for any loss, damage damage, or destruction of clothing or personal property of the teacher while on duty during normal teaching day in the school or supervision of extra-curricular activities providing no negligence was shown on the part school premises, if caused by a deliberate act of the teachervandalism or malicious mischief, which has its inception in discipline of a student or as a result of rendering assistance in emergencies. STUDENT DISCIPLINE AND TEACHER PROTECTION. Section A. The teacher's authority Teachers shall be responsible for creating and effectiveness maintaining conditions conducive to learning and discipline, both in the classroom is strengthened when there is positive support from and in the Administrationperformance of other duties. The Board recognizes its responsibility to will give all reasonable support and assistance to the teacher backing of teachers with respect to the maintenance of control and discipline when teachers conform to the School Code and board policy. Whenever it appears as a result of a student's behavior that the Bargaining Unit Member requires the attention of counselors, social workers, or law enforcement officials, etc, the administration shall coordinate such help in accordance with board policy. In cases where such help does not appear to remedy the situation, the administration shall work with the teacher to relieve the situation through appropriate means according to board policy. This provision is subject to such limitations or restrictions as may be imposed by Statute or regulations adopted or promulgated by the Michigan Department of Education or its Superintendent.
B. Teachers shall exercise reasonable care with respect to the safety of pupils and property and shall follow the School Code and board policy as to Corporal Punishment. The Board will provide liability insurance protection to cover both Board and teachers.
C. Time lost by a teacher in connection with any incident mentioned in this article shall not be charged against the teacher; provided, the Board in its exclusive discretionary determination concludes that said incident is not attributable due to the neglect, act or omission of such teacher.
D. Serious complaints by a parent, guardian or a student concerning the professional competence of an individual teacher shall within five (5) school days be called to the said teacher's attention. A record of complaint shall not be placed in the classroomteacher's personnel file unless the actual complaint contains the name of the informant.
