Styrene. Pursuant to an agreement dated August 30, 1999, Shell, through a local operating subsidiary, supplies, and we purchase, a nominated volume of styrene per year for our manufacturing facility in the U.S. We purchased approximately 45,000, and 39,000 metric tons of styrene pursuant to this agreement in 2001 and 2002, respectively. Pursuant to an agreement dated August 4, 2000, we purchase a minimum of 28,000 metric tons, and Shell, through a local operating subsidiary, supplies a maximum of 40,000 metric tons, of styrene per year in aggregate for our manufacturing facilities in The Netherlands, France, and Germany. The agreed annual quantities are subject to increase or decrease upon annual review by the parties. The initial term of each agreement ends December 31, 2005 and will automatically renew indefinitely subject to 12 months prior written notice of termination by either party. In the U.S., Shell charges a price based on market prices for styrene, subject to a minimum based on the market prices for benzene and ethylene, the chemicals from which styrene is produced. Notwithstanding this price floor, however, Shell will match any lower price for available styrene of like quality and quantity produced in the U.S. under similar terms and conditions or will deduct from our remaining annual obligation all quantities we purchase at this price. In Europe, Shell charges a price based on market indicators, including market prices for benzene and ethylene and labor costs.

Styrene. Working with the industry and other interested parties promulgate a rule by December 2000, establishing emission standards for styrene from the fiberglass reinforced plastics industry. Publish a non-rule policy document by November 1999, addressing transitional issues prior to rule effectiveness, and develop and distribute compliance assistance information. Status: Nonrule Policy Document - 100% complete. Rule - 100% complete.

Styrene. There have been fewer experimental studies on the combustion of styrene as shown in Table 4. The first kinetic experiments were made by Xxxxxxxxx et al. in 1896 (41) and concerned its oxidation in an atmospheric flow reactor at temperatures around 1060 K. The main stable products detected were CO, methane, ethane, benzene, phenol and cyclopentadiene. After that, Xxxxx et al. (42) were the first to study the unimolecular decomposition of styrene. The experiments were carried out at very low pressure between 1180 and 1350 K. In 2001, Xxxxxxxxx et al. (43) investigated the ignition delay times of styrene in a shock tube at the pressures of 1.43 atm and temperatures of 1300-2000 K. Concerning JSR study, there is not data for neat styrene as reactant. However, Xxxx et al. (44) investigated the oxidation of a styrene/benzene mixture at three equivalences ratios (Φ= 0.5, 1 and 1.5), at 10 atm and over the temperature range of 1000-1357 K. The main stable products detected were small hydrocarbons (methane, ethane, and ethylene), with also benzene, phenol, and benzaldehyde. A detailed chemical kinetic model of the combustion of styrene including 290 species and 1786 reactions was established and validated.

  • Asbestos Any material that contains more than one percent asbestos and is friable or is releasing asbestos fibers into the air above current action levels established by the United States Occupational Safety and Health Administration.

  • Storage Tanks If storage tanks storing Hazardous Materials located on the Premises or the Project are used by Tenant or are hereafter placed on the Premises or the Project by Tenant, Tenant shall install, use, monitor, operate, maintain, upgrade and manage such storage tanks, maintain appropriate records, obtain and maintain appropriate insurance, implement reporting procedures, properly close any storage tanks, and take or cause to be taken all other actions necessary or required under applicable state and federal Legal Requirements, as such now exists or may hereafter be adopted or amended in connection with the installation, use, maintenance, management, operation, upgrading and closure of such storage tanks. Notwithstanding anything to the contrary contained herein, Tenant shall have no right to use or install any underground storage tanks at the Project.

  • Hazardous Substances The words "Hazardous Substances" mean materials that, because of their quantity, concentration or physical, chemical or infectious characteristics, may cause or pose a present or potential hazard to human health or the environment when improperly used, treated, stored, disposed of, generated, manufactured, transported or otherwise handled. The words "Hazardous Substances" are used in their very broadest sense and include without limitation any and all hazardous or toxic substances, materials or waste as defined by or listed under the Environmental Laws. The term "Hazardous Substances" also includes, without limitation, petroleum and petroleum by-products or any fraction thereof and asbestos.

  • Waste Borrower shall not commit or suffer any waste of the Property or make any change in the use of the Property which will in any way materially increase the risk of fire or other hazard arising out of the operation of the Property, or take any action that might invalidate or give cause for cancellation of any Policy, or do or permit to be done thereon anything that may in any way impair the value of the Property or the security of this Security Instrument. Borrower will not, without the prior written consent of Lender, permit any drilling or exploration for or extraction, removal, or production of any minerals from the surface or the subsurface of the Land, regardless of the depth thereof or the method of mining or extraction thereof.

  • Materials of Environmental Concern have not been transported or disposed of from the Properties in violation of, or in a manner or to a location that could give rise to liability under, any Environmental Law, nor have any Materials of Environmental Concern been generated, treated, stored or disposed of at, on or under any of the Properties in violation of, or in a manner that could give rise to liability under, any applicable Environmental Law;

  • Anti-Layering The Company shall not incur, create, issue, assume, guarantee or otherwise become liable for any Indebtedness that is both (a) subordinate or junior in right of payment to any Senior Debt and (b) senior in any respect in right of payment to the Notes. No Subsidiary Guarantor shall incur, create, issue, assume, guarantee or otherwise become liable for any Indebtedness that is both (a) subordinate or junior in right of payment to its Senior Debt and (b) senior in right of the Section 4.9 hereof.

  • Hazardous Substance Hazardous Substance" shall mean any chemical, substance, material, or waste, including without limitation asbestos, PCBs and formaldehyde, that is defined, classified, listed, or designated as hazardous, toxic, or radioactive, or by other similar term, by any federal, state, or local environmental statute, regulation, rule, order, or ordinance presently in effect.

  • Hazardous Wastes Are hazardous wastes generated? Yes ☐ No ☐ If yes, continue with the next question. If not, skip this section and go to section 4.0.

  • Materials of Environmental Concern “Materials of Environmental Concern” include chemicals, pollutants, contaminants, wastes, toxic substances, petroleum and petroleum products and any other substance that is now or hereafter regulated by any Environmental Law or that is otherwise a danger to health, reproduction or the environment.

  • HAZARDOUS SUBSTANCE CONDITIONS If a Hazardous Substance Condition occurs, unless Lessee is legally responsible therefor (in which case Lessee shall make the investigation and remediation thereof required by Applicable Requirements and this Lease shall continue in full force and effect, but subject to Lessor's rights under Paragraph 6.2(c) and Paragraph 13), Lessor may at Lessor's option either (i) investigate and remediate such Hazardous Substance Condition, if required, as soon as reasonably possible at Lessor's expense, in which event this Lease shall continue in full force and effect, or (ii) if the estimated cost to investigate and remediate such condition exceeds twelve (12) times the then monthly Base Rent or $100,000 whichever is greater, give written notice to Lessee within thirty (30) days after receipt by Lessor of knowledge of the occurrence of such Hazardous Substance Condition of Lessor's desire to terminate this Lease as of the date sixty (60) days following the date of such notice. In the event Lessor elects to give such notice of Lessor's intention to terminate this Lease, Lessee shall have the right within ten (10) days after the receipt of such notice to give written notice to Lessor of Lessee's commitment to pay for the excess costs of (a) investigation and remediation of such Hazardous Substance Condition to the extent required by Applicable Requirements, over (b) an amount equal to twelve (12) times the then monthly Base Rent or $100,000, whichever is greater. Lessee shall provide Lessor with the funds required of Lessee or satisfactory assurance thereof within thirty (30) days following said commitment by Lessee. In such event this Lease shall continue in full force and effect, and Lessor shall proceed to make such investigation and remediation as soon as reasonably possible after the required funds are available. If Lessee does not give such notice and provide the required funds or assurance thereof within the time period specified above, this Lease shall terminate as of the date specified in Lessor's notice of termination.
