Common use of Subcontracted Maintenance Services Clause in Contracts

Subcontracted Maintenance Services. To the extent that any Change Order is intended to compensate Maintenance Contractor for the cost of work performed by Subcontractors, the Change Order shall provide for compensation equal to: (a) the actual cost to Maintenance Contractor of such work (which shall be charged by the Subcontractor on a time and materials basis in accordance with this Section 10.7, unless otherwise approved in writing by TxDOT), plus (b) 5% of such cost. The 5% markup for subcontracted work shall not apply to: (i) Subcontracts with Affiliates; or (ii) Subcontracts with Suppliers.
