SUBJECT MATTER OF THIS DATA PROCESSING AGREEMENT. 1.1 This Data Processing Agreement applies exclusively to the Processing of Personal Data that is subject to the EU Data Protection Law and that is provided to the Data Processor by the Data Controller pursuant to the Terms of Service entered into between the Parties (together with any amendments, the “Service Agreement”), under which the Data Processor provides access and use of its geo mapping and analytics software application and related services (the “Services”). The Service Agreement remains in full force and effect in accordance with its terms; provided however, that if there is a conflict between the terms of this Data Processing Agreement and the Service Agreement, the terms of the Data Processing Agreement shall prevail with respect to the Data Processor’s Processing of Personal Data.
