Subpoena Compliance. If Customer or Netradyne receives a subpoena relating to Customer’s billing records, or any information collected from or processed in connection with the Hardware, the Firmware or the Services, Customer or Netradyne agree to promptly notify the other of the subpoena, and to assist the other with compliance.
Subpoena Compliance. If a law enforcement agency produces to any SIG Party a valid subpoena relating to End User MDN/MSID billing records or End User information, including End User name, address and credit information, such SIG Party must honor such subpoena by providing the requested information to such law enforcement agency within the timeframe specified in such subpoena to the extent required by law. If such subpoena requests information not provided by Sprint to such SIG Party in its normal billing practice, such SIG Party must promptly contact the Sprint representative designated in the Private Label Operations Manual for assistance in compliance so that the timeframe specified in such subpoena can be met subject to any actions such SIG Party may take to contest such subpoena. If such SIG Party either: (a) fails to provide the End User phone records requested in such subpoena; (b) fails to provide the End User phone records requested in such subpoena within the timeframe specified in such subpoena; or (c) fails to promptly contact the designated Sprint representative for assistance when such subpoena requests information not provided by Sprint to such SIG Party in its normal billing practice, and if Sprint is fined by a court of law as a direct result of any failure described in (a), (b) or (c) above, such SIG Party will reimburse Sprint for the amount of such fine; provided that Sprint shall, to the extent requested by such SIG Party, contest such fine at such SIG Party’s cost and expense.
Subpoena Compliance. If Customer receives a subpoena relating to End User billing records or any End User information, Customer will comply with the subpoena. If the subpoena requests information not in Customer’s possession, Customer will promptly contact Sprint for assistance in compliance with the subpoena. If Customer either: (i) fails to comply with the subpoena; or (ii) when applicable, fails to promptly contact Sprint for assistance, and if Sprint is fined as a result of Customer’s failure described in (i) or (ii) above, Customer will reimburse Sprint for the amount of the fine.

If Trial User or NetraDyne receives a subpoena relating to Trial User’s billing records, or any information collected from or processed in connection with the Evaluation Materials, Trial User or NetraDyne agree to promptly notify the other of the subpoena, and to assist the other with compliance.
Subpoena Compliance. If a law enforcement agency contacts Qwest with a subpoena relating to End User MDN billing records or End User information, including but not limited to, End User name, address and credit information, Qwest must honor the subpoena.
Subpoena Compliance. If a law enforcement agency contacts VMU with a subpoena relating to End User MIN billing records or End User information, including but not limited to, End User name, address and credit information, VMU must honor the subpoena by providing the requested information to such law enforcement agency within the timeframe specified in the subpoena. If the subpoena requests information not provided by Sprint PCS to VMU in its normal billing practice, VMU must promptly contact the Sprint PCS representative designated in the Operations Manual for assistance in compliance so that the timeframe specified in the subpoena can be met. If VMU either: (a) fails to provide the End User phone records requested in the subpoena; (b) fails to provide the End User phone records requested in the subpoena within the timeframe specified in the subpoena; or (c) fails to promptly contact the designated Sprint PCS representative for assistance when the subpoena requests information not provided by Sprint PCS to VMU in its normal billing practice, and if Sprint PCS is fined by a court of law as a direct result of VMU’s failure described in (a), (b) or (c) above, VMU will reimburse Sprint PCS for the amount of such fine.

If the subpoena requests information not in the possession of Purchaser, Purchaser will promptly contact the Sprint representative designated in the Private Label Operations Manual for assistance in compliance with the subpoena.

If Sprint fails to comply with its obligations contained in this paragraph for reasons other than Purchaser’s acts or omissions and if Purchaser is fined by a court of law as a direct result of such failure, Sprint will reimburse Purchaser for the amount of such fine.
