Common use of Substitution (Trading) of Time Clause in Contracts

Substitution (Trading) of Time. If a member, with the approval of his or her supervisor, and solely at the member’s option, agrees to substitute during scheduled hours for another member, except as required by the Fair Labor Standards Act (FLSA), the hours the member works as a substitute shall be excluded by the Authority in the calculation of hours worked for purposes of computing overtime eligibility.‌ A member whose shift is worked by another member will not be permitted to take vacation or compensatory time for the shift, which he or she has agreed to work in trade. The member who works the shift for the originally assigned member will be paid his or her regular rate of pay for the shift. Where a supervisor’s approval has been received allowing members to substitute for one another or trade shifts, it is the responsibility of the member originally assigned to the shift to ensure that the assignment is fulfilled.
