Sufficient Staff. At all times the Assuming Institution shall retain sufficient staff to discharge its obligations pursuant to this Agreement. Without limiting the generality of the foregoing, and with respect to the consideration and evaluation of loan modification and loss mitigation options concerning Shared-Loss Loans, at all times the Assuming Institution shall retain sufficient designated loss mitigation staff so that (i) Obligors are apprised of loan modification and loss mitigation options, (ii) each Obligor who is being considered for a loan modification or other loss mitigation option shall have a single contact person on the Assuming Institution’s staff to respond to Obligor inquiries concerning the loan modification process and (iii) foreclosure actions are not taken while an Obligor request for a loan modification or other loss mitigation option is pending or if the Obligor is current on a trial or permanent loan modification.
Sufficient Staff. Construction Manager and Trade Contractors shall maintain and assign to the Work, at all times, sufficient staff and personnel to perform their services in a skilled, professional and satisfactory manner so as not to delay the progress of the Work.
