SURS cap on end of career earnings. The College shall not increase a faculty member’s earnings (defined as any earnings used to calculate the Final Rate of Earning or FRE) for any year of the faculty member’s annual earnings for purposes of SURS retirement annuity calculation above six percent (6%). The purpose of this provision is to ensure that the College shall not incur any financial penalty or any additional SURS contribution under the Illinois Pension Code and/or SURS rules and regulations. Notwithstanding any contrary or other provision of this contract, including but not limited to any salary schedules, in the event a faculty member’s SURS earnings would increase by more than 6% in any given year of this contract, that faculty member shall only receive the maximum increase allowed under this provision. This provision shall only apply to teachers who are within 4 years of SURS retirement eligibility, regardless of whether the faculty member intends to retire or submit a notice of retirement. A distribution from a Xxxxxxxxx Education Savings Account may be rolled over to another beneficiary’s Xxxxxxxxx Education Savings Account according to the requirements of Section (4). Note that the Economic Growth and Tax Relief Reconciliation Act of 2001 waives the distribution age limitation if the beneficiary of the Xxxxxxxxx Education Savings Account is a “Special Needs” student.

If the employee meets the skills and abilities requirements of the position and chooses to remain in the reallocated position, the employee retains existing appointment status and has the right to be placed on the Employer’s internal layoff list for the classification occupied prior to the reallocation.
