Common use of System Design Clause in Contracts

System Design. SolarPorts shall provide Customer with a System design via email. Customer shall approve such System design in writing if Customer is satisfied with the design. If Customer seeks to change the System design after Customer has provided written approval, Customer shall be subject to the following charges: (i) re-design charges at $95/hour, (ii) installation crew charges of $60/hour for each crew member that is present at the Site if re-design is done on Installation Date while crew members are already on site, and (iii) permit processing fee of $500 plus any city/county permit filing fees. Shading from nearby trees and/or buildings can significantly impact energy production of the System. Upon Customer request, SolarPorts's design team is available to consult with a certified arborist and provide shading impact reports to Customer; however, SolarPorts is not responsible for any impacts to the System's energy production based on shading conditions at the Site. Customer is responsible for maintaining any trees or foliage that may affect the System's energy production.
