Common use of Taking of Maternity Leave Clause in Contracts

Taking of Maternity Leave. (a) Subject to sub-clause (c), an eligible employee may start a continuous period of leave including (or constituted by) maternity leave to which she is entitled at any time within 6 weeks before the expected date of birth of the child. (b) Subject to sub-clause (c), a continuous period of leave including (or constituted by) maternity leave must include a period of leave of at least 6 weeks starting from the date of birth of the child. (c) If the employee continues to work during the period of 6 weeks before the expected date of birth, the employer may ask the employee to give the employer a medical certificate containing the following statement or statements: (i) a statement of whether the employee is fit to work; (ii) if, in the opinion of the medical practitioner, the employee is fit to work—a statement of whether it is inadvisable for the employee to continue in her present position for a stated period because of: (A) illness, or risks, arising out of the pregnancy; or (B) hazards connected with the position.
