No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off school premises. D. The Board agrees to furnish to the Association in response to reasonable requests to the Superintendent all available information which is public information concerning the financial resources of the district, including but not limited to: annual financial reports and audits, register of certified personnel, budgets, agendas and minutes of Board of Education meetings, treasurer’s reports, census and membership data, names and addresses of all teachers, curriculum committee meeting minutes, and building construction reports if available. In addition the Board agrees to provide at the district’s expense a copy of the Board Book and/or including handout to the Association President within two (2) days of each School Board meeting. E. The Association shall be encouraged to appoint committees to study such matters as school finance, construction, and policy so that the advice of such committees shall be presented to the Board of Education at the end of each semester and/or as requested by the Board. F. At all times teachers will be entitled to have a representative of the Association present at meetings relating to the infraction of any rules or delinquency in professional performance of a teacher. The meeting will be conducted at a location where privacy is assured. The Association and its representatives shall have the right to use the school buildings and equipment in accord with the following regulations: The principal or superintendent shall designate what areas or rooms are available for meetings and or use; where extra maintenance or service costs are involved, the Association will assume this cost; Association meetings shall not interfere with other regularly scheduled activities; the Association’s bulletin board shall be restricted to official organization materials. If the building administrator considers the posted materials objectionable s/he shall bring it to the attention of the Association President and Superintendent of Schools at which time the material shall be removed. The president and superintendent shall meet to discuss the objections and by mutual agreement resolve the issue. The Association may use the District’s mailboxes and pick up and delivery service for communications to teachers. D. Duly authorized by representatives of the Association shall have the right to transact official Association business on school property at reasonable times, provided that this shall not interfere with or interrupt normal school operations. Any plans, strategies, or objectives which conflict with the Master Agreement will require mutual agreement between the Xxxxxx-Xxxxxx Education Association and the Xxxxxx-Xxxxxx Board of Education. 2. The Xxxxxx-Xxxxxx Education Association shall approve any and all teacher representatives to any district or building committee formed for the purpose of Site Based Decision Making, Building Level Decision Making, etc. 3. The participation in the above mentioned committees or councils shall be voluntary on the part of the bargaining unit members. C. The Association and committees authorized by its representatives shall have the Association shall be allowed the right to use of school building facilities buildings at any time in accordance with regular scheduling procedures for meetings provided that when special custodial service is required the current Board may make a reasonable charge therefore. No charge shall be made for use of schoolrooms before the commencement of the school facility day nor until 6:00 p.m. D. The Association and its representatives shall have the right to use policies school facilities and formsequipment for Association business in the building in which it is located, including available technology at reasonable times when such equipment is not otherwise in use. The Association will shall pay for the reasonable cost of all materials and supplies incident to such use. The person operating each piece of equipment shall be allowed trained to operate that machine prior to the use of established communication facilities exclusive of televisionuse. C. E. Duly authorized representatives of the Association and their respective affiliates shall be permitted to transact official Association business on school property during school hours provided that this shall not interfere with scheduled assignments. Interfering with scheduled assignments means diverting the teacher who is directly responsible for student(s) at that time. F. The Association shall have the exclusive right to post notices of activities and matters of Association concern on one teacher bulletin board for each building. The Board will furnish this equipment, the location of which will not replace an existing bulletin board. The Association may use the district mail service and teacher mailboxes for communications to teachers concerning Association business. Association members who have been given access to the District's network may use the electronic mail service for communications pertaining to Association business. G. The Board agrees to furnish the Association in response to reasonable requests from time to time all available information concerning the financial resources of the district, including, but not limited to: annual financial reports and audits, register of certified personnel, agendas and minutes of all Board meetings, treasurer's reports, census and membership data, names and addresses of all teachers, and such other information as will assist the Association in developing intelligent, accurate, information and constructive programs on behalf of the teachers and their students. H. The Board may consult with the Association on any new or modified fiscal, budgetary or tax program, construction programs or major revisions of educational policy, which are proposed or under consideration and the Association may be given opportunity to advise the Board with respect to said matters prior to their adoption and/or general publication. I. The teachers shall be entitled to full rights of citizenship and no religious or political activities of any teacher or the lack thereof shall be grounds for discrimination with respect to the professional employment of such teacher. J. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off the school premises. D. K. No non-teaching professional staff member shall be discharged, disciplined, reprimanded, reduced in rank or compensation or deprived of any professional advantage without just cause. The Board agrees foregoing standard shall not apply to furnish non-renewal or dismissal of a probationary non-teaching professional staff member. For purposes of this Agreement the probationary period for a non-teaching professional staff member shall be the non-teaching professional staff member’s first four school year period in the employ of Xxxxxx-Xxxxxx Schools. Those non-teaching professional staff members hired on or after September 1, 2012 shall have a probationary period of five (5) years. Any such discipline shall be subject to the grievance procedure hereinafter set forth, including arbitration, except as otherwise specified in Article 16/Grievance Procedure. Procedures regarding all such action as outlined here shall be: 1. Prior to initiating any measure against a non-teaching professional staff member as described in paragraph K above, the Board shall inform said staff member of his rights to representation by the Association. 2. Should the non-teaching professional staff member request representation by the Association, all action by the Board regarding the matter or matters shall be deferred for a least forty-eight (48) hours to allow such Association representatives, as determined by the non-teaching professional staff member, to be present. In instances involving such issues where the continued presence of the non-teaching professional staff member could reasonably be assumed to cause and/or immediately threaten the welfare of the student(s), the administration may temporarily suspend the non-teaching professional staff member with pay pending further investigation in response accordance with this section. The Association specifically reserves the right to reasonable requests utilize the grievance procedure should such administrative action authorized herein not be deemed proper and necessary. 3. Prior to any meeting called by the Board to discuss such matter or matters and, in time to allow for an adequate review, the Board shall provide the Association and the non-teaching professional staff member with full particulars, including written documentation when applicable, of the matter or matters in question. L. A teacher with or without his representative(s) will be allowed to review his official personnel file under the supervision of the Superintendent or his designee. M. The Association and Superintendent shall discuss and recommend teacher representatives to the District Improvement Team. The Xxxxxx-Xxxxxx Education Association shall be entitled to one (1) representative on each of the component teams of the District Improvement Team. The Association President shall submit three (3) nominees to the Superintendent all available information which is public information concerning the financial resources for each of the district, including but not limited to: annual financial reports and audits, register of certified personnel, budgets, agendas and minutes of Board of Education meetings, treasurer’s reports, census and membership data, names and addresses of all teachers, curriculum committee meeting minutes, and building construction reports if availableappointments to the Association-designated positions on the components teams. J. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off the school premises. D. K. No non-teaching professional staff member shall be discharged, disciplined, reprimanded, reduced in rank or compensation or deprived of any professional advantage without just cause. The Board agrees foregoing standard shall not apply to furnish non-renewal or dismissal of a probationary non-teaching professional staff member. The Board may consult with the Association on any new or modified fiscal, budgetary or tax program, construction programs or major revisions of educational policy, which are proposed or under consideration and the Association may be given opportunity to advise the Board with respect to said matters prior to their adoption and/or general publication. I. The teachers shall be entitled to full rights of citizenship and no religious or political activities of any teacher or the lack thereof shall be grounds for discrimination with respect to the professional employment of such teacher. J. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off the school premises. D. K. No non-teaching professional staff member shall be discharged, disciplined, reprimanded, reduced in rank or compensation or deprived of any professional advantage without just cause. The Board agrees foregoing standard shall not apply to furnish non-renewal or dismissal of a probationary non-teaching professional staff member. For purposes of this Agreement the probationary period for a non-teaching professional staff member shall be the non-teaching professional staff member’s first four school year period in the employ of Xxxxxx-Xxxxxx Schools. Those non-teaching professional staff members hired on or after September 1, 2012, shall have a probationary period of five (5) years. Any such discipline shall be subject to the grievance procedure hereinafter set forth, including arbitration, except as otherwise specified in Article 16/Grievance Procedure. Procedures regarding all such action as outlined here shall be: 1. Prior to initiating any measure against a non-teaching professional staff member as described in paragraph K above, the Board shall inform said staff member of his rights to representation by the Association. 2. Should the non-teaching professional staff member request representation by the Association, all action by the Board regarding the matter or matters shall be deferred for at least forty-eight (48) hours to allow such Association representatives, as determined by the non-teaching professional staff member, to be present. In instances involving such issues where the continued presence of the non-teaching professional staff member could reasonably be assumed to cause and/or immediately threaten the welfare of the student(s), the administration may temporarily suspend the non-teaching professional staff member with pay pending further investigation in response accordance with this section. The Association specifically reserves the right to utilize the grievance procedure should such administrative action authorized herein not be deemed proper and necessary. 3. Prior to any meeting called by the Board to discuss such matter or matters and, in time to allow for an adequate review, the Board shall provide the Association and the non-teaching professional staff member with full particulars, including written documentation when applicable, of the matter or matters in question. L. For tenured teachers, consistent with the Teachers’ Tenure Act, discipline may only be issued for reasons that are not arbitrary or capricious and the parties subscribe to the concept of progressive discipline as required by law. The district reserves the right to apply disciplinary measures consistent with the severity of the infraction. 1. All discipline will be in writing and placed in an individual’s personnel file, and the teacher will be forwarded a copy. 2. Bargaining unit members have full Xxxxxxxxxx rights. Should a teacher request representation by the Association, all action may be deferred for 48 hours to allow a representative to be available, if one is not available. 3. Probationary teachers cannot grieve discipline. Tenured teachers may only grieve discipline up to, but not including, arbitration. This article does not limit a tenured teacher's right to appeal to the State Tenure Commission a “demotion” or “termination" pursuant to the protections outlined in the Michigan Teachers Tenure Act. M. A teacher with or without his representative(s) will be allowed to review his official personnel file with reasonable requests notice under the supervision of the Superintendent or his designee. N. The Association and Superintendent shall discuss and recommend teacher representatives to the District Improvement Team. The Xxxxxx-Xxxxxx Education Association shall be entitled to one (1) representative on each of the component teams of the District Improvement Team. The Association President shall submit three (3) nominees to the Superintendent all available information which is public information concerning the financial resources for each of the district, including but not limited to: annual financial reports and audits, register of certified personnel, budgets, agendas and minutes of Board of Education meetings, treasurerappointments to the Association-designated positions on the component’s reports, census and membership data, names and addresses of all teachers, curriculum committee meeting minutes, and building construction reports if availableteams. In addition the Board agrees to provide at the district’s expense a copy The final selection of the Board Book and/or including handout to other teacher representatives shall be the prerogative of the Superintendent. The Association President within two (2) days shall serve as an ad hoc member to each of each School Board meetingthe component teams. E. O. The President and the President-elect of the Association shall be encouraged provided with a direct dial telephone, including long distance service, in their classrooms and entry keys for their respective buildings as well as entry key access to appoint committees to study such matters as school finance, construction, and policy so that an agreed upon meeting room for each building in the advice District for the purpose of such committees shall be presented to conducting the Board of Education at the end of each semester and/or as requested by the Board. F. At all times teachers will be entitled to have a representative business of the Association present at meetings relating to the infraction of any rules or delinquency in professional performance of a teacher. The meeting will be conducted at a location where privacy is assured. When request for such representation is made, no action shall be taken with respect to the teacher until such representative is present. The Association shall endeavor to provide representation within two (2) working days. TEACHER AND ASSOCIATION RIGHTS. X. Xxxxxxxx A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every employee of the Board shall have the right freely to organize, join, join and support the Association Association, or to choose not to do so, for the purpose of engaging in collective bargaining or negotiation and other lawful concerted activities for mutual aid and protection. As a duly duly-elected body exercising governmental power under color cover of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment or employment of any rights conferred by Act 379 or other laws of Michigan or the Constitution of Michigan and the United States of America379; that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her the teacher’s membership or non-membership in the Association, his/her the teacher’s participation or non-participation in any activities of the Association or collective professional negotiations with the Board, or his/her institutionthe teacher’s institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment. B. Nothing contained herein shall be construed to deny or restrict to any teacher rights they may have under the Michigan General School Laws or applicable laws and regulations. The rights granted to teachers hereunder shall be deemed to be in addition to those provided elsewhere. C. The Board specifically recognizes the right of its employees to appropriately invoke the assistance of a mediator or an arbitrator appointed pursuant to the provisions of this Agreement. The Board and the teachers of the Association agree to be bound by any lawful order or award thereof. D. The Association and committees authorized by its members shall have the Association shall be allowed the right to use of school building facilities when the school is normally open for meetings if such use is not in accordance conflict with the current scheduled school facility use policies and formsactivities, consistent with Board Policies. The Association will be allowed the use of established communication facilities exclusive of television. C. Bulletin board space shall be made available to the Association in the teacher lounge of each building. The Board agrees to furnish to the Association in response to reasonable requests requests, from time to the Superintendent time, all available information which is public pertinent information concerning the financial resources of the districtDistrict, including but not limited to: annual financial reports tentative budgetary requirements and audits, register of certified personnel, budgets, agendas and minutes of Board of Education meetings, treasurer’s reports, census and membership data, names and addresses of all teachers, curriculum committee meeting minutesallocations, and building construction reports if available. In addition such other information as will assist the Board agrees to provide at the district’s expense a copy Association in developing intelligent, accurate, informed and constructive programs on behalf of the Board Book and/or including handout to teachers and their students together with information which may be necessary for the Association President within two (2) days of each School Board meetingto process any grievance or complaint. E. The Association shall be encouraged to appoint committees to study such matters as school finance, construction, and policy so that the advice of such committees shall be presented to the Board of Education at the end of each semester and/or as requested by the Board. F. At all times teachers will be entitled to have a representative of the Association present at meetings relating to the infraction of any rules or delinquency in professional performance of a teacher.
