TEACHER AND ASSOCIATION RIGHTS. A. Pursuant to Act 379 of the Public Acts of 1965, the Board hereby agrees that every member of the recognized bargaining unit shall have the right freely to organize, join, and support the Association for the purpose of engaging in collective bargaining or negotiations and other concerted activities for mutual aid and protection. As a duly elected body exercising government power under color of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by Act 379 or other laws of Michigan or Constitutions of Michigan and the United States; that it will not discriminate against any teacher with respect to hours, wages or any terms or conditions of employment by reason of his/her membership in the Association or any other teacher organization, his/her participation in any activities of the Association or of any other teacher organization, his/her participation in collective professional negotiations with the Board, or his/her institution of any grievance, complaint or proceeding under this Agreement, or otherwise, with respect to any terms or conditions of employment. B. No teacher shall be prevented from wearing insignia pins or other identification of membership in the Association or any other teacher organization either on or off school premises. Bulletin boards and other established media of communication shall be made available for the use of the Association and its members, in an area not frequented by students. Such use will be appropriate and professional in nature. C. The Association and its members shall have the right, upon previous notification to the building principal, to use available school facilities for meetings between the close of school and 10:00 p.m. provided such school buildings have night custodial personnel. Meetings whose activities may exceed the 10:00 p.m. limit may also be arranged for by previous notification to the building principal. D. The Board agrees to furnish, without cost, to the Association in response to reasonable requests, all information in the format available concerning the financial resources of the District and other such reasonably available information as will assist the Association in negotiations and implementation of this Agreement and in the processing of any grievance. E. The Board will continue to provide for inservice workshops for all teaching staff on a released-time basis. The Board and Association, through the Professional Development Policy Board, composed of at least 50% teachers, will cooperate in planning of those inservice sessions for staff on a released-time basis which are scheduled in the annual calendars which accompany this Agreement. The Professional Development Policy Board shall make its recommendations to the appropriate administrator. If the administrator declines to approve a program recommended by the committee, he/she shall give reasons to the committee in writing. Both parties also recognize the importance of systematic staff development and training beyond scheduled sessions. The Professional Development Policy Board will monitor and assist in this process upon request. F. The Board agrees to provide released time for the president, other officers, and committee chairs of the Association, as deemed necessary by the Association. There shall be no deduction from salaries, provided that the Association shall pay for the cost of any necessary substitutes. No released time shall be granted unless the Association notified the building principal's office in writing forty-eight (48) hours in advance of the proposed absences. Whenever meetings of mutual benefit to the Board and the Association are called by the Superintendent, the Superintendent may, at his/her discretion, schedule such meetings during the normal school day, and the Board shall pay the cost of released time for the Association representatives requested to attend. G. The Board agrees to provide for the Association the use of school equipment and facilities for the duplication of printed materials provided such use does not interfere with or interrupt normal school operations. The Association agrees to assume the cost of repair to school equipment if damaged while in use for Association business. The Association shall furnish its own materials for such purposes and shall not use school materials. H. The Board agrees to reasonable payroll deductions as requested by the Association which shall include, but not be limited to: 1. Davison Education Association Dues or representation fee 2. Flint Area School Employees Credit Union 3. United Fund 4. Savings Bonds 5. Tax Deferred Annuities 6. MESSA and MEFSA programs 7. Xxxxxx Xxxx 8. Xxxxxxx Educational Foundation I. The Board agrees to forward to the Association President an agenda and minutes of each school board meeting at the time each are distributed to the school board members. J. The representative of the Board will review with the Association designated representatives any millage or bond issue proposals prior to final action by the Board. K. Building principals will discuss ordering procedures with teachers in advance of the ordering deadlines. L. By November 1 of each year, the Board shall furnish each teacher with information regarding Schedule A (salary, step and degree level), longevity rate, professional hourly rate, and daily (per diem) rate. M. Duly authorized representatives of the Association, as specified in writing to the building principal at the beginning of each school year, shall be permitted to transact official Association business on school property provided that this shall not interfere with or interrupt normal school operations. Any Association representative from outside the building must inform office personnel (if available) upon entering the building. N. The Association and the Board shall negotiate the annual school calendar to the extent allowed by law. O. If any provision of the Agreement or any application of the Agreement to any employee or group of employees shall be found contrary to law, then such provision or application shall be deemed null and void except to the extent permitted by law, but all other provisions or applications shall continue in full force and effect. In such cases, the parties agree to meet to renegotiate the provision(s) within thirty (30) days. P. Notwithstanding their employment, teachers shall be entitled to full rights of citizenship, and no religious or political activities of any teacher or the lack thereof shall be grounds for any discipline or discrimination with respect to the professional employment of such teacher. The private and personal life of any teacher is not within the appropriate concern or attention of the Board. The teacher, however, shall agree to govern his/her private and personal life, insofar as it affects his/her teaching position, by the principles and provisions of the basic code of professional ethics as recognized by the Association.

All matters pertaining to wages, hours, and other terms and conditions of employment, including the negotiation of an agreement on behalf of the employees shall be prevented from wearing insignia pins the sole responsibility of the Xxxxxx-Xxxxxx Education Association. Any plans, strategies, or other identification objectives which conflict with the Master Agreement will require mutual agreement between the Xxxxxx-Xxxxxx Education Association and the Xxxxxx-Xxxxxx Board of membership Education. 2. The Xxxxxx-Xxxxxx Education Association shall approve any and all teacher representatives to any district or building committee formed for the purpose of Site Based Decision Making, Building Level Decision Making, etc. 3. The participation in the Association above mentioned committees or any other teacher organization either on or off school premises. Bulletin boards and other established media of communication councils shall be made available for voluntary on the use part of the Association and its bargaining unit members, in an area not frequented by students. Such use will be appropriate and professional in nature. C. The Association and its members representatives shall have the right, upon previous notification to the building principal, right to use available school facilities buildings at any time in accordance with regular scheduling procedures for meetings between provided that when special custodial service is required the close Board may make a reasonable charge therefore. No charge shall be made for use of schoolrooms before the commencement of the school and 10:00 p.m. provided such school buildings have night custodial personnel. Meetings whose activities may exceed the 10:00 p.m. limit may also be arranged for by previous notification to the building principal.day nor until 6:00 p.m. D. The Board agrees Association and its representatives shall have the right to furnish, without cost, to the use school facilities and equipment for Association in response to reasonable requests, all information business in the format building in which it is located, including available concerning the financial resources of the District and other technology at reasonable times when such reasonably available information as will assist the Association equipment is not otherwise in negotiations and implementation of this Agreement and in the processing of any grievance. N. F. The Association shall have the exclusive right to post notices of activities and matters of Association concern on one teacher bulletin board for each building. The Board will furnish this equipment, the location of which will not replace an existing bulletin board. The Association may use the district mail service and teacher mailboxes for communications to teachers concerning Association business. Association members who have been given access to the District's network may use the electronic mail service for communications pertaining to Association business. G. The Board agrees to furnish the Association in response to reasonable requests from time to time all available information concerning the financial resources of the district, including, but not limited to: annual financial reports and audits, register of certified personnel, agendas and minutes of all Board meetings, treasurer's reports, census and membership data, names and addresses of all teachers, and such other information as will assist the Association in developing intelligent, accurate, information and constructive programs on behalf of the teachers and their students. H. The Board may consult with the Association on any new or modified fiscal, budgetary or tax program, construction programs or major revisions of educational policy, which are proposed or under consideration and the Association may be given opportunity to advise the Board shall negotiate the annual school calendar with respect to the extent allowed by lawsaid matters prior to their adoption and/or general publication. O. If any provision of the Agreement or any application of the Agreement to any employee or group of employees shall be found contrary to law, then such provision or application shall be deemed null and void except to the extent permitted by law, but all other provisions or applications shall continue in full force and effect. In such cases, the parties agree to meet to renegotiate the provision(s) within thirty (30) days. P. Notwithstanding their employment, I. The teachers shall be entitled to full rights of citizenship, citizenship and no religious or political activities of any teacher or the lack thereof shall be grounds for any discipline or discrimination with respect to the professional employment of such teacher. J. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off the school premises. K. No non-teaching professional staff member shall be discharged, disciplined, reprimanded, reduced in rank or compensation or deprived of any professional advantage without just cause. The private and personal life foregoing standard shall not apply to non-renewal or dismissal of a probationary teacher in an initial probationary period. For purposes of this Agreement the "initial" probationary period shall be either the teacher's first four school year period or the first two school year period of employment (for those teachers who have attained tenure in another Michigan public school district prior to their hire at Xxxxxx-Xxxxxx Schools). Any such discipline shall be subject to the grievance procedure hereinafter set forth, including arbitration, except as otherwise specified in Article 16/Grievance Procedure. Procedures regarding all such action as outlined here shall be: 1. Prior to initiating any teacher is not within measure against a non-teaching professional staff member as described in paragraph K above, the appropriate concern or attention Board shall inform said staff member of the Board. The teacher, however, shall agree his rights to govern his/her private and personal life, insofar as it affects his/her teaching position, by the principles and provisions of the basic code of professional ethics as recognized representation by the Association. 2. Should the non-teaching professional staff member request representation by the Association, all action by the Board regarding the matter or matters shall be deferred for a least forty-eight (48) hours to allow such Association representatives, as determined by the non-teaching professional staff member, to be present. In instances involving such issues where the continued presence of the non-teaching professional staff member could reasonably be assumed to cause and/or immediately threaten the welfare of the student(s), the administration may temporarily suspend the non-teaching professional staff member with pay pending further investigation in accordance with this section. The Association specifically reserves the right to utilize the grievance procedure should such administrative action authorized herein not be deemed proper and necessary. 3. Prior to any meeting called by the Board to discuss such matter or matters and, in time to allow for an adequate review, the Board shall provide the Association and the non-teaching professional staff member with full particulars, including written documentation when applicable, of the matter or matters in question. L. All professionals covered under the Michigan Tenure Law, who are subject to discipline, are covered under District policy (see appendix policy 5530). M. A teacher with or without his representative(s) will be allowed to review his official personnel file under the supervision of the Superintendent or his designee. N. The Association and Superintendent shall discuss and recommend teacher representatives to the District Improvement Team. The Xxxxxx-Xxxxxx Education Association shall be entitled to one (1) representative on each of the component teams of the District Improvement Team. The Association President shall submit three (3) nominees to the Superintendent for each of the appointments to the Association-designated positions on the components teams. The final selection of the other teacher representatives shall be the prerogative of the Superintendent. The Association President shall serve as an ad hoc member to each of the component teams. O. The President and the President-elect of the Association shall be provided with a direct dial telephone, including long distance service, in their classrooms and entry keys for their respective buildings as well as entry key access to an agreed upon meeting room for each building in the District for the purpose of conducting the business of the Association.

Any Association representatives not affiliated with the Alcona Community Schools will not be allowed to conduct Association business when school is in session unless such representative from has first reported to the school office. G. The Association shall have the right to use school facilities and equipment, including duplicating equipment, calculating machines, audio-visual equipment, and district technology, including computers, at reasonable times, when such equipment is not otherwise in use. H. The Association shall have the right to post notices of activities and matters of Association concern on teacher bulletin boards, at least one of which shall be provided in each school building. The Association may use the District mail and email service and teacher mailboxes for communications to teachers. I. The Board will provide to the Association in response to reasonable requests, available information concerning the District’s financial resources, including tentative budgetary requirements and allocations (with the understanding that such are tentative and therefore subject to change.) J. The Association shall be given the opportunity to advise the Board on any new or modified fiscal, budgetary or tax programs, construction programs, or major revisions of educational policy, or any proposals for additional operating or building millage, which are proposed or under consideration, before their adoption and/or general publication. K. The parties recognize that teachers can make a significant contribution to the improvement of the District’s educational programs through participation in the process of school improvement and site-based decision making. It is recognized that such participation promotes professional improvement and should be considered part of the professional responsibilities of each teacher. The parties express their mutual desire that teachers will participate in such activities consistent with the professional objectives specified. 1. Participation of teachers in school improvement outside the building must inform office personnel (if available) upon entering the buildingcontracted day is voluntary. N. The parties agree that mutual respect between and among administrators, teachers, co-workers, supervisors, and support staff is integral to the efficient conduct of the Agreement District’s business. Treating others politely and courteously is the expectation of all staff in their interactions with each other. Should staff members find themselves in conflicting situations, they should seek the counsel of an administrator, supervisor, Association representative, or other impartial third party to any employee or group preserve the professional integrity of employees shall the District’s workplace. If such counsel should not be found contrary to law, then such provision or application shall be deemed null and void except to effective in resolving the extent permitted by law, but all other provisions or applications shall continue in full force and effect. In such casesdisagreement, the parties agree individuals will be encouraged to meet to renegotiate the provision(s) within thirty (30) days. P. The provisions of this Agreement shall be applied without regard to race, religion, color, national origin, age, sex, (including sexual orientation and transgender identity), disability, height, weight, military status, ancestry, or marital or family status, genetic information or any other teacher organization either on or off school premises. Bulletin boards and other established media of communication shall be made available for the use of the Association and its members, in an area not frequented by students. Such use will be appropriate and professional in nature.legally protected category C. E. The Association and its members shall have the right, upon previous notification to the building principal, right to use available school building facilities free of charge at all reasonable hours for meetings between the close of school and 10:00 p.m. provided such school buildings have night custodial personnel. Meetings whose activities may exceed the 10:00 p.m. limit may also be arranged for by previous notification to the building principal. D. E. The Board will continue to provide for inservice workshops for all teaching staff on a released-time basis. The Board may consult with the Association on any new or modified fiscal, budgetary or tax program, construction programs or major revisions of educational policy, which are proposed or under consideration and the Association may be given opportunity to advise the Board shall negotiate the annual school calendar with respect to the extent allowed by lawsaid matters prior to their adoption and/or general publication. O. Any such discipline shall be subject to the grievance procedure hereinafter set forth, including arbitration, except as otherwise specified in Article 16/Grievance Procedure. Procedures regarding all such action as outlined here shall be: 1. Prior to initiating any measure against a teacher is not within as described in ¶ K above, the appropriate concern or attention Board shall inform said teacher of the Board. The teacher, however, shall agree his rights to govern his/her private and personal life, insofar as it affects his/her teaching position, by the principles and provisions of the basic code of professional ethics as recognized representation by the Association. 2. Should the teacher request representation by the Association, all action by the Board regarding the matter or matters shall be deferred for a least forty-eight (48) hours to allow such Association representatives, as determined by the teacher, to be present. In instances involving such issues where the continued presence of the teacher could reasonably be assumed to cause and/or immediately threaten the welfare of the student(s), the administration may temporarily suspend the teacher with pay pending further investigation in accordance with this section. The Association specifically reserves the right to utilize the grievance procedure should such administrative action authorized herein not be deemed proper and necessary. 3. Prior to any meeting called by the Board to discuss such matter or matters and, in time to allow for an adequate review, the Board shall provide the Association and the teacher with full particulars, including written documentation when applicable, of the matter or matters in question. L. A teacher with or without his representative(s) will be allowed to review his official personnel file under the supervision of the Superintendent or his designee. M. The Association and Superintendent shall discuss and recommend teacher representatives to the District Improvement Team. The Xxxxxx-Xxxxxx Education Association shall be entitled to one (1) representative on each of the component teams of the District Improvement Team. The Association President shall submit three (3) nominees to the Superintendent for each of the appointments to the Association- designated positions on the components teams. The final selection of the other teacher representatives shall be the prerogative of the Superintendent. The Association President shall serve as an ad hoc member to each of the component teams. N. The President and the President-elect of the Association shall be provided with a direct dial telephone, including long distance service, in their classrooms and entry keys for their respective buildings as well as entry key access to an agreed upon meeting room for each building in the District for the purpose of conducting the business of the Association.
