TEACHER AND ASSOCIATION RIGHTS. 2.1 Teachers shall have the right to organize, join and assist the Association and to participate in professional negotiations with the Board through representatives chosen by the Association. Neither the Board nor the Association shall discriminate against any teacher by reason of his membership or non-membership in the Association, participation in negotiations with the Board or the institution of any grievance, complaint or proceeding providing that such is as per the provisions of this agreement and follows the procedures outlined in this agreement. 2.1.1 The Association shall be notified of any and all Board meetings in writing by placing a notice in the mailbox of the Association President and Vice-president at the time the meeting is posted for the public. During the summer months, the Association President and Vice president will be notified by e-mail notice to the Association President and Vice-president at the time the meeting is posted for the public. 2.1.2 The administration will investigate and determine the validity of complaints brought to their attention. No unsubstantiated or anonymous complaint shall be used in the evaluation process. 2.2 Each bargaining unit member, as a condition of his/her employment, on or before thirty (30) days from the date of commencement of duties or the effective date of this Agreement, whichever is later, may choose to join theAssociation. 2.3 The Board shall not discriminate against a teacher for reason of race, creed, color, marital status, sex or national origin. 2.4 When a teacher is required to appear before the Board or an administrator for a formal discussion concerning circumstances which might adversely affect his/her employment, position or salary, the teacher shall be given prior notice of the reason(s) for the meeting. A meeting with the administrator shall take place at a time agreed upon by both the teacher and the administrator, but in the event there is no agreement, the meeting shall take place during the teacher’s preparation period. The teacher may, if he/she so requests, have a member of the Association present. The teacher’s representative shall be a member of the Association chosen by the teacher but shall be a teacher who is free from duties at the time of the meeting. When circumstances permit, the meeting shall take place within two working days of the notification. 2.5 Enforcement of the rules and regulations governing teacher conduct under the provisions of this agreement shall be as per the procedures herein outlined. 2.6 Each teacher shall have the right, upon written request, to review the contents of his/her personnel file and to place therein written reactions to any of its contents. 2.7 Whenever any rights or benefits accorded teachers under the laws of the State of Illinois or laws of the United States Government exceed the benefits accorded teachers elsewhere in this agreement, then such rights and benefits shall be granted to the teachers. 2.8 The Board agrees to deduct from each member teacher’s salary the current dues of the Association under the following conditions: A. The president of the Association shall, by the first Monday in October of each year, provide the business office a list of those members who desire to have the dues deducted from their salary. Such list shall also show the amount of the dues and exhibit an authorizing signature of each person on the list. For teachers employed after the first Monday in October the president of the Association shall provide the business office with the necessary authorizing forms as referred to in above paragraph, as soon as practical. 2.10 C. The Association shall have the right to appear and speak to new teachers and to the entire faculty meeting the first day of school. This Association meeting shall not exceed one hour.
D. Members of the Executive Committee of the Association or their designees upon five (5) days notification whenever possible to the Superintendent will be granted leave without loss of pay. Said leave shall not exceed a yearly (academic) aggregate total of eight (8) school days. Said days shall be deducted from the sick leave bank.
E. The collective bargaining agreement between the parties shall be reproduced by the Association. All teachers and personnel covered by the contract, at contract conclusion or thereafter, shall be given a copy of the agreement, which copies shall be at association expense. In addition, the association shall provide management with the number of contract copies it requests at negotiations conclusion or during the life of the agreement. Accordingly the association will be compensated by the school district at the rate of $3.00 per complete contract, for the number ordered by management. This clause is not intended for application to intermediary or small documents (ex Memorandums of Agreement).
F. Notice shall be given to the Association President of existing vacancies in either teaching or supervisory positions (new positions and/or replacements) prior to advertising such replacements.
G. Whenever possible, teachers will be notified of any change in assignment before May 1.
H. In order to effect better relations between employees and the District, the President of the Association or his/her designee shall be relieved of all extra duties and have his/her schedule adjusted to insure free time of at least sixty (60) minutes in blocks not less than thirty (30) minutes, one day per week in addition to any preparation time, to carry out the duties of the office.
I. Tentatively available teaching positions in summer school to be conducted by the Deposit Central School shall be posted in both teachers rooms by May 1 prior to summer school. Deposit teachers will be given opportunity to apply for teaching positions in summer school.
J. Teachers will have the right to leave the school building during their lunch period or during any unassigned student contact period.
K. The Superintendent shall make known to all bargaining unit members any opportunities for assignments as they relate to extra or co-curricular activities and shall accept and consider applications from any member of the bargaining unit.
L. Any member of the bargaining unit shall be entitled to freedom Association representation during meetings with the Board of discussion within Education and a bargaining unit member, upon that member's request. If there is a meeting between an administrator and a teacher for the classroom on matters which are relevant purpose of discussing a written reprimand, the teacher may have the right to have a representative present.
M. No member of the bargaining unit will be dismissed without just cause.
X. Xxxxxx County Federal Credit Union deductions shall be made to the subject matter being studied and which fall within the teacher’s area of professional competence as determined by the teacher’s academic preparation. Xxxxxx County Federal Teachers shall present all facts of controversial issues in a scholarly and objective manner. Academic freedom shall mean that teachers may present instructional material which is pertinent to the subject and level being taught, within the confines of the content of the course and within the planned instructional program as determined by the administrationCredit Union.

TEACHER AND ASSOCIATION RIGHTS. 2.1 Teachers A. Pursuant to the Public Employment Relations Act (XXXX), the Board hereby agrees that every employee of the Board shall have the right freely to organize, join and assist support the Association for the purpose of engaging in collective bargaining or negotiation and to participate in professional negotiations with other concerted activities for mutual aid and protection. 2.1.1 B. With respect to any School Improvement Plan as required by Section 1277 of the Revised School Code, it is agreed as follows:
1. All matters pertaining to wages, hours, and other terms and conditions of employment, including the negotiation of an agreement on behalf of the employees shall be the sole responsibility of the Xxxxxx-Xxxxxx Education Association. Any plans, strategies, or objectives which conflict with the Master Agreement will require mutual agreement between the Xxxxxx-Xxxxxx Education Association and the Xxxxxx-Xxxxxx Board of Education.
2. The Xxxxxx-Xxxxxx Education Association shall approve any and all teacher representatives to any district or building committee formed for the purpose of School Improvement, Site Based Decision Making, Building Level Decision Making, etc.
3. The Association and Superintendent shall discuss and recommend teacher representatives to the Curriculum Coordinating Council. The Xxxxxx-Xxxxxx Education Association representative shall be the President of the Association or his/her chosen designee. If the Association President designates a representative, that decision will be made after consultation with the Superintendent. The final selection of the other teacher representatives shall be the prerogative of the Superintendent.
4. The participation in the above mentioned committees or councils shall be voluntary on the part of the bargaining unit members.
C. The Association and its representatives shall have the right to use school buildings at any time in accordance with regular scheduling procedures for meetings provided that when special custodial service is required the Board may make a reasonable charge therefore. No charge shall be made for use of schoolrooms before the commencement of the school day or until 6:00 p.m.
D. The Association and its representatives shall have the right to use school facilities and equipment for Association business in the building in which it is located, including available technology at reasonable times, when such equipment is not otherwise in use. The Association shall pay for the reasonable cost of all materials and supplies incident to such use. The person operating each piece of equipment shall be notified of any and all Board meetings in writing by placing a notice in trained to operate that machine prior to the mailbox use.

H. The Board may consult with the Association on any new or modified fiscal, budgetary or any tax program, construction programs or major revisions of educational policy, which are proposed use of school supplies shall, or under consideration and the Association may be given opportunity to advise the Board with respect to said matters prior to such use, be discussed with the Superintendent for the purpose of making arrangements to reimburse the school districttheir adoption and/or general publication.
2.10 Teachers I. The teachers shall be entitled to freedom full rights of discussion within citizenship and no religious or political activities of any teacher or the classroom on matters which are relevant lack thereof shall be grounds for any discipline or discrimination with respect to the professional employment of such teacher.
J. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off the school premises.
K. No teacher shall be discharged, disciplined, reprimanded, reduced in rank or compensation or deprived of any professional advantage without just cause. Any such discipline shall be subject to the grievance procedure hereinafter set forth, including arbitration. Procedures regarding all such action as outlined here shall be:
1. Prior to initiating any measure against a teacher as described in ¶ K above, the Board shall inform said teacher of his rights to representation by the Association.
2. Should the teacher request representation by the Association, all action by the Board regarding the matter being studied and which fall within the teacher’s area of professional competence or matters shall be deferred for a least forty-eight (48) hours to allow such Association representatives, as determined by the teacher’s academic preparation, to be present. Teachers shall present all facts of controversial In instances involving such issues in a scholarly and objective manner. L. A teacher with or without his representative(s) will be allowed to review his official personnel file under the supervision of the Superintendent or his designee.
M. The President and President-elect of the Association shall be provided with a direct dial telephone in their classrooms and entry keys for their respective buildings for the purpose of conducting the business of the Association.
