Common use of Temporary Assignment of Duties Clause in Contracts

Temporary Assignment of Duties. In some circumstances and with the agreement of the member, the University may assign the APT member to undertake another position, or a substantial portion of the duties of another position, for a limited period of time not to exceed nine months. With the mutual agreement of the University, the Association and the APT member, the nine-month assignment may be extended to a period not to exceed twelve months in total. The details of the assignment shall be specified in writing to the member prior to the member deciding whether or not to agree to the assignment. If the temporary assignment is for a period of fifteen or fewer working days, there will be no adjustment in the APT member’s salary. If the temporary assignment is for a period of more than fifteen working days and the duties of the position have different functions, the APT member’s salary will be adjusted from the date of reassignment to the greater of: a) the first step in the salary range of the position to which assigned; or b) the present salary plus two increments from the range of the position to which assigned; or c) the present salary plus two increments in their current position. When an APT member is frequently assigned to assume some or all of the duties of another position, but not all of the assignments are for more than fifteen working days’ duration, the APT member may request that the cumulative effect of the substitution be considered under 13.3, or in some other equitable fashion. Employees who are subsequently appointed permanently to the position shall not have their salary reduced by the application of Article 17.3.2.
