Common use of TEMPORARY VACANCIES AND POSITIONS Clause in Contracts

TEMPORARY VACANCIES AND POSITIONS. A bargaining unit position that is vacant for up to forty-five (45) work days may be filled with a substitute. After the bargaining unit position has been vacant for forty-five (45) work days, the position will be posted consistent with the collective bargaining agreement as a “temporary position.” The employee who bids for the position and is assigned the job is being place in the position on a temporary basis to last only during the absence of the employee who normally holds the job. Any position open as a result of the "temporary position" being temporarily filled will be posted in a similar manner. Upon return of the absent employee, all employees shall return to their original positions. A new employee will not be hired to fill a vacated position in the case of a temporary vacancy, but rather a substitute shall be placed in the last open position. Upon the Board’s acceptance of the resignation of the vacant employee the filled position shall no longer be temporary, and the position vacancy shall be posted as a permanent position.
