Tenancy Management. The Housing Authority agrees: (a) to exercise all rights and obligations accruing to an Owner under the Residential Tenancies Xxx 0000 in respect of Nominated Lots and Nominated Houses, except as otherwise lawfully provided for in this Agreement or any Tenancy Agreement entered into in respect of the Nominated Lots and Nominated Houses, including: (i) executing Tenancy Agreements in accordance with clause 4.1(a) of this Agreement; and (ii) determining the term of Tenancy Agreements; (b) to be responsible for the issuing of all required notices, of any nature whatsoever, in respect of any Tenancy Agreement regarding a given Nominated Lots and Nominated Houses, including: (i) notices for variation of Rent; (ii) default or breach notices; (iii) termination of a Tenancy Agreement; and (iv) all other notices as provided for in the Residential Tenancies Xxx 0000; (a) to ensure allocation of Nominated Lots and Nominated Houses to Eligible Persons in accordance with subclause 4.5; (b) to determine, with the approval of the Minister, the amount of Rent payable in respect of a Tenancy Agreement; (c) to collect and receive all Rent paid by a Tenant of the Nominated Lots or Nominated Houses pursuant to a Tenancy Agreement, including the issuing receipts for all Rent collected when requested by a Tenant or Government Agency or when otherwise required by the Residential Tenancies Xxx 0000 or any other Law; and (d) to provide an Annual Report to the Organisation by no later than 30 September each calendar year

Tenancy Management. 4.1 The Successful Tenderer shall manage the tenancies of all stallholders, including but not limited to: a) Sourcing of new stallholders to take over vacant stalls; b) Management of stall allocation, including situations where there are more interested parties than vacant stalls; c) Renewal of tenancies (if applicable); d) Collection of rent and other charges from stallholders; and e) Enforcing the terms of the individual sub-tenancy or licence agreements with the stallholders. 4.2 The Successful Tenderer shall enter into a sub-tenancy or licence agreement with all individual stallholders for tenure periods to be determined by the Successful Tenderer. For avoidance of doubts, such individual tenures shall not be longer than the tenure of the TA between the Agency and the Successful Tenderer. 4.3 The Successful Tenderer shall submit the draft sub-tenancy or licence agreement with stallholders to the Agency for approval, prior to signing with stallholders. The Successful Tenderer shall adhere to the guidelines in Appendix E on contractual terms between the Successful Tenderer and stallholders. Any subsequent changes to the terms, conditions and covenants in the sub-tenancy or licence agreement with the stallholders shall be subject to the Agency’s prior written approval. 4.4 Upon execution of a new sub-tenancy or licence agreement with a stallholder, the Successful Tenderer shall furnish a copy of the sub-tenancy or licence agreement to the Agency within seven
Tenancy Management. 4.4.1 Tenants will have a Tenancy Agreement with Manchester City Council which sets out their rights and responsibilities and those of the Council (which will be the contractual responsibility of Northwards under this Management Agreement). Northwards will ensure that Tenants are fully aware of their rights and responsibilities as part of their Tenancy Agreement.
