TERMINATION FOR NON-PAYMENT OF DUES. Upon written notification from the Union that an employee has failed to pay his/her Union dues, Xxxxxxx will send a letter to the employee informing him/her of the issue of nonpayment with a copy of the authorization form. The employee will be given thirty (30) days to return the completed form to Human Resources. I f the employee fails to return the completed form to Human Resources, and upon written request from the Union, Xxxxxxx shall terminate the employment of any worker who fails to comply with the requirements of this agency shop provision.
TERMINATION FOR NON-PAYMENT OF DUES. Upon written notice from the Union that an employee fails to maintain membership in the Union by refusing to pay dues or assessments, the Employer agrees to terminate employment of said employee after seven (7) days from the date of notice.

Provided that notice of non-performance is provided in accordance with this Section 4.4, nothing in this Section 4.4 shall prevent, preclude, or limit any claim or action for default or breach of contract resulting from non-performance by a Party.

  • Termination for Non-Appropriation The continuation of this Contract beyond the current fiscal year is subject to and contingent upon sufficient funds being appropriated, budgeted, and otherwise made available by the City. The City may terminate this Contract, and Contractor waives any and all claim(s) for damages, effective immediately upon receipt of written notice (or any date specified therein) if for any reason the City’s funding from State and/or federal sources is not appropriated or is withdrawn, limited, or impaired.

  • Termination for Non-Appropriation of Funds Notwithstanding any other provision of this Contract, the County shall not be obligated for the Contractor’s performance hereunder or by any provision of this Contract during any of the County’s future fiscal years unless and until the County’s Board of Supervisors appropriates funds for this Contract in the County’s Budget for each such future fiscal year.
