Common use of Termination of Employment or Assignment to exempt status Clause in Contracts

Termination of Employment or Assignment to exempt status. An employee who is terminated from employment with the City or assigned to a job which is exempt from overtime requirements shall be paid for any accumulated and unused compensatory time. For an employee who is terminated, the rate of pay used shall be the final regular rate received by the employee during the employees last three years of employment with the City. For an employee who is assigned to an exempt job, the rate of pay used shall be the final regular rate received by the employee in the employee’s last non-exempt job before assignment to the exempt job.
