The Grievance Procedure. (a) Step 1 (Immediate Supervisor) An Employee who has a grievance shall, within ten (10) days of the date she becomes aware of, or reasonably should have become aware of, the occurrence which led to the grievance, first discuss the matter with her immediate supervisor and attempt to resolve the grievance at this stage. In the event that it is not resolved satisfactorily to the Employee, it may be advanced in accordance with the following steps. (b) Step 2 (Centre Administrator) (i) Where an Employee is not satisfied with the response at step 1, from her immediate supervisor, she may submit in writing an individual grievance, at step 2 to the Centre Administrator or designate within ten (10) days of discussing the grievance with her immediate supervisor in Step 1; (ii) If the grievance is a group grievance, it shall be submitted in writing at step 2 to the Centre Administrator or designate within ten (10) days of the date any of the aggrieved Parties became aware of the event or reasonably should have become aware of the event leading to the grievance. The Administrator of the Centre shall hold a hearing within ten (10) days of receipt of the grievance. The Employee shall be entitled to have a representative of the Union present during the meeting. If the grievance is not settled at this stage, it may be advanced to Step 3. (c) Step 3 (Chief Operating Officer) Within ten (10) days of the reply at Step 2, the Employee shall submit the grievance, in writing to the Chief Operating Officer or designate. The Chief Operating Officer or designate shall hold a hearing within ten (10) days of receipt of the grievance. The Employee shall be entitled to have a representative of the Union present during the meeting. The Chief Operating Officer or designate shall render a written decision within ten (10) days of the date of the hearing. If the grievance is not settled at this stage, either party may decide to proceed to Arbitration or by mutual agreement to Mediation. The Grievance Procedure. (a) Step 1 (Immediate Supervisor) An Employee who has The following constitutes the sole and exclusive method for resolving a grievance shallbetween the parties under this Agreement. A written statement by the grievant providing a. The specific Article, within ten (10) days paragraph or provision and/or policy violated; b. the material facts of the date she becomes aware of, violation; and c. the relief sought. Step One The grievant shall institute action by filing a grievance with the Commissioner in Charge of Personnel or reasonably should have become aware of, his designee within seven (7) calendar days after the occurrence of the event which led prompted the grievance. The Commissioner in Charge of Personnel or his designee shall schedule and hold a meeting with the grievant within fifteen (15) calendar days after the Grievance is filed. The intent of this meeting is to reach a settlement. A response shall be provided to the grievancegrievant within fifteen (15) calendar days after the meeting. If a decision is not rendered within the time limits prescribed for a decision, first discuss the matter with her immediate supervisor and attempt to resolve then the grievance at this stageshall be deemed to be denied. In If the event that it is not resolved satisfactorily to the Employee, it may be advanced in accordance with the following steps. (b) Step 2 (Centre Administrator) (i) Where an Employee grievant is not satisfied with the results of Step One, the grievant may file an appeal within five (5) calendar days with the Board after receipt of the results of Step One or the time limits prescribed for a decision have expired. The Arbitrator shall be chosen in accordance with the rules promulgated by PERC or by a procedure agreed upon by the parties in writing. B. The time limits expressed herein shall be strictly adhered to. If any grievance has not been initiated within the time limits specified, then the grievance shall be deemed to have been abandoned. If any grievance is a group grievancenot processed to the next succeeding step in the grievance procedure within the time limits prescribed hereunder, it then disposition of the grievance at the last preceding step shall be submitted deemed to be conclusive. The grievance shall be submitted, referred in writing, stating writing to the article(sSuperintendent of Schools by the grievant within three (3) claimed to have been violated, days after the nature grievant received the written report of the grievance and the redress soughtprincipal or first-line supervisor. The Administrator of the Centre shall hold a hearing within ten (10) days of receipt of the grievance. The Employee shall be entitled to have a representative of the Union present during the meeting. The grievance will be responded to, in writing, by the Centre Administrator or designate within ten (10) days of the grievance hearing at step 2. If the grievance is not settled at this stage, it may be advanced to Step 3. (c) Step 3 (Chief Operating Officer) Within ten (10) days of after referral by the reply at Step 2grievant, the Employee Superintendent shall submit meet with the grievance, in writing to the Chief Operating Officer or designate. The Chief Operating Officer or designate shall hold a hearing within ten (10) days of receipt of the grievance. The Employee shall be entitled to have grievant and a representative of the Union present during employee organization to consider the meetingalleged grievance and to make every attempt to resolve it. The Chief Operating Officer or designate Superintendent shall render a indicate his/her disposition of the alleged grievance in writing within five (5) days after said meeting (one copy for the grievant, one copy for the association) LEVEL III - If the action taken at Level II fails to resolve the grievance to the satisfaction of the affected parties, the grievance shall be referred in writing by the grievant to the Board of Education within three (3) days after reviewing the written decision report of the Superintendent. The Board of Education shall meet with the grievant and the representative committee of the employee organization within ten fifteen (1015) days of the date request of the grievant for the purpose of discussing the grievance and disposing of it in a mutually satisfactory manner. The Board of Education shall make a disposition in writing (one copy to the grievant and one copy to the Association) of the grievance within seven (7) days after the hearing. LEVEL IV - If the action at Level III fails to resolve a grievance is not settled at this stage, either party may decide to proceed to Arbitration or by mutual involving the interpretation and/or application of the negotiated agreement to Mediation. The Grievance Procedure. (a) Step 1 (Immediate Supervisor) An Employee who has a grievance shall, within ten (10) days of the date she becomes aware of, or reasonably should have become aware of, the occurrence which led to the grievance, first discuss the matter with her immediate supervisor and attempt to resolve the grievance at this stage. The Chief Operating Officer Administrator or designate her representative shall render a written decision within ten (10) days of the date of the hearing. If the grievance is not settled at this stage, either party Party may decide to proceed to Arbitration or by mutual agreement to Mediation. (d) A copy of the written grievance at Step 2 and Step 3 shall be submitted to the Executive Director, Human Resources.
