Common use of Time Limits to Present Initial Grievance Clause in Contracts

Time Limits to Present Initial Grievance. An employee who wishes to present a grievance at Step 2 of the grievance procedure in the manner prescribed in Clause 8.4, must do so not later than: (a) twenty-one (21) calendar days after the date on which he/she was notified orally or in writing of the action or circumstances giving rise to the grievance; or (b) twenty-one (21) calendar days after the date on which he/she first became aware of the action or circumstances giving rise to the grievance. (a) Subject to the time limits in Clause 8.3, the employee may present a grievance at this level by: (1) recording this grievance on the appropriate grievance form, setting out the nature of the grievance and the circumstances from which it arose; (2) stating the article or articles of the Agreement infringed upon or alleged to have been violated and the remedy or correction required; and (3) transmitting this grievance to the designated supervisor through the Union xxxxxxx. (b) The supervisor General Manager or their designate shall acknowledge receipt of the written grievance by signing and dating the grievance form at the time that the grievance is presented.

(b) The immediate supervisor shall acknowledge receipt shall: (1) forward the grievance to the representative of the written grievance by signing and dating Employer authorized to deal with grievances at Step 2; and (2) provide the employee with a receipt stating the date on which the grievance form at the time that the grievance is presentedwas received.

(b) The supervisor shall acknowledge receipt of the written grievance by signing and dating the grievance form at the time that the grievance is presented.

(a) Subject If the grievance is not resolved at Step 1, subject to the time limits in Clause 8.310.3, the employee may present a grievance at this level by: (1) recording this grievance on the appropriate grievance form, setting out the nature of the grievance and the circumstances from which it arose; (2) stating the article or articles of the Agreement infringed upon or alleged to have been violated violated, and the remedy or correction required; and, (3) transmitting this grievance to the designated supervisor Director of Human Resources through the Union xxxxxxx. (b) The supervisor shall acknowledge receipt Director of Human Resources shall: (1) forward the grievance to the representative of the written grievance by signing and dating Employer authorized to deal with grievances at Step 2; (2) provide the employee with a receipt stating the date on which the grievance form at the time that the grievance is presentedwas received.
