Traffic Congestion Area. Tenant acknowledges the existence of traffic congestion areas (each, a “Traffic Congestion Area”) located in the Processing Building and in front of the Loading Dock, as depicted on Exhibits B and C. Tenant’s commercial vehicles will be intermixing with District’s customers and vehicles through the Traffic Congestion Areas and through other areas where various individuals and entities will be driving vehicles. In addition, pedestrians may be walking in multiple directions in the Traffic Congestion Areas. Although the District may (but is not obligated to) provide traffic directors to provide direction in the Traffic Congestion Areas, the District is not responsible for the safety of any Tenant Parties within the same. Tenant shall instruct all Tenant Parties (whether driving or walking on the Property or working thereon) comply with any and all requirements of the District, and the directions of the District Traffic Directors (if present), and Tenant shall be solely responsible for any Tenant Party’s failure to follow such instructions, except to the extent resulting from the gross negligence, willful misconduct or breach of this Lease by District. To minimize congestion, the District and Tenant shall each instruct its drivers of commercial vehicles to back into the Loading Dock within 2 minutes of arrival into the Traffic Congestion Area located in front of the Loading Dock as depicted on Exhibits B and C. Nothing in this Section 10.3 shall be construed as limiting Tenant’s or the District’s indemnity obligations under Section 15 of this Lease.
