Transfers Without Posting. (a) Lateral transfers or voluntary demotions may be granted, without posting for: (i) compassionate or medical grounds to regular employees who have completed their probationary period; (ii) all employees who have become incapacitated by industrial injury or industrial illness. (b) In such cases the Rehabilitation Committee established in Clause 12.05 shall consider any applications or requests presented to the Committee. Each request for special consideration shall be judged solely on its merit. (c) An employee whose spouse is also an employee and who is transferred pursuant to Clause 12.04, Article 37, or Memorandum of Agreement #2 (Privatization) may be considered for a lateral transfer or voluntary demotion to available vacancies.
