TRANSFERS AND PROMOTIONS. 9.1 Notices for permanent full-time vacancies within this bargaining unit, including full-time entry level positions, shall be posted online though the district website posting system and an email will be sent out to every employee notifying them of the job opening, and a copy of each posting shall be sent to the Union Vice-President. Notices shall be posted five (5) working days prior to the application deadline, unless in an emergency the time frame may be reduced after consulting with the local Vice-President of the Union. No permanent appointment shall be made until after the deadline for filing applications. The positions will be filled, if possible, from those seeking a lateral transfer and if not possible, from those seeking promotion. Part-time employees will be given preference for full-time vacancies over outside applicants. Transfers will be honored according to seniority. Positions that will be or have been vacant for at least 6 months shall be posted within 10 days of the vacancy. Also all posted positions will be filled within 30 days of the vacancy. Vacancies means any permanent separation of employment and does not apply when positions are not being filled due to 7:5.
9.2 Service in a part-time position will be converted to full-time equivalency and used to determine seniority status in bidding for an upgraded position (i.e. four (4) hours per work day equals two (2) years full-time seniority).
9.3 The written notice of a vacancy shall contain:
(a) type of vacancy;
(b) position description;
(c) location and shift;
(d) starting date;
(e) qualifications;
(f) salary; and
(g) other relevant information.
9.4 The written notice set forth for a particular position shall not be substantively changed after posting.
9.5 Employees who desire a transfer to a posted position may apply as specified in the posting notice. The decision on transfer requests shall be awarded to the most senior applicant, provided he or she is qualified for the position.
TRANSFERS AND PROMOTIONS. Notices of lateral transfer opportunities shall be posted for at least five (5) days on division bulletin boards and in branch offices. If an employee desires to transfer, he/she must submit a written request to Human Resources.
TRANSFERS AND PROMOTIONS. 274 The University shall post all regular job openings in a seniority group for a period of five (5) calendar days at an appropriate location in the seniority group. The posting shall consist of, but not be limited to, the classification title, pay grade, seniority group, shift, and necessary qualifications for the position. 275 Non-probationary employees within the seniority group where the regular job opening exists who wish to be considered for the position may apply by submitting a bid via the electronic applicant management system provided by the University. The University need not consider bids which are incomplete, inaccurate or not submitted within the posting period. 276 An employee in another seniority group also will be considered for a specific regular job opening if that employee has made known in writing and in advance that consideration is desired if such a specific job opening occurs. 277 Selection for a promotion or transfer is within the discretion of the University. In the event that an employee who is selected does not perform to the satisfaction of the University within a reasonable period of time determined by the University, the employee will be returned to the employee’s former position provided a job opening exists. Exception to this provision may apply in the event the employee engages in an act of misconduct that warrants disciplinary action up to and including discharge. 278 For purposes of this article, a “Transfer” shall be defined as the lateral movement of an employee from one classification within the bargaining unit to a similar classification within the bargaining unit, regardless of salary; or as the reclassification of an employee from one classification to another classification at the same step level within the bargaining unit, regardless of salary. 279 For purposes of this article, a “Promotion” shall be defined as the reclassification of an employee from one classification within the bargaining unit to another classification within the bargaining unit, at a higher salary range. 280 When an employee is transferred to a classification with a higher range of rates, the employee will be paid the rate for that classification which is next higher to the employee’s rate prior to the transfer. 281 When an employee is transferred to a classification with a lower range of rates, the employee will be paid a lower rate that reflects proper placement in the new classification in accordance with the Wage Scale. 282 Security and c...

Where there is a simultaneous requirement to implement Article XII Transfers and Promotions, and Article Reduction in Work Force, all labour moves required under Article XII will be planned before Article put into effect. The experience of rehired employees acquired while in the previous employ of the Company shall not be considered in assessing their eligibility for Transfers, Promotions, or Job A Job Opportunity List will be maintained by the Human Resources Department. An employee with seniority may record in writing, classifications within his own to which he wishes to transfer and/or a shift transfer within his own classification should a vacancy occur. If the Company’s operation would be adversely affected, the request for shift transfer may be denied. An employee with a least year seniority may record in writing, classifications outside his own department to which he wishes to transfer provided: there is not a more senior non-restricted employee on layoff at the time. he has not exercised a move to another department within the last six months. This does not apply if an employee was subsequently displaced from a Seniority List through the application of Article Reduction in Work Force. Employees are encouraged to record only those classifications to which they would transfer if a vacancy occurred. It is the individuals’ responsibility to place his name on the and such name will be retained on the list for twelve (12) months. Only those names on the will be considered for transfer. When an employee is contacted either by telephone or in person regarding such a transfer, he will be given up to hours to advise re his decision to transfer. In dealing with promotions, or the transfer of employees within a Department, the following procedures shall apply:

TRANSFERS AND PROMOTIONS. 12.01 In all cases of definite and indefinite transfers, or promotion to a bargaining unit nursing position, the following criteria for selection shall be considered:
(a) skills, ability, experience and qualifications
(b) seniority Where the qualifications of factor a) are relatively equal, factor b) shall govern.
12.02 All promotions, assignments, and transfers within the bargaining unit shall be on a trial basis. The nurse will serve a trial period of four hundred and fifty (450) regular hours worked in which to demonstrate their ability to perform the duties and responsibilities of the position to the satisfaction of the Employer. Should a nurse fail to succeed during the above mentioned trial period, the Employer will reinstate the nurse in their former position without loss of seniority, and the filling of subsequent vacancies will likewise be reversed.
TRANSFERS AND PROMOTIONS. A. Consideration Employees are encouraged to apply for any job vacancy within the District which can be considered a transfer or a promotion after the announcement for the position vacancy. District employees will be given first consideration for any vacancy for which they might be qualified. First consideration means that regular employees will be granted an interview if they meet the minimum qualifications as stated in the job description. It may be necessary for employees to fill out the long form of the job opening in order to determine if employees meet the minimum qualifications. The interview schedule shall identify all internal candidates as such and will identify their current classification in the District. Short Term/Temporary Assignments When a position within a school site or department becomes temporarily vacant, and the supervisor determines that it is in the best interest of that site or department to fill that position, then the supervisor will advertise the position to be temporarily filled within the site or department. If two or more bargaining unit members, who currently hold a position related to the vacant position, wish to work in an “acting status” for that position, the employee with the greatest district seniority will be selected based on satisfactory performance evaluations and supervisor discretion. Said discretion shall not be applied in an arbitrary or subjective manner. The “acting status” employee may be removed from that position upon unsatisfactory performance, or when the position is filled. The removed employee shall be returned to their original position.
B. Posting of Notices
TRANSFERS AND PROMOTIONS a) Seniority employee shall be required to submit to fit for duty testing for transfer or promotion opportunities. The Employer must determine within Forty-five (45) working days whether or not an employee who has been promoted or who has voluntarily transferred, exclusive of employees in trainee programs, is qualified to discharge the duties and responsibilities of the new position. Such determination shall rest exclusively with the Employer subject to the grievance and arbitration procedure and shall be made not later than the employee's Forty-fifth (45) working day, with written notice to the employee thereof. An employee determined to be unqualified shall resume his or her former position, or an equivalent position, at the previous rate of pay with no loss of work during the transfer period.
b) An employee who has been promoted or who has voluntarily transferred, exclusive of employees in trainee programs, shall have the option during the first fifteen (15) working days in the new position to resume his or her former position, or an equivalent position, at the previous rate of pay, provided that written notice of intention to exercise this option shall be given to the Employer no later than the fifteenth (15th) working day.
TRANSFERS AND PROMOTIONS. 7 1. An employee may be transferred to meet the needs of the District as determined by 8 the District from one position to another position in the same classification at the 9 discretion of the division head(s) where the positions are located. Transfers shall not 10 be made for punitive reasons; it is agreed, however, that any grievance which alleges 11 that a transfer was made for punitive reasons shall be excluded from binding 12 arbitration.
14 2. Reasons for any transfer which is not voluntary shall be discussed with the employee 15 by the appropriate division head at least ten (10) working days prior to the transfer, 16 except in the case of extenuating circumstances. The employee will receive a written 17 notice of involuntary transfer which shall specify the needs of the District which 18 require the transfer. Such notice shall be in writing on the appropriate form 19 (Appendix I).
21 3. When a transfer is necessitated by the elimination of a position at a work site, the 22 transfer will be accomplished as follows:
24 a. If there is only one person assigned to the classification in which the position 25 is eliminated, that person will be transferred. 26
27 b. If there are two or more people assigned to the classification in which the 28 position is eliminated, the manager will ask for volunteers for transfer. 29
(1) If two or more people volunteer for transfer, the employee with the 31 most District seniority in the classification will be transferred. 32
(2) If there are no volunteers for transfer, the employee with the least 34 District seniority in the classification at the site will be transferred. 35
36 4. An employee with permanent status may request a transfer from one position to 37 another within the same classification. Such request shall be in writing and submitted 38 to the Executive Officer, Personnel Commission and Classified Employment. A 39 transfer request shall remain active through November 30 at which time the request 40 must be renewed. No obligation shall exist to fill a position by transfer rather than 41 by any other method of appointment; however, each employee will be notified that 42 his/her transfer request has been received.
