Transit Traffic Rate Application. 8.1 AT&T CALIFORNIA, AT&T INDIANA, and/or, AT&T OHIO only,
8.1.1 The applicable Transit Traffic Service rate applies to all Transit Traffic MOUs. For AT&T CALIFORNIA, AT&T INDIANA, and/or AT&T OHIO, Transit Traffic MOUs include Local and IntraLATA toll minutes of use. CLEC agrees to compensate AT&T CALIFORNIA, AT&T INDIANA and/or AT&T OHIO as a transit service provider for the rate elements at the rate set forth in the Transit Traffic Service Pricing Schedule, Exhibit B.
8.2 AT&T ARKANSAS, AT&T KANSAS, AT&T KENTUCKY, AT&T MISSOURI, AT&T OKLAHOMA, AT&T NORTH CAROLINA, and/or AT&T TEXAS only
8.2.1 The applicable Transit Traffic Service rate applies to all Transit Traffic MOUs. For AT&T ARKANSAS, AT&T KANSAS, AT&T KENTUCKY, AT&T MISSOURI, AT&T OKLAHOMA, AT&T NORTH CAROLINA and/or AT&T TEXAS, Transit Traffic MOUs include Local minutes of use only. CLEC agrees to compensate AT&T ARKANSAS, AT&T KANSAS, AT&T KENTUCKY, AT&T MISSOURI, AT&T OKLAHOMA, AT&T NORTH CAROLINA and/or AT&T TEXAS as a Transit Service Provider for the rate elements at the rate set forth in the Transit Traffic Service Pricing Schedule, Exhibit B. 8.3 AT&T MISSOURI only
8.3.1 Pursuant to the Missouri Public Service Commission Order in Case No. TO-99-483, the Transit Traffic rate elements shall not apply to MCA Traffic (i.e., no transiting charges shall be assessed for MCA Traffic) for AT&T MISSOURI.
Transit Traffic Rate Application. 9.1 Unless otherwise specified, Transit Traffic Services rates apply to all Minutes of Use (“MOU” or “MOUs”) when CLEC sends Transit Traffic to a Third Party Terminating Carrier’s network throuAgTh&T-22STATE’s tandem switch where an AT&T-22STATEend user is neither the originating nor the terminating Party. CLEC agrees to compensate AT&T-22STATEoperating as a Transit Service Provider at the applicable rates set forth in Transit Traffic Service Appendix Pricing.
Transit Traffic Rate Application. 5.8.1 The applicable Transit Traffic Service rate applies to all Sprint originated Transit Traffic MOUs. Sprint shall compensate AT&T ILLINOIS as a Transit Service Provider at the rate set forth in the Pricing Sheet.
5.8.2 If Sprint has delivered at least 150,000,000 minutes of Transit Traffic to AT&T ILLINOIS in the calendar year preceding the year in which this Amendment is executed by the Parties, then Sprint shall compensate AT&T ILLINOIS as Transit Service Provider at the “Eligibility Criteria met” Transit Rate per MOU set forth in the Pricing Sheet.
5.8.3 If Sprint has not met the requirements of Section 5.8.2 above, then Sprint shall compensate AT&T ILLINOIS as Transit Service Provider at the “Eligibility Criteria NOT met” Transit Rate per MOU set forth in the Pricing Sheet.
2. The Pricing Sheets are hereby deleted and replaced with the amended pricing sheets dated March 7, 2014, attached hereto as “Amended Pricing Sheets – March, 2014.”
3. Subject to Section 4, the provisions of Section 5.8, as set forth in Section 1, above, and the “Amended Pricing Sheets-March, 2014”, referenced in Section 2, above, shall begin to apply on April 1, 2014.
4. Notwithstanding anything to the contrary, including anything in the Agreement or this Amendment, in no event shall this Amendment result in the change in rates implemented pursuant to Sections 1 and 2 of this Amendment back to a date earlier than the latest of the following three dates: (i) the date the last Party signs this Amendment; (ii) the Effective Date of the underlying Agreement; or (iii) April 1, 2014.
5. EXCEPT AS MODIFIED HEREIN, ALL OTHER TERMS AND CONDITIONS OF THE UNDERLYING AGREEMENT SHALL REMAIN UNCHANGED AND IN FULL FORCE AND EFFECT. Amendment – Transit/AT&T-22STATE 6. In entering into this Amendment, neither Party waives, and each Party expressly reserves, any rights, remedies or arguments it may have at law or under the intervening law or regulatory change provisions in the underlying Agreement (including intervening law rights asserted by either Party via written notice predating this Amendment) with respect to any orders, decisions, legislation or proceedings and any remands thereof, which the Parties have not yet fully incorporated into this Agreement or which may be the subject of further review.

Transit Traffic Rate Application. 6.1 The Transit Traffic Services rate applies to all Minutes of Use (“MOUs”) when WSP sends Transit Traffic to a Third Party Terminating Carrier’s network through AT&T-TSP’s tandem switch where an AT&T-TSP end user is neither the originating nor the terminating party. WSP agrees to compensate AT&T-TSP operating as the Transit Service Provider at the applicable rates set forth in Transit Traffic Service Pricing Sheet.

4.1 Traffic between CLEC and Wireless Type 1 Third Parties or Wireless Type 2A Third Parties that do not engage in Meet Point Billing with AT&T KENTUCKY and/or AT&T NORTH CAROLINA shall not be treated as Transit Traffic from a routing or billing perspective until such time as such traffic is identifiable as Transit Traffic.

2.1 Traffic between CLEC and Wireless Type 1 Third Parties or Wireless Type 2A Third Parties that do not engage in Meet Point Billing with AT&T KENTUCKY and/or AT&T NORTH CAROLINA shall not be treated as Transit Traffic from a routing or billing perspective until such time as such traffic is identifiable as Transit Traffic.

CLEC agrees to compensate AT&T CALIFORNIA as a Transit Service Provider for the rate elements at the rate set forth in the Pricing Schedule.
Transit Traffic Rate Application. 9.1 Unless otherwise specified, Transit Traffic Services rates apply to all Minutes of Use (“MOU” or “MOUs”) when CLEC sends Transit Traffic to a Third Party Terminating Carrier’s network through AT&T MISSOURI’s tandem switch where an AT&T MISSOURI end user is neither the originating nor the terminating Party. XXXX agrees to compensate AT&T MISSOURI operating as a Transit Service Provider at the applicable rates set forth in Transit Traffic Service Appendix Pricing. For purposes of Transit Traffic compensation, all Transit Traffic is treated as telecommunications services traffic, regardless of transport protocol. Transit Traffic charges will apply to all traffic destined to a third party where the end points of the call are in the same mandatory local calling area within the same LATA.
