Transportation Development District. Prior to or concurrently with the execution of this Agreement, the City shall take all necessary governmental and legal action to cause the creation of the TDD, including requiring the Developer to take all necessary action, as set forth in the Development Agreement, for the creation of the TDD. With regard to the TDD, the City agrees as follows:

Transportation Development District. The Developer shall have the right in Developer’s sole and subjective discretion, to petition the Circuit Court of the County for the creation of the TDD pursuant to the TDD Act, to be known as the “University Village Transportation Development District.” The TDD shall be created for the purpose of
Transportation Development District. Unless the City otherwise consents in writing, the Developer shall petition the Circuit Court for the creation of one or more TDDs encompassing those portions of the Redevelopment Area that are expected to generate more than an insubstantial amount of retail sales tax (and the City shall not oppose the creation of any such TDD sought to be created in compliance with this Section). The Parties acknowledge that each TDD will be governed by a board of directors made up of five representatives of the owners of real property within the TDD, who will be elected by the owners of real property within the TDD. The Developer, as an owner of real property within the TDD, will cause the election to the board of directors of at least one person designated by the City who meets all other qualifications to serve on the board of directors, by designating such person as an authorized representative of the Developer and voting for such persons. The Parties, acting through their representatives on the boards of directors, shall cause the TDDs to (a) engage qualified administrators and/or legal counsel to assist in managing the TDD and ensuring compliance with applicable laws and (b) take such steps as are necessary (including casting votes as a qualified voter under the TDD Act) to impose a sales and use tax in the amount of one percent (1.0%) and such other taxes and assessments as may be permitted by the TDD Act that the Developer may request. The TDD may issue bonds, notes and other obligations as it determines appropriate; however, the TDD will not issue any tax-exempt bonds, notes or obligations without the City’s prior written consent (which shall not be unreasonably withheld, conditioned or delayed). The City shall have the right to designate Bond Counsel for any tax-exempt obligations issued by or on behalf of the TDD.

  • Joint Occupational Health and Safety Committee The Employer and the Union recognize the role of the joint Occupational Health and Safety Committee in promoting a safe and healthful workplace. The parties agree that a Joint Occupational Health and Safety Committee shall be established for each Employer covered by this Collective Agreement. The Committee shall govern itself in accordance with the provisions of the Industrial Health and Safety Regulations made pursuant to the Workers’ Compensation Act. The Committee shall be as between the Employer and the Union, with equal representation, and with each party appointing its own representatives. Representatives of the Union shall be chosen by the Union membership or appointed by the Union. All minutes of the meetings of the Joint Occupational Health & Safety Committee will be recorded in a mutually agreeable format and will be sent to the Union. The Union further agrees to actively pursue with the other Health Care Unions a Joint Union Committee for the purposes of this Article. The Employer agrees to provide or cause to be provided to Employer members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently. The Union agrees to provide or cause to be provided to Union members of the Joint Occupational Health and Safety Committee adequate training and orientation to the duties and responsibilities of committee members to allow the incumbents to fulfil those duties competently. Such training and orientation shall take place within six (6) months of taking office.

  • Professional Development Plan Professional Development Plan (PDP) refers to plans developed by faculty members addressing the criteria contained in Article 22 and Appendix G.

  • Professional Development Reimbursement Management will provide reimbursement for approved professional development expenses for Lieutenants and Sergeants. Funds may be used for the purpose of improving job performance, maintaining and increasing proficiency, preparing Lieutenants and Sergeants for greater responsibility, or increasing promotional opportunities. Management must approve of the specific professional development request in advance. Denial will require written notification to the requesting Lieutenant or Sergeant.

  • Design Development Phase Services 3.3.1 Based on the Owner’s approval of the Schematic Design Documents, and on the Owner’s authorization of any adjustments in the Project requirements and the budget for the Cost of the Work, the Architect shall prepare Design Development Documents for the Owner’s approval. The Design Development Documents shall illustrate and describe the development of the approved Schematic Design Documents and shall consist of drawings and other documents including plans, sections, elevations, typical construction details, and diagrammatic layouts of building systems to fix and describe the size and character of the Project as to architectural, structural, mechanical and electrical systems, and other appropriate elements. The Design Development Documents shall also include outline specifications that identify major materials and systems and establish, in general, their quality levels.

  • PROFESSIONAL DEVELOPMENT AND EDUCATIONAL IMPROVEMENT A. The Board agrees to implement the following:

  • Professional Development Allowance 55.1 The CEO may, subject to this clause, approve the reimbursement or payment of financial assistance to a Science and Engineering Professional employee to offset professional development costs.

  • Professional Development Funds 23.1.1 Two Professional Development Funds, a Professional Development Support Fund and an Education Leave Fund, shall be established to support professional development activities as defined in 23.2. On April 1st of each year, the College will allocate an amount equal to no less than 0.9% of total faculty salary (exclusive of severance payments) to the Professional Development Support Fund, and an amount equal to no less than 0.6% of total faculty salary to the Educational Leave Fund. Any unused balances in these funds shall carry over to the next budget year.

  • CONSTRUCTION INDUSTRY DEVELOPMENT & PROMOTION FUND 19.01 The Employer shall contribute to the Union’s Construction Industry Development and Promotion Fund (the “Industry Fund”) the amount identified at Schedule “A” for each hour worked by each employee covered by this Agreement, and it shall remit such contributions to the Union together with union dues, and in the manner described in the Remittances to the Union article and in the Union’s remittance directives.
