Transporter’s Obligations a. On or before June 1, 2014, Transporter shall apply to the National Energy Board (“NEB”) for approval of Transporter’s transportation tariff that codifies the tolls and terms and conditions of the New Services.
Transporter’s Obligations. Are general obligations of the Transporter those contained in the legislation applicable and in Resolution No. 18 – 1258 of the 14th of July of 2010 issued by the Ministry of Mines and Energy, as amended, added or replaced from time to time and, in particular, those contained in this Transporter’s Manual and the Transportation Contract entered into with the Sender. Transporter’s Obligations. (a) The Transporter will, at the time the Confirmed Nominations are issued to the Shipper, determine the flow rates (in GJ/Day) required to flow from each Receipt Point to each Delivery Point to meet the Shipper's Confirmed Nominations including any Gas for correcting any Daily Imbalance.
Transporter’s Obligations. On a Day, the Transporter must supply Gas at a Delivery Point at a pressure between the minimum and maximum pressures set out in the relevant Annexure.
Transporter’s Obligations. Transporter will receive Gas up to the Scheduled Quantity at the Receipt Point(s) as nominated and tendered by Shipper under the terms of this Statement of Operating Conditions, the Service Agreement, its applicable Confirmation, and any Agency Agreement, transport and deliver an equivalent quantity of Gas, in MMBtu, to Shipper at the Delivery Point(s), less the Retention Volume as set forth in Section 9.2 of this Statement of Operating Conditions. Transporter's obligations to receive, transport, and deliver Gas to the Delivery Point(s) shall be in accordance with the applicable character of service (i.e., Firm or Interruptible), and are subject to: (i) an event of Force Majeure; (ii) Shipper's failure or refusal to deliver Gas to or receive Gas from Transporter as required under this Statement of Operating Conditions, the Service Agreement and any applicable Confirmation; (iii) any laws, rules, orders, or requirements of any governmental or regulatory authorities that limit, prevent, or interfere with Transporter's performance; and (iv) as otherwise provided under any other terms and conditions in this Statement of Operating Conditions, the Service Agreement, any applicable Confirmation, and any applicable Agency Agreement. Shipper acknowledges that the quantity of Gas physically received or delivered by Transporter may be different than the Scheduled Quantity and, for those Receipt Point(s) and Delivery Point(s) at which Transporter has operational balancing agreements, the Scheduled Quantity is deemed to have been received or delivered for the account of Shipper, subject to the remaining terms and conditions of this Statement of Operating Conditions, the applicable Service Agreement, any applicable Confirmation, and any applicable Agency Agreement. In the event of constraints at a Delivery Point(s) or on a downstream pipeline, Transporter will rely on the downstream party's allocation at the affected Delivery Point(s) and, to the extent Shipper's Nominations are reduced, Shipper will be deemed to have failed to receive Gas from Transporter as required hereunder.

Transporter’s Obligations. (a) Transporter agrees to use commercially reasonable efforts to timely seek the contractual and property rights, financing arrangements and regulatory approvals, including the necessary authorizations from FERC, as may be necessary to construct and operate the Project so as to provide firm transportation service to Shipper consistent with the terms and conditions in this Agreement. Transporter shall have the right to terminate this Agreement, in its judgment, if FERC attaches any material conditions to Transporter’s authority to construct, modify, own or operate any aspect of the Project. Once construction of Project has commenced, Transporter shall provide Shipper monthly written updates on the progress of the Project, including updates regarding the Anticipated Service Date. Shipper will use commercially reasonable efforts to provide Shipper thirty (30) days advanced notice of the Service Commencement Date.
Transporter’s Obligations. Transporter will receive Gas up to the Scheduled Quantity at the Receipt Point(s) as nominated and tendered by Shipper under the terms of this Statement of Operating Conditions, the Service Agreement, its applicable Confirmation, and any Agency Agreement, transport the Gas, and deliver Gas to Shipper at the Delivery Point(s), less the Retention Volume as set forth in Section 9.2 of this Statement of Operating Conditions. In the event of constraints at a Delivery Point(s) or on a downstream pipeline, Transporter will rely on the downstream party’s allocation at the affected Delivery Point(s) and, to the extent Shipper’s nominations are reduced, Shipper will be deemed to have failed to receive Gas from Transporter as required hereunder.
Transporter’s Obligations. Transporter agrees to obtain or cause to be obtained the contractual and property rights, financing arrangements and regulatory approvals, including authorizations from FERC under the Natural Gas Act, as may be necessary to construct the Project so as to provide firm transportation service at the levels specified herein to Shipper by the Term Commencement Date.
