Tribe a. Purchases by the Tribe or a Tribal Entity of tangible personal property for its use, including but not limited to Governmental Functions identified in § III(A)(1)(b), below, and commercial activities are exempt from both the sales tax and use tax if the transaction takes place and the property is used exclusively within the Tribal and Trust Lands.
Tribe. Where approval or consent or other action of the Tribe is required, such approval shall mean the written approval of the Tribal Council evidenced by a resolution thereof, certified by a Tribal official as having been duly adopted, or such other person or entity designated by resolution of the Tribal Council. Any such approval, consent or action shall not be unreasonably withheld or delayed.
Tribe. The term ‘‘Tribe’’ means the Hualapai Tribe, organized under section 16 of the Act of June 18, 1934 (25 U.S.C. 476) (commonly known as the ‘‘Indian Reorganization Act’’), and recognized by the Secretary.
Tribe. The Tribe agrees that it will provide Monroe, through its designee, an annual certification verifying that the Tribe's calculation of Monroe's Revenue Share is true and correct and that the amount is equivalent to that to which Monroe is entitled under the terms of this Agreement. Upon request by the Monroe’s designee, the Tribe will permit Monroe’s designee to review books and records sufficient to verify the accuracy of the Tribe’s calculation of Monroe’s Revenue Share, provided that such viewing shall not be deemed a waiver of the confidential and proprietary nature of such financial information. If, after reviewing the relevant books and records, Monroe’s designee is not satisfied with the Tribe’s calculation, the Tribe and Monroe shall by mutual agreement designate an independent accounting firm of national repute to review the Tribe’s audit statement and
Tribe. The Tribe shall indemnify, defend, and hold harmless the City, its officers, agents, and employees from all suits, claims, or liabilities of any nature, including attorney’s fees, costs, and expenses, for or on account of injuries or damages sustained by any person or property, resulting from acts or omissions of and to the extent harm is caused by the Tribe, its elected officials , officers, agents or employees in connection with maintenance and operation of the JSSCS or for breach of its duties under this O&M Agreement. If suit in respect to the above is filed, the Tribe shall defend the suit at the Tribe's own cost and expense, and if judgment is rendered or settlement made requiring payment by the City, its officers, agents or employees, the Tribe shall pay the same. Should a court of competent jurisdiction determine that this indemnity agreement is subject to RCW 4.24.115, then in the event of liability for damages arising out of bodily injury to persons or damages to property caused or resulting from the concurrent negligence of the City and the Tribe, it elected officials, officers, employees or agents, the Tribe's liability hereunder shall only be to the extent of the Tribe's negligence. The Tribe is not subject to the requirements or provisions of Title 51 RCW.
Tribe. The Tribe is a federally recognized Indian Tribe, with authority to enter into and perform its obligations under the Indenture. The Constitution of the Tribe dated March 28, 1975 (the "Constitution") was validly adopted by the Tribe, is effective according to its terms, and is the law of the Tribe.

Tribe. Tribe shall meant to be the Pinoleville Pomo Nation of Indians, or such other Tribe that the FoxBarry shall enter into a Medical Marijuana Management agreement, located in the State of California. Any agreements FoxBarry shall enter into agreement with other Tribes located outside the state of California shall be covered by another agreement between the Parties.
