TUITION AND TEXTBOOK REIMBURSEMENT. 1. Employees covered by Veteran' s Administration benefits pertaining to tuition or textbook reimbursement shall not be entitled to receive the reimbursement benefits provided hereunder. 2. All courses taken must be of three (3) or more weeks duration except that any portion of a calendar year tuition maximum may be used for short courses (less than three weeks' duration) that are approved by management. e. An approved course of study shall be deemed successfully completed if: (1) A grade of "C" or higher is received and such course of study is an undergraduate course of study; or (2) A grade of "B" or higher is received and such course of study is a graduate course of study; or (3) When grades are not given or the course of study taken is a non-credit one then the employee must present to aforesaid City-designated administrator within the time limit above described a written statement from the course's instructor that the employee has satisfactorily completed the course of study. 4. An employee must remain in service for a six-month period after successful completion date of approved course or the amount reimbursed will be deducted from the employee's final paycheck. The City may pay up front those tuition and textbook costs for programs offered by and as determined by the City's Training and Development Services Unit. If an employee does not meet criteria in Section 3, above, payment will be deducted from the employee's paycheck. 5. Payment of reimbursement described under subsection 2, above, shall be made as soon as is administratively practicable after the reimbursement application and evidence of successful completion of the approved courses of study is received. 6. Any payment made under the provisions of this Article shall not have any sum deducted for pension benefits nor shall such payments be included in the determination of pension benefits or other fringe benefits. 7. The Director of Employee Relations shall administer this program in accordance with practices established for the City's general reimbursement program.

TUITION AND TEXTBOOK REIMBURSEMENT. 1. Employees covered by Tuition and textbook reimbursement shall be in accordance with the Veteran' s 's Administration benefits and Safe Streets Act benefits pertaining thereto. In no event shall there be any duplication of these benefits paid the employee. 2. If an employee is ineligible to receive tuition or textbook reimbursement shall not be entitled to receive under the reimbursement benefits provided hereunder. 2. In the event an employee provisions of paragraph 1, above, and meets the criteria specified under in paragraphs 3 and 4 of this Article4, below, the City shall effective upon the execution date of this Agreement provide the employee reimbursement of tuition, laboratory fees and required textbooks for Police Department-approved courses of study up to a combined maximum reimbursement of $600 in calendar years 2010 and2011(tuition, of which $300 may be used for reimbursement of costs for laboratory fees and required textbookstextbooks costs added together) of $1000 in calendar year 2004. Effective upon execution of the 2004-2006 Agreement, the annual calendar year maximum reimbursement shall be increased to $1,200. 3. In order for the employee' s course 's courses of study to qualify for reimbursement under paragraph 2 of this Article2, above, the following criteria must be metsatisfied: a. All coursework and related homework must be done on the employees own time. b. All courses of study shall must be directly related to an employee' s 's job or to a reasonable promotional opportunity within the City and be approved by the Fire Department AdministrationPolice Chief. Graduate courses must be directly related to an employee' s 's present position. Effective the pay period following execution of this Agreement, coursework which is approved to be on City time by both the Police Chief and the Employee Relations Director may be on City time. c. b. A Police Department approved course of study shall be deemed successfully completed if: (1) A grade of "C" or higher is received and such course of study is an undergraduate course of study; or (2) A grade of "B" or higher is received and such course of study is a graduate course of study; or (3) When grades are not given or the course of study taken is a non-credit one then the employee must present to aforesaid City-designated administrator within the time limit above described a written statement from the course's instructor that the employee has satisfactorily completed the course of study. 4. Employees must remain in service for a six-month period after receiving Tuition and Textbook reimbursement from the City or the amount reimbursed will be deducted from the employee's final paycheck. 5. An employee with full-time student status (12 or more credits) is not eligible for tuition reimbursement. 6. Payment of reimbursement described in paragraph 2, above, shall be made as soon as is administratively practicable after the reimbursement application and evidence of successful completion of the Police Department approved courses of study is received by the City- designated administrator. The City may pay up front those tuition and textbook costs for programs offered by and as determined by the City's Training and Development Services Unit. If an employee does not meet the criteria listed in Article 25.3, payment will be deducted from the employee's paycheck. 7. Any payment made under the provisions of this paragraph shall not have any sum deducted for pension benefits nor shall such payments be included in the determination of pension benefits or other fringe benefits.
