Common use of Union Activities Clause in Contracts

Union Activities. (a) The Company acknowledges the right of the Union to appoint or otherwise elect (1) Xxxxxxx who shall be an employee of the Company and who shall represent the two (2) seniority groups. (b) The Union will notify the Company in writing of the names of its Stewards and may also notify the Company of the names of additional employees who may serve as alternate Stewards in the absence from work of a regular Xxxxxxx. The Company will not recognize any individual as a Xxxxxxx until it has received such notification from the Union. (a) The Union acknowledges that a xxxxxxx has regular duties to perform on behalf of the Company. In a grievance situation which requires a xxxxxxx’x attention during working hours, they shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. It is understood that the taking of such time away from regular duties shall be kept to a minimum and that permission will not therefore be unreasonably withheld. Stewards shall return to their regular duties as expeditiously as possible. The Company reserves the right to limit such time if the time requested is unreasonable. (b) Should a Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting of the general membership of the Union is to be held, such Xxxxxxx shall (provided their request is made at least two (2) weeks in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings of the Union or its members will be held on the premises of the Company at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall be cause for discipline of such employee by the Company. (b) Subject to the foregoing, the Company agrees that no employee shall be disciplined or discriminated against for lawful Union activities, or performing services on a Union committee outside working hours, or for reporting to the Union the violation of any provision of this Agreement. 8.04 The Company agrees to provide access to the bulletin board on its premises for the use of the Union. The main purpose of the bulletin boards shall be for the posting of proper notices related to Union meetings, Union elections, the names of Union Officers or stewards, social and recreation events. With respect to such notices prior approval of the Company need not be obtained although the Union shall furnish the Company with a copy of such notices prior to posting. The contents of such notices will not contain any comments that are detrimental to the Company or any of its employees. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to posting. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's efforts to assure a full day's work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 At the request of the Union, the Company will grant time off, without loss of regular pay during the employee's regular working hours, to one (1) employee to allow him/her to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisor.

When a union xxxxxxx is transferred by an action of management (not including promotion or transfer at the employee's request), the Xxxxxxx may continue to act as a xxxxxxx for his/her former work site for a period not to exceed thirty (30) days from original notification. The Union will supply the Chancellor or his/her designee with lists of Xxxxxxx names which shall be posted on appropriate bulletin boards. The Union shall notify the Chancellor of changes in the roster of Stewards. Stewards are authorized to perform and discharge Union duties and responsibilities which may be assigned to them under the terms of this Agreement. C. Time for Performance of Duties 1. Stewards shall obtain permission from the administrator in charge of their worksite (e.g., a school principal) prior to leaving their work assignments to properly and expeditiously carry out their duties during a reasonable amount of official time to be heldestimated in advance whenever possible. Before attempting to see an employee, such the Xxxxxxx shall (provided will obtain permission from the administrator in charge of their request worksite. Such permission will be granted unless the employee cannot be immediately relieved from his assigned duties, in which case permission will be granted as soon as possible thereafter. The allowing of any such time off shall, however, shall be subject to recall to duty, and shall not be entitled to overtime pay for attendance at such meetings. Section 4: Insofar as permitted by the employee having obtained permission requirements of the Department of Public Works, up to leave two (2) Union Officers and/or Stewards may be excused at the same time from duty, without pay, when required to conduct Union business other than joint meetings with management. The Union will be allowed to use up to 48 person hours per year and shall request time off at least 48 hours in advance so that work from his/her Supervisorschedules may be arranged accordingly. Time off shall be granted in periods of half or whole days. Section 5: Insofar as permitted by the requirements of the Department of Public Works, the Business Manager and up to one other elected delegate may be allowed to attend the annual International Convention of the Laborers’ International Union of North America without pay. The Union will be allowed to use up to 64 person hours per year and shall request time off at least 30 days in advance so that work schedules may be arranged accordingly. Time off shall be granted in periods of half or whole days.

Employees excused for any of the meetings described above are expected to return to work when their attendance is no longer required, except that following completion of such meetings, employees will be permitted a brief wrap-up session, not to exceed 15 minutes, unless production needs require employees to report to their work stations sooner, or a period longer than 15 minutes is mutually agreed upon by the Company and the Union. An employee shall give reasonable notice to his or her supervisor of an absence contemplated by the preceding paragraphs. C. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to posting. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's efforts to assure a full day's work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 At the request of the Union, the Company will grant time off, without loss of regular pay during the employee's regular working hours, to one (1) employee to allow him/her to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of may withhold any such time off shall, however, be subject to the employee having obtained permission to requested leave work from his/her Supervisorif it would cause unreasonable interference with operations.

Union Activities. (a) The Company acknowledges the right of 6.01 No employee shall be discriminated against or discharged for his/her activity as a Union member or for doing committee or other work for the Union to appoint or otherwise elect (1) Xxxxxxx who shall be an employee of provided, however, that permission from the Company is first obtained if such activities occur during working hours and who shall represent interfere with the two (2) seniority groups. The Union Representative and Union Xxxxxxx will have the keys to the board. (a) Every Union Xxxxxxx and every Officer of the Union who is an employee shall be allowed such time off as may be necessary to enable him/her to attend those appointments with Management personnel at which his/her presence is required under the provisions of Article 8 and every employee who is a necessary witness at a grievance situation which requires meeting or at a xxxxxxx’x attention during working hours, they grievance arbitration hearing established under Article 8 shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. It is understood that the taking of be allowed such time away from regular duties shall off as may be kept necessary to a minimum and that permission will not therefore be unreasonably withheld. The Company reserves Chief Xxxxxxx will be allowed the right to limit such time if the time requested is unreasonable. (b) Should a Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting of the general membership of the Union is to be held, such Xxxxxxx shall (provided their request is made at least last two (2) weeks in advance) hours of work on Friday each week for Union business. The Chief Xxxxxxx will be required to remain at work for a minimum of at least one of these two hours. In the absence of the Chief Xxxxxxx, the designate will be allowed the last hour of work on Friday for Union business. The designate will be required to remain at work for this hour. If a Friday is a Holiday or a vacation day the Union time will be moved to the closest day. 6.02 Committee members and Stewards handling grievances and negotiations with the Company shall be paid their usual rates for any lost time. 6.03 The Company agrees to grant leave of absence without pay for a period of not more than twelve (12) months, or for the balance or the duration of this Agreement, whichever is the longer, to any employees who have been elected or appointed as Officials of the International Union or of the Local Union, if such time off work as duties require them to have a leave of absence from their Company duties on a fulltime basis. 6.04 Employees on such leave of absence may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of continued as active members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, pension and before the start and end of an employee's shift. In no case shall the ongoing operation welfare plan upon payment of the Company be disrupted. It is understood and agreed that no meetings of total contributions whether from the Union or its members will be held on from the premises employee concerned. During such periods of leave of absence, the Company employees' seniority shall continue to accumulate as if they were employed at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall be cause for discipline of such employee their regular post by the Company. Such permission will not be unreasonably withheld. 6.06 Labour/Management meetings shall be held bimonthly unless both parties agree to assure a full day's work on postponement. If required, either party may request a meeting (with an agenda) when necessary. Grievances will not be discussed at these meetings. The Union has the part option to rotate stewards. If a Xxxxxxx reports for such a meeting outside of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employeestheir scheduled shift, the customer and Xxxxxxx will be paid for such time at the public. 8.06 At the request straight time hourly rate, with a minimum of the Union, the Company will grant time off, without loss of regular pay during the employee's regular working hours, to one (1) employee hour of pay. The Union Representative may attend if prior notification is given. 6.07 The Union will supply the Company with current lists of elected representatives and stewards. 6.08 The Company will grant up to allow him/her a total of four (4) days paid leave of absence to the Plant Committee in each calendar year. This leave is to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer used solely for the purpose of negotiating a renewal of this Collective Agreement. The allowing of attending union business and shall not exceed four (4) cumulative days in any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisorcalendar year.

Union Activities. (a) 8.01 It is agreed that except as herein otherwise specifically permitted, no Union activities shall be conducted on the employer’s premises. 8.02 The Company acknowledges Employer shall recognise the right duly elected or appointed officers and committee persons of the Local Union. The Local Union officers and committee persons will operate under the direction of the Local Union President, or in his absence, the Local Union Vice-President or their designate. The Local Union shall provide the Employer with an up-to-date list of the officers and committee persons and shall update them as required. 8.03 The duties of the appropriate Local Union Official shall be to appoint or otherwise elect see to it that this agreement is not violated by either party to this agreement. If and when a violation of this agreement does occur then that Union Official shall draw it to the attention of the offending party and the Supervisor and have the violation corrected if at all possible. 8.04 The parties agree that employees should not harbour grievances; they should bring them to the attention of an appropriate Local Union Official and the Supervisor without delay, all as provided for in the grievance procedure. 8.05 As little time as possible will be used by the appropriate Local Union Officials in servicing grievances during working hours. When servicing a grievance after working hours the appropriate Local Union Official will be compensated at his appropriate rate up to a period of one (1) Xxxxxxx who hour. Grievances shall as much as possible be an employee of the Company and who shall represent the two (2) seniority groups. (b) The settled after working hours. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisorcarrying out their duties.

Union Activities. (a) 6.01 There shall be no Union activities during working hours which interfere with the duties of any employee unless permission is first obtained from the employee's immediate supervisor. Such permission will not be unreasonably withheld and all such time off during an employee's regular working hours shall be without loss of pay. 6.02 The Company acknowledges will make available for the right use of the Union a bulletin board for each seniority group at each Plant whereon the Union may post such notices as it desires to appoint bring to the attention of employees provided, however, that no such notice may be posted at places other than on these bulletin boards and further provided that no such notice may be posted until it has been signed by an Officer of the Union and by a rep- resentative of management. 6.03 From time to time during the currency of this Agreement, upon the written request of the Union, the Company will grant leaves of absence without pay to the employees named in such request to enable them to participate in Union activities. No such leave of absence shall be for a period of less than one day or otherwise elect more than seven days except that where a leave is granted to an employee to enable him to attend a Union convention, the maximum of seven (7) days may be exceeded to the extent of necessary travel time to the place of convention and return. No more than eight (8) such leaves will be granted in any one year of the currency of this Agreement and no more than three (3) employees may be absent on such leave at any one time. If the maximum of eight (8) leaves in any year of this Agreement has been granted, the Company will consider any further request for such leave in that year on an individual basis. 6.04 From time to time during the currency of this Agreement and upon the written request of the Union, the Company will grant a leave of absence without pay to any employee for the purpose of attending to Union business. Such leave of absence shall be for a period of not less than one (1) Xxxxxxx who shall be an employee of the Company month and who shall represent the not more than two (2) seniority groupsemployees from each plant shall be entitled to any such leave of absence at any one time. Where such leave is to be for a period of less than one (1) year, the Union shall specify the period to be covered. If the leave is expected to be required for a period in excess of one (1) year, it shall be treated as an indefinite leave of absence and the Company's approval of such leave shall be considered to continue throughout the life of this Agreement. To the extent that it is practical to do so, the Company will endeavour to arrange for the continuance of both Company and Government welfare benefits while an employee is absent on such leave. 6.05 With respect to employees granted leave of absence under the provisions of clauses 6.03 or 6.04 above, it is agreed that on the written request of the Union: (a) Each employee shall receive from the Company in respect of each day of absence on such leave, an amount equivalent to: (i) the regular straight-time hourly rate then in effect for his employment classification, multiplied by eight (8) hours, (ii) all deductions normally withheld by law from an employee's pay and, if applicable, the employee's contributions to the Extended Group Insurance Plan. (b) The Union will notify shall promptly reimburse the Company in writing for the sum of: (i) the gross amount of the names of its Stewards and may also notify payment calculated as set out in (a) (i) above, (ii) any amount which becomes payable by the Company as a result of the names Company having made to any employee a payment under the provisions of additional (a) above (e.g. Company contributions to the Extended Group Insurance Plan, Unemployment Insurance, Government Pension Plan and Health Plan, etc.). In the event of failure of the Union to so reimburse the Company, all payments to employees who under (a) above shall immediately cease. (c) In consideration of the agreement of the Company to make payments as provided above, the Union agrees to indemnify the Company and save it harmless from and against any and all claims, payments, and costs of any kind which it may serve as alternate Stewards in receive, make or suffer, directly or indirectly, through having agreed to make and having made such payments, deductions and contributions or by reason of any imputed employment relationship which might be alleged to exist between such employee and the Company by reason of the making of such payments. 6.06 The granting of any leave of absence from work under clauses 6.03 or 6.04 may be refused by the Company when the granting of a regular Xxxxxxx. The Company will not recognize any individual as a Xxxxxxx until it has received such notification from the UnionRepresentatives. 6.2 There shall be up to three (a3) union workplace representatives, one from each shift. 6.3 The Union acknowledges that a xxxxxxx has the union workplace representative have regular duties to perform on behalf of the Company. In Where a grievance situation which requires a xxxxxxx’x representative’s attention during working hours, they he shall not leave their his regular duties without first obtaining permission to do so from their his immediate supervisor. It is understood that the taking of such time away from regular work duties shall be kept to a minimum and that permission will not therefore be unreasonably withheld. Stewards The representative shall return to their regular duties as expeditiously as possible. The Company reserves the right to limit such time if the time requested is unreasonable. (b) Should a Union Xxxxxxx be scheduled to be on duty during 6.4 The Company recognizes the time in which a regularly scheduled meeting of the general membership right of the Union is to be held, such Xxxxxxx shall (provided their request is made at least appoint or otherwise select two (2) weeks in advance) employees to the Negotiating Committee. It shall be allowed such time off work as may be reasonably required in the circumstances Negotiating Committee’s function to permit them meet with the Company to attend such meetingnegotiate the renewal of this Agreement. Union Activities. If and when a violation of this agreement does occur then that Union Official shall draw it to the attention of the offending party and the Supervisor and have the violation corrected if at all possible. 8.04 The parties agree that employees should not harbour grievances; they should bring them to the attention of an appropriate Local Union Official and the Supervisor without delay, all as provided for in the grievance procedure. 8.05 As little time as possible will be used by the appropriate Local Union Officials in servicing grievances during working hours. When servicing a grievance after working hours the appropriate Local Union Official will be compensated at his appropriate rate up to a period of one (1) Xxxxxxx who hour. When such permission is granted, the Union Representative will sign "out" and may also "in" in his/her own department and in the department or section he/she visits on forms provided by the Company. Such time spent shall be considered Union business time and subject to the provisions of 6.7. 6.5 A Union Representative who enters a section or department other than his own for the purpose of investigating a grievance, must first notify the Company supervisor of such other section or department of the names reason for his/her presence before commencing his/her investigation of additional employees who may serve as alternate Stewards in the absence from work of a regular Xxxxxxxgrievance. Union Activities. (a) 28.01 The Union will supply the Company with the Division regular meeting schedule, indicating the day of the week and the time of regular Division meetings and a list of Division Officers for the Division. 28.02 The Union shall notify the Company in writing whenever changes take place of the names of its Officers and Representatives. 28.03 The Company acknowledges shall grant to a Divisional Officer, Regional Officer, National Officer or designated representative a leave of absence without pay to fulfil their duties for Union activities i.e. conventions, seminars, meetings, and arbitration, during which he will accumulate seniority. The granting of which will not be unreasonably withheld and the Union representative will provide at least 14 days’ notice if possible. 28.04 A Local Chairperson needing to book off for immediate Union shall give as much notice as possible but in no case less than three (3) hours prior to commencement of regular assignment. 28.05 The Company recognizes the right of the Union to appoint or otherwise elect select three (13) Xxxxxxx who accredited Union Reps as follows to the Negotiating Committee. One Local Chairperson (or designate) from Mechanical, One Local Chairperson (or designate) from Locomotive Engineers, One Local Chairperson (or designate) from the Conductors. It shall be an employee the Negotiating Committee’s function to meet with the Company to negotiate the renewal of this Agreement. The members of this committee are absent from work, without loss of pay, to participate in the collective agreement negotiation and conciliation sessions. Prior to the expiry of this collective agreement, the Employer will grant the Union Bargaining Committee a maximum of five (5) days leave for the purpose of preparing for these negotiations. 28.06 Time spent by the union workplace representatives in meetings with the Company and who by employees selected under article 28.05 during negotiations with the Company shall represent be without loss of pay or benefits, provided that there shall be no entitlement to pay in respect to hours outside the two (2) seniority groupsemployee’s normal hours of work and during which the employee would not otherwise have worked. (b) 28.07 The Union will notify Company shall allow reasonable access to the Company in writing Company’s premises by a staff representative of the names Union for the purpose of its Stewards and may also notify consulting with the Company of the names of additional employees who may serve as alternate Stewards in the absence from work of a regular Xxxxxxx. The Company will not recognize any individual as a Xxxxxxx until it has received such notification from the Union. (a) The Union acknowledges that a xxxxxxx has regular duties union workplace representatives with regard to perform on behalf of union matters, or the Company. (b) Should a Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting of the general membership recognizes and agrees that Representatives of the Union is have their regular work to be helddo. Thus, such Xxxxxxx shall (provided their request is made at least two (2) weeks in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings any member of the Union who must assist an employee in presenting a grievance or its members will be held on participating in the premises settlement of any other matter directly related to the administration of this agreement may not leave his workstation without having obtained permission of the Company at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall supervisor, which will not be cause for discipline of such employee by the Companyunduly denied. The main purpose of the bulletin boards shall be for the posting of proper notices related to Union meetings, Union elections, the names of Union Officers or stewards, social and recreation events. With respect to such notices prior approval of the Company need not be obtained although the Union shall furnish the Company with a copy of such notices prior to posting. The contents of such notices will not contain any comments that are detrimental to the Company or any of its employees. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to posting. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's efforts to assure a full day's work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 At the request of the Union, the Company will grant time offEmployer releases, without loss of salary and benefit, the Local Chairperson for Locomotive Engineers, Conductors, or Maintenance (or their replacement) to handle any Union business. There is one day of release in their regular pay during the employee's regular working hours, to one (1) employee to allow him/her to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisorweek.

Union Activities. (a) 8.01 The Company acknowledges the right of the Union to appoint or otherwise elect (1) Xxxxxxx Stewards; who shall be an employee employees of the Company and who shall represent not be more than five (5) in number representing the two (2) seniority groups.following departments: (bi) The Union will notify the Company in writing of the names of its Stewards and may also notify the Company of the names of additional employees who may serve as alternate Stewards in the absence from work of a regular Distribution Department 1 Xxxxxxx. Stewards shall return to their regular duties as expeditiously as possible. The Company reserves the right to limit such time if the time requested is unreasonable. (b) . Should a Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting of the general membership of the Union is to be held, such Xxxxxxx shall (provided their request is made at least two twenty-four (224) weeks hours in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) . All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, periods and before the start and end of an employee's ’s shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings of the Union or its members will be held on the premises of the Company at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall be cause for discipline of such employee by the Company. (b) Subject to the foregoing, the Company agrees that no employee shall be disciplined or discriminated against for lawful Union activities, or performing services on a Union union committee outside working hours, or for reporting to the Union the violation of any provision of this Agreement. 8.04 The Company agrees to provide access to the bulletin board on its premises will make available for the use of the Union. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to postingmanagement. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's ’s efforts to assure a full day's ’s work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 At the request of the Union, the Company will grant time off, without loss of regular pay or benefits during the employee's ’s regular working hours, to one five (15) employee Shop Stewards covered by this Collective Agreement to allow him/her them to be a member members of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave their work from his/her the employee’s Supervisor.

Union Activities. 7.1 The company will contribute sixteen (a16) The Company acknowledges hours per week to the right salary of the Union to appoint or otherwise elect General Chairman. The Company granting of which will not recognize any individual as a Xxxxxxx until it has received such notification from the Unionbe unreasonably withheld. (a) 7.4 The Union acknowledges that a xxxxxxx has the union workplace representative have regular duties to perform on behalf of the Company. (b) Should a Union Xxxxxxx be scheduled to be on duty during 7.5 The Company recognizes the time in which a regularly scheduled meeting of the general membership right of the Union is to appoint or otherwise select four (4) employees to the Negotiating Committee. In no case shall the ongoing operation of the Company be disruptedCompany. It is understood and agreed that no meetings such visits will be timed to cause as little disruption as possible to the normal conduct of the business. 7.8 The Company shall provide the Union or its members will be held on with no less than one (1) day of access to each group of newly hired employee(s), with the premises of costs, if any, being the Company at any time without the prior written approval responsibility of the Company. Union Activities. (a) The Company acknowledges Section 22.1 Except as provided elsewhere in this Agreement, union representatives or members will not engage in any union activity during working time or in any working area in a way that interferes with the right efficient operation of the Union Township. Section 22.2 The Employer agrees to appoint or otherwise elect provide a bulletin board (1appx. 36” x 24”) Xxxxxxx who shall be an employee in the maintenance shop, and a section of the Company bulletin board in the office, for announcements of meetings and who other material related to Union business with the Employer. In a grievance situation which requires a xxxxxxx’x attention during working hours, they shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. It is understood that the taking of such time away from regular duties shall be kept to a minimum and that permission will not therefore be unreasonably withheld. The Company reserves post political material, nor will it be used to post notices that are derogatory of or inflammatory toward the right to limit such time if the time requested is unreasonableEmployer. (b) Should a Section 22.3 The Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting of the general membership of the Union is to be held, such Xxxxxxx shall (provided their request is made at least two (2) weeks in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings of the Union or its members will be held on the premises of the Company at any time without the prior written approval of the Company. The Union agrees to allow himfurnish the Employer with the name of the union xxxxxxx and to keep the list current. The Employer will have no obligation to deal with any xxxxxxx who is not on said list. The Employer agrees that the union xxxxxxx shall be free to conduct his/her to be a member union duties on Township property provided that such duties do not interfere with normal operations. Section 22.4 Non-employee staff representatives of the Union Negotiating Committee shall be permitted to attend arranged meetings visit bargaining unit employees at work between the hours of 9:00 a.m. and 3:00 p.m. Such visits shall not interfere with Company representatives the operation of the Employer or with a Conciliation Officer for the purpose performance of negotiating a renewal of this Collective Agreement. The allowing of any such time off shallemployees’ duties, howeverand the Union representative shall inform the Township Manager, be subject to the employee having obtained permission to leave work from or his/her Supervisordesignee, of his/her visit prior to entering the Employer’s premises. The Union will furnish the name of the authorized representative and/or his designee and, the Employer is obliged only for admission of such authorized representative and/or designee. The foregoing visitation privilege does not include or allow the holding of Union meetings on the Employer’s premises, without regard to whether a Union representative does or does not attend.

Union Activities. 6.01 There shall be no Union activities during working hours which interfere with the duties of any employee unless permission is first obtained from the employee's immediate supervisor. Such permission will not be unreasonably withheld and all such time off during an employee's regular working hours shall be without loss of pay. 6.02 The Company will make available for the use of the Union a bulletin board at each Plant whereon the Union may post such notices as it desires to bring to the attention of employees provided, however, that no such notice may be posted at places other than on these bulletin boards and further provided that no such notice may be posted until it has been signed by an Officer of the Union and by a representative of management. 6.03 From time to time during the currency of this Agreement, upon the written request of the Union, the Company will grant leaves of absence without pay to the employees named in such request to enable them to participate in Union activities. No such leave of absence shall be for a period of less than one day or more than seven days except that where a leave is granted to an employee to enable him/her to attend a Union convention, the maximum of seven (7) days may be exceeded to the extent of necessary travel time to the place of convention and return. No more than ten (10) such leaves will be granted in any one year of the currency of this Agreement and no more than four (4) employees may be absent on such leave at any one time. If the maximum of ten (10) leaves in any year of this Agreement has been granted, the Company will consider any further request for such leave in that year on an individual basis. 6.04 From time to time during the currency of this Agreement and upon the written request of the Union, the Company will grant a leave of absence without pay to any employee for the purpose of attending to Union business. Such leave of absence shall be for a period of not less than one (1) month and not more than six (6) employees from each plant shall be entitled to any such leave of absence at any one time. Where such leave is to be for a period of less than one (1) year, the Union shall specify the period to be covered. If the leave is expected to be required for a period in excess of one (1) year, it shall be treated as an indefinite leave of absence and the Company's approval of such leave shall be considered to continue throughout the life of this Agreement. To the extent that it is practical to do so, the Company will endeavour to arrange for the continuance of both Company and Government welfare benefits while an employee is absent on such leave. 6.05 With respect to employees granted leave of absence under the provisions of clauses 6.03 and 6.04 above, it is agreed that on the written request of the Union: (a) The Company acknowledges the right of the Union to appoint or otherwise elect (1) Xxxxxxx who Each employee shall be an employee of receive from the Company in respect of each day of absence on such leave, an amount equivalent to: (i) the regular straight-time hourly rate then in effect for his/her employment classification, multiplied by eight (8) or ten (10) hours, whichever is appropriate (ii) all deductions normally withheld by law from an employee's pay and, if applicable, the employee's contributions to the Extended Group Insurance Plan, the Employees' Retirement Plan and who shall represent the two (2) seniority groupsEmployee Savings and Investment Plan. (b) The Union will notify shall promptly reimburse the Company in writing for the sum of: (i) the gross amount of the names payment calculated as set out in (a) (i) above, (ii) with the exception of its Stewards and may also notify leaves of absence granted under the provisions of clause 6.03 above, any amount which becomes payable by the Company as a result of the names Company having made to any employee a payment under the provisions of additional (a) above (e.g. Company contributions to the Employees' Retirement Plan, the Employee Savings and Investment Plan, the Extended Group Insurance Plan, Employment Insurance, Government Pension Plan and Health Plan, etc.). In the event of failure of the Union to so reimburse the Company, all payments to employees who under (a) above shall immediately cease. (c) In consideration of the agreement of the Company to make payments as provided above, the Union agrees to indemnify the Company and save it harmless from and against any and all claims, payments, and costs of any kind which it may serve as alternate Stewards in receive, make or suffer, directly or indirectly, through having agreed to make and having made such payments, deductions and contributions or by reason of any imputed employment relationship which might be alleged to exist between such employee and the absence from work Company by reason of a regular Xxxxxxx. The Company will not recognize any individual as a Xxxxxxx until it has received the making of such notification from the Unionpayments. (b) Provided he/she is an employee, the Union Xxxxxxx and the President, or his designate shall be allowed such time off with pay, as may be necessary to enable him/her to attend those appointments with management personnel at which his/her presence is required under the arbitration provisions of this collective agreement. In addition, the Company will pay the regular wages for employees called by the Union as arbitration witnesses, provided that such employees actually give evidence at the arbitration hearing on the day that (c) The Company will also be responsible for the wages for arbitration witnesses who would otherwise give testimony save for the Company making a preliminary objection, requesting an adjournment or seeking some other form of delay of which the Union was not previously notified. In the event that the Union is given advance notice of such Company position, the Union will only require those employees necessary for dealing with the preliminary issue to be absent from work. (d) The Company will pay the regular wages for the grievor to attend at arbitration in all circumstances, provided that the grievor is still an active employee of the Company on the date of the arbitration hearing(s). (e) Should a Union Xxxxxxx or Union Officer be scheduled to be on duty during the time in which a regularly scheduled meeting of the general membership of the Union is to be held, such Xxxxxxx shall (provided their his/her request is made at least two (2) weeks 24 hours in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them him/her to attend such meeting. (cf) The allowing of time off under the provisions of this Article 6.06 shall be subject to the employee having obtained permission to leave his/her work from his/her Supervisor. (g) All such time off under the provisions of Article 8.02, 6.06 during a Xxxxxxx’x an employee's regular working hours, hours shall be without loss of pay. However, the Company may discontinue paying for such time off, if, in its opinion, the privilege of requesting such time off under any provision of Article 6.06 is being abused. (ah) The Union agrees that there When stewards are elected or otherwise appointed to such position, every effort shall be no solicitation made by the Union to ensure adequate xxxxxxx representation on all shifts and days of members work. 6.07 The granting of any leave of absence under clauses 6.03 or other Union activities on 6.04 or 6.06 may be refused by the premises Company when the granting of the Company, or during working hours except during lunch periods, rest periods, and before same would be unreasonable having regard to the start and end requirements of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings of the Union or its members will be held on the premises of the Company at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall be cause for discipline of such employee by the Companyoperations. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to posting. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's efforts to assure a full day's work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 6.08 At the request of the Union, the Company will grant time off, without loss of regular pay during the employee's regular working hours, to one not more than four (14) employees and to any employee holding the office of President of Local Union 385 to allow him/her them to be a member members of the Union Negotiating Committee and to enable them to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave his/her work from his/her Supervisor.

Union Activities. It is understood that the taking of such Company duties on a full-time away from regular duties shall be kept to a minimum and that permission will not therefore be unreasonably withheld. Stewards shall return to their regular duties as expeditiously as possible. The Company reserves the right to limit such time if the time requested is unreasonablebasis. (b) Should a Union Xxxxxxx 6.04 Employees on such leave of absence may be scheduled to be on duty during the time in which a regularly scheduled meeting continued as active members of the general membership pension and welfare plan upon payment of the Union is to be held, such Xxxxxxx shall (provided their request is made at least two (2) weeks in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings of total contributions whether from the Union or its members will be held on from the premises employee concerned. During such periods of leave of absence, the Company employees' seniority shall continue to accumulate as if they were employed at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall be cause for discipline of such employee their regular post by the Company. (b) Subject 6.05 Where a Union Representative wishes to enter the foregoingCompany's premises to process or investigate any grievance, the Company agrees that no employee Union Representative shall be disciplined or discriminated against for lawful Union activities, or performing services on a Union committee outside working hours, or for reporting to obtain the Union the violation permission of any provision of this Agreement. 8.04 The Company agrees to provide access to the bulletin board on its premises for the use of the Union. The main purpose of the bulletin boards shall be for the posting of proper notices related to Union meetings, Union elections, the names of Union Officers or stewards, social and recreation events. With respect to such notices prior approval an official of the Company need prior to entering the Company's premises. Such permission will not be obtained although the unreasonably withheld. 6.06 Labour/Management meetings shall be held bi-monthly unless both parties agree to a postponement. If required, either party may request a meeting (with an agenda) when necessary. Grievances will not be discussed at these meetings. 6.07 The Union shall furnish will supply the Company with a copy current lists of such notices prior to posting. The contents of such notices will not contain any comments that are detrimental to the Company or any of its employees. This leave is to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer used solely for the purpose of negotiating a renewal of this Collective Agreement. The allowing of attending union business and shall not exceed four (4) cumulative days in any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisorcalendar year.

No more than eight (8) such leaves will be granted in any one year of the currency of this Agreement and no more than three (3) employees may be absent on such leave at any one time; provided, without loss however, that there shall be no limit on the number of regular pay such leaves that may be granted to an employee holding the office of President of Local 350 or a designated alternate. 6.04 Other than as noted below, the granting of any leave of absence under clause 6.03 may be refused by the Company if there is no suitable replacement employee available who is capable of satisfactorily performing the work of the employee requesting the leave. An exception to the foregoing shall be made for an employee holding the office of President of Local 350 (and/or a designated alternate), provided that the Union has advised the Company of its requirements at least forty-eight (48) hours in advance of such employee's absence. 6.05 From time-to-time during the employee's regular working hourscurrency of this Agreement and upon the written request of the Union, the Company will grant a leave of absence without pay to any employee for the purpose of attending to Union business. Union Activities. (a) 7.01 It is agreed that except as herein otherwise specifically permitted, no Union activities shall be conducted on the employer's premises. 7.02 The Company acknowledges Employer shall recognise the right duly elected or appointed officers and committee persons of the Local Union. The Local Union officers and committee persons will operate under the direction of the Local Union President, or in his absence, the Local Union Vice-President or their designate. The Local Union shall provide the Employer with up-to-date list of the officers and committee persons and shall update them as required. 7.03 The duties of the appropriate Local Union Official shall be to appoint or otherwise elect see to it that this agreement is not violated by either party to this agreement. If and when a violation of this agreement does occur then that Union Official shall draw it to the attention of the offending party and the Supervisor and have the violation corrected if at all possible. 7.04 The parties agree that employees should not harbour grievances; they should bring them to the attention of an appropriate Local Union Official and the Supervisor without delay, all as provided for in the grievance procedure. 7.05 As little time as possible will be used by the appropriate Local Union Officials in servicing grievances during working hours. When servicing a grievance after working hours the appropriate Local Union Official will be compensated at his appropriate rate up to a period of one (1) Xxxxxxx who hour. (b) Subject to the foregoing, the Company agrees that no employee shall be disciplined or discriminated against for lawful Union activities, or performing services on a Union committee outside working hours, or for reporting to the Union the violation of any provision of this Agreement. 8.04 The Company agrees to provide access to the bulletin board on its premises for the use of the Union. The main purpose of the bulletin boards shall be for the posting of proper notices related to Union meetings, Union elections, the names of Union Officers or stewards, social and recreation events. With respect to such notices prior approval of the Company need not be obtained although the Union shall furnish the Company with a copy of such notices prior to posting. The contents of such notices will not contain any comments that are detrimental to the Company or any of its employees. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to posting. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's efforts to assure a full day's work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 At the request of the Union, the Company will grant time off, without loss of regular pay during the employee's regular working hours, to one (1) employee to allow him/her to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisor.

Union Activities. (a) The 3.1 It is recognized that from time to time it may be necessary for employees representing the Union to carry out their Union duties during their working hours. Employees shall first obtain permission from their supervisor prior to conducting any Union activity or business on Company acknowledges premises at any time. Maintenance or earnings shall be the right responsibility of the Employer, unless otherwise specifically agreed to. Other representatives of the Union shall obtain prior approval from a Company supervisor prior to appoint conducting any Union activity or otherwise elect (1) Xxxxxxx who business on Company premises at any time. 3.2 Employees representing the Union shall be an employee granted short term leaves of absence of twenty-two (22) working days or less, in order to carry out their Union duties. 3.3 Such leaves of absence shall be granted, insofar as the regular operations of their department shall permit, and the application shall be given precedence over any other leave of absence application received on the same day. 3.4 Members of the Negotiating Committee who are not performing their regular duties, but who are meeting with the Company and who shall represent the two (2) seniority groups. (b) The Union will notify the Company in writing of the names of its Stewards and may also notify the Company of the names of additional employees who may serve as alternate Stewards in the absence from work of a regular Xxxxxxx. The Company will not recognize any individual as a Xxxxxxx until it has received such notification from being paid by the Union. (a) The Union acknowledges that a xxxxxxx has regular duties to perform on behalf of the Company. In a grievance situation which requires a xxxxxxx’x attention during working hours, they shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. It is understood that the taking of have such time away from regular duties shall be kept to a minimum and that permission will not therefore be unreasonably withheld. Stewards shall return to their regular duties classified as expeditiously as possible. The Company reserves "in service" time for the right to limit such time if the time requested is unreasonable. (b) Should a Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting purposes of the general membership of the Union is to be held, such Xxxxxxx shall (provided their request is made at least two (2) weeks in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of calculating eligibility for Statutory Holiday pay. (a) The Union agrees that there shall be no solicitation of members 3.5 Employees acting as full time officers or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings representatives of the Union or its members will their parent organization, on a leave of absence beyond twenty-two (22) working days, shall be held entitled to retain their membership in all existing welfare plans, in accordance with the terms and conditions of the plans, subject to the Union paying the full cost of the premium of each plan on the premises employee's and Xxxxxxxx's behalf. 3.6 Employees who are acting as full time officers or representatives of the Company at any Union or their parent organization shall be placed on leave of absence, with the time without the prior written approval of involved considered as service with the Company. Violation by any employee On conclusion of any such leave of absence, employees shall return to a job level equivalent to that which they previously held immediately prior to working for the foregoing provisions Union, with the accrued seniority. 3.7 The Employer shall have the right of selection to fill vacancies due to Union leaves of ten (10) months duration or less. Otherwise, the vacancy shall be cause for discipline of such employee filled by the Companyapplicable posting rules. Experience gained by selection to the temporary positions shall not be considered in selection of a successful applicant to the posting.
