Union Activities. (a) The Company acknowledges the right of the Union to appoint or otherwise elect (1) Xxxxxxx who shall be an employee of the Company and who shall represent the two (2) seniority groups. (b) The Union will notify the Company in writing of the names of its Stewards and may also notify the Company of the names of additional employees who may serve as alternate Stewards in the absence from work of a regular Xxxxxxx. The Company will not recognize any individual as a Xxxxxxx until it has received such notification from the Union. (a) The Union acknowledges that a xxxxxxx has regular duties to perform on behalf of the Company. In a grievance situation which requires a xxxxxxx’x attention during working hours, they shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. (b) Should a Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting of the general membership of the Union is to be held, such Xxxxxxx shall (provided their request is made at least two (2) weeks in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings of the Union or its members will be held on the premises of the Company at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall be cause for discipline of such employee by the Company. (b) Subject to the foregoing, the Company agrees that no employee shall be disciplined or discriminated against for lawful Union activities, or performing services on a Union committee outside working hours, or for reporting to the Union the violation of any provision of this Agreement. 8.04 The Company agrees to provide access to the bulletin board on its premises for the use of the Union. The main purpose of the bulletin boards shall be for the posting of proper notices related to Union meetings, Union elections, the names of Union Officers or stewards, social and recreation events. With respect to such notices prior approval of the Company need not be obtained although the Union shall furnish the Company with a copy of such notices prior to posting. The contents of such notices will not contain any comments that are detrimental to the Company or any of its employees. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to posting. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's efforts to assure a full day's work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 At the request of the Union, the Company will grant time off, without loss of regular pay during the employee's regular working hours, to one (1) employee to allow him/her to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisor.

The Union shall notify the Chancellor of changes in the roster of Stewards. Stewards are authorized to perform and discharge Union duties and responsibilities which may be assigned to them under the terms of this Agreement. C. Time for Performance of Duties 1. Stewards shall obtain permission from the administrator in charge of their worksite (e.g., a school principal) prior to leaving their work assignments to properly and expeditiously carry out their duties during a reasonable amount of official time to be heldestimated in advance whenever possible. Union Activities. Union Activities. Union Activities. (b) The Union will notify shall promptly reimburse the Company in writing for the sum of: (i) the gross amount of the names of its Stewards and may also notify payment calculated as set out in (a) (i) above, (ii) any amount which becomes payable by the Company as a result of the names Company having made to any employee a payment under the provisions of additional (a) above (e.g. Company contributions to the Extended Group Insurance Plan, Unemployment Insurance, Government Pension Plan and Health Plan, etc.). Union Activities. Nothing contained herein shall prohibit an employee from engaging in Union activities during his lunch, breaks, or non-paid time. (a) 28.01 The Union will supply the Company with the Division regular meeting schedule, indicating the day of the week and the time of regular Division meetings and a list of Division Officers for the Division. 28.02 The Union shall notify the Company in writing whenever changes take place of the names of its Officers and Representatives. 28.03 The Company acknowledges shall grant to a Divisional Officer, Regional Officer, National Officer or designated representative a leave of absence without pay to fulfil their duties for Union activities i.e. conventions, seminars, meetings, and arbitration, during which he will accumulate seniority. The granting of which will not be unreasonably withheld and the Union representative will provide at least 14 days’ notice if possible. 28.04 A Local Chairperson needing to book off for immediate Union shall give as much notice as possible but in no case less than three (3) hours prior to commencement of regular assignment. 28.05 The Company recognizes the right of the Union to appoint or otherwise elect select three (13) Xxxxxxx who accredited Union Reps as follows to the Negotiating Committee. One Local Chairperson (or designate) from Mechanical, One Local Chairperson (or designate) from Locomotive Engineers, One Local Chairperson (or designate) from the Conductors. It shall be an employee the Negotiating Committee’s function to meet with the Company to negotiate the renewal of this Agreement. The members of this committee are absent from work, without loss of pay, to participate in the collective agreement negotiation and conciliation sessions. Prior to the expiry of this collective agreement, the Employer will grant the Union Bargaining Committee a maximum of five (5) days leave for the purpose of preparing for these negotiations. 28.06 Time spent by the union workplace representatives in meetings with the Company and who by employees selected under article 28.05 during negotiations with the Company shall represent be without loss of pay or benefits, provided that there shall be no entitlement to pay in respect to hours outside the two (2) seniority groupsemployee’s normal hours of work and during which the employee would not otherwise have worked. Union Activities. 6.01 There shall be no Union activities during working hours which interfere with the duties of any employee unless permission is first obtained from the employee's immediate supervisor. Such permission will not be unreasonably withheld and all such time off during an employee's regular working hours shall be without loss of pay. 6.02 The Company will make available for the use of the Union a bulletin board at each Plant whereon the Union may post such notices as it desires to bring to the attention of employees provided, however, that no such notice may be posted at places other than on these bulletin boards and further provided that no such notice may be posted until it has been signed by an Officer of the Union and by a representative of management. 6.03 From time to time during the currency of this Agreement, upon the written request of the Union, the Company will grant leaves of absence without pay to the employees named in such request to enable them to participate in Union activities. No such leave of absence shall be for a period of less than one day or more than seven days except that where a leave is granted to an employee to enable him/her to attend a Union convention, the maximum of seven (7) days may be exceeded to the extent of necessary travel time to the place of convention and return. No more than ten (10) such leaves will be granted in any one year of the currency of this Agreement and no more than four (4) employees may be absent on such leave at any one time. If the maximum of ten (10) leaves in any year of this Agreement has been granted, the Company will consider any further request for such leave in that year on an individual basis. 6.04 From time to time during the currency of this Agreement and upon the written request of the Union, the Company will grant a leave of absence without pay to any employee for the purpose of attending to Union business. Such leave of absence shall be for a period of not less than one (1) month and not more than six (6) employees from each plant shall be entitled to any such leave of absence at any one time. Where such leave is to be for a period of less than one (1) year, the Union shall specify the period to be covered. If the leave is expected to be required for a period in excess of one (1) year, it shall be treated as an indefinite leave of absence and the Company's approval of such leave shall be considered to continue throughout the life of this Agreement. To the extent that it is practical to do so, the Company will endeavour to arrange for the continuance of both Company and Government welfare benefits while an employee is absent on such leave. 6.05 With respect to employees granted leave of absence under the provisions of clauses 6.03 and 6.04 above, it is agreed that on the written request of the Union: (a) The Company acknowledges the right of the Union to appoint or otherwise elect (1) Xxxxxxx who Each employee shall be an employee of receive from the Company in respect of each day of absence on such leave, an amount equivalent to: (i) the regular straight-time hourly rate then in effect for his/her employment classification, multiplied by eight (8) or ten (10) hours, whichever is appropriate (ii) all deductions normally withheld by law from an employee's pay and, if applicable, the employee's contributions to the Extended Group Insurance Plan, the Employees' Retirement Plan and who shall represent the two (2) seniority groupsEmployee Savings and Investment Plan. In the event of failure of the Union to so reimburse the Company, all payments to employees who under (a) above shall immediately cease. (c) In consideration of the agreement of the Company to make payments as provided above, the Union agrees to indemnify the Company and save it harmless from and against any and all claims, payments, and costs of any kind which it may serve as alternate Stewards in receive, make or suffer, directly or indirectly, through having agreed to make and having made such payments, deductions and contributions or by reason of any imputed employment relationship which might be alleged to exist between such employee and the absence from work Company by reason of a regular Xxxxxxx. Union Activities. (a) Every Union Xxxxxxx and every Officer of the Union who is an employee shall be allowed such time off as may be necessary to enable him/her to attend those appointments with Management personnel at which his/her presence is required under the provisions of Article 8 and every employee who is a necessary witness at a grievance situation which requires meeting or at a xxxxxxx’x attention during working hours, they grievance arbitration hearing established under Article 8 shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. It is understood that the taking of be allowed such time away from regular duties shall off as may be kept necessary to a minimum and that permission will not therefore be unreasonably withheld. Stewards shall return enable him/her to their regular duties as expeditiously as possible. Such permission will not be unreasonably withheld and shall be without loss of pay. (a) The Union agrees that there shall be no solicitation of members or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings of the Union or its members will be held on the premises of the Company at any time without the prior written approval of the Company. Violation by any employee of any of the foregoing provisions shall be cause for discipline of such employee by the Company. (b) Subject to the foregoing, the Company agrees that no employee shall be disciplined or discriminated against for lawful Union activities, or performing services on a Union committee outside working hours, or for reporting to the Union the violation of any provision of this Agreement. 8.04 The Company agrees to provide access to the bulletin board on its premises for the use of the Union. The main purpose of the bulletin boards shall be for the posting of proper notices related to Union meetings, Union elections, the names of Union Officers or stewards, social and recreation events. With respect to such notices prior approval of the Company need not be obtained although the Union shall furnish the Company with a copy of such notices prior to posting. The contents of such notices will not contain any comments that are detrimental to the Company or any of its employees. Notices or other material that do not fall within the preceding definition shall require the prior approval of the Company expressed by the initials or signature of an authorized Representative of the Company or their delegated representative prior to posting. 8.05 The Union recognizes the responsibilities imposed upon it as the exclusive bargaining agent of the unit, and assumes a joint responsibility with the Company to cooperate and support the Company's efforts to assure a full day's work on the part of its members; actively combat absenteeism and any other practices which restrict optimum efficiency; improve the quality of workmanship and service; prevent accidents and strengthen goodwill between the Company, and the employees, the customer and the public. 8.06 At the request of the Union, the Company will grant time off, without loss of regular pay during the employee's regular working hours, to one (1) employee to allow him/her to be a member of the Union Negotiating Committee to attend arranged meetings with Company representatives or with a Conciliation Officer for the purpose of negotiating a renewal of this Collective Agreement. The allowing of any such time off shall, however, be subject to the employee having obtained permission to leave work from his/her Supervisor.

Union Activities. (a) The 3.1 It is recognized that from time to time it may be necessary for employees representing the Union to carry out their Union duties during their working hours. Employees shall first obtain permission from their supervisor prior to conducting any Union activity or business on Company acknowledges premises at any time. Maintenance or earnings shall be the right responsibility of the Employer, unless otherwise specifically agreed to. Other representatives of the Union shall obtain prior approval from a Company supervisor prior to appoint conducting any Union activity or otherwise elect (1) Xxxxxxx who business on Company premises at any time. 3.2 Employees representing the Union shall be an employee granted short term leaves of absence of twenty-two (22) working days or less, in order to carry out their Union duties. 3.3 Such leaves of absence shall be granted, insofar as the regular operations of their department shall permit, and the application shall be given precedence over any other leave of absence application received on the same day. 3.4 Members of the Negotiating Committee who are not performing their regular duties, but who are meeting with the Company and who shall represent the two (2) seniority groups. (b) The Union will notify the Company in writing of the names of its Stewards and may also notify the Company of the names of additional employees who may serve as alternate Stewards in the absence from work of a regular Xxxxxxx. The Company will not recognize any individual as a Xxxxxxx until it has received such notification from being paid by the Union. (a) The Union acknowledges that a xxxxxxx has regular duties to perform on behalf of the Company. In a grievance situation which requires a xxxxxxx’x attention during working hours, they shall not leave their regular duties without first obtaining permission to do so from their immediate supervisor. (b) Should a Union Xxxxxxx be scheduled to be on duty during the time in which a regularly scheduled meeting purposes of the general membership of the Union is to be held, such Xxxxxxx shall (provided their request is made at least two (2) weeks in advance) be allowed such time off work as may be reasonably required in the circumstances to permit them to attend such meeting. (c) All such time off under the provisions of Article 8.02, during a Xxxxxxx’x regular working hours, shall be without loss of calculating eligibility for Statutory Holiday pay. (a) The Union agrees that there shall be no solicitation of members 3.5 Employees acting as full time officers or other Union activities on the premises of the Company, or during working hours except during lunch periods, rest periods, and before the start and end of an employee's shift. In no case shall the ongoing operation of the Company be disrupted. It is understood and agreed that no meetings representatives of the Union or its members will their parent organization, on a leave of absence beyond twenty-two (22) working days, shall be held entitled to retain their membership in all existing welfare plans, in accordance with the terms and conditions of the plans, subject to the Union paying the full cost of the premium of each plan on the premises employee's and Xxxxxxxx's behalf. 3.6 Employees who are acting as full time officers or representatives of the Company at any Union or their parent organization shall be placed on leave of absence, with the time without the prior written approval of involved considered as service with the Company. Violation by any employee On conclusion of any such leave of absence, employees shall return to a job level equivalent to that which they previously held immediately prior to working for the foregoing provisions Union, with the accrued seniority. 3.7 The Employer shall have the right of selection to fill vacancies due to Union leaves of ten (10) months duration or less. Otherwise, the vacancy shall be cause for discipline of such employee filled by the Companyapplicable posting rules. Experience gained by selection to the temporary positions shall not be considered in selection of a successful applicant to the posting. (b) Subject 3.8 No employee shall lose section seniority rights as a result of transfers to fill vacancies which result from these Union leaves. 3.9 On the foregoingfollowing dates, the Company agrees that no employee shall be disciplined or discriminated against for lawful Union activitiespay the following respective lump sums into the Bargaining Unit's Paid Education Leave fund: April 1, or performing services on a Union committee outside working hours2004 $2100.00 April 1, or for reporting to the Union the violation of any provision of this Agreement. 8.04 The Company agrees to provide access to the bulletin board on its premises for the use of the Union.
