UNION STEWARDS AND COMMITTEES. 3.01 No individual employee or group of employees shall undertake to represent the Union at meetings with the Employer without proper authorization of the Union. In order that this may be carried out, the Union will supply the Employer with the names of its Representatives. Similarly, the Employer will supply the Union with a list of its supervisory or other personnel with whom the Union may be required to transact business. 3.02 The bargaining unit employees have the right, at any time, to have the assistance of a Representative of the United Food and Commercial Workers Union or its International affiliates when dealing with the Employer regarding complaints or grievances. 3.03 Any employee who so desires it, shall have the right to review their personnel record in the presence of the Union Xxxxxxx and a member of Management, upon making a request for same in advance. (b) The Union shall notify the Employer in writing of the names of each xxxxxxx and, where applicable, each Committee member, before Management shall be required to recognize any person so selected. The Union Xxxxxxx shall be given the necessary time, up to one half (½) hour with pay per orientation session for union orientation with the new bargaining unit employee(s). 3.07 Any further negotiations for the renewal of this agreement, the bargaining unit will be represented by a negotiating committee consisting of Union representatives of the United Food & Commercial Works Union and not more than six (6) bargaining unit employees appointed or elected by the Union. Whenever possible the 6 appointed employees will be inclusive of 1 individual from each of the Polar Pak plants currently covered in this collective agreement. The Employer will recognize as members of the negotiating committee employees who have acquired at least one year of seniority under this Agreement. The union shall notify the Employer in writing the names of the members of the negotiating committee at the time of appointment and the Employer shall not be required to recognize any committee member until it has been so notified. Members of the negotiating committee who are required to be in attendance at negotiation sessions shall be paid their regular hourly rate for each day scheduled to have been at work, but spent at negotiations. Having said this, neither said pay nor time will be used in the calculation of overtime. Moreover, the Employer will process the appropriate rate of pay and will invoice the Union an amount equal to pay, taxes and benefits. The Union will attend to said payment forthwith.

(a) An Employee who is called to a copy meeting by their Supervisor or other Management personnel for the purpose of receiving written disciplinary action, a disciplinary suspension or discharge shall have a xxxxxxx present as a witness. All lesser disciplinary action shall be conducted on a one-to- one basis between the immediate supervisor and the affected Employee unless either party requests the presence of a Xxxxxxx. (b) Should an Employee decline the opportunity to have a Union representative, the employee must acknowledge same by signing a form. (c) In consideration of stewards, members of the Collective AgreementUnion Committee and other Union Officers who are Employees, complying with the terms of (a) above, the City will pay such Employees for time spent attending grievance hearings or attending official meetings with representatives of the City during their regular scheduled hours of work. (d) An Employee shall have the right to have a xxxxxxx present during the investigation meeting which may result in discipline or discharge or in any meeting where discipline is being imposed. An Employee has the right to waive their right to union representation. This does not preclude the Corporation from meeting with an Employee on a one-on-one basis for the purpose of coaching or counselling unless such an Employee requests the presence of a xxxxxxx. 3.7 A Negotiating Committee will consist of a Union Business Representative from UFCW and not more than three (3) bargaining unit employees appointed or elected by the Union. Employees appointed by the union to be the negotiating committee shall be paid 8 hours per day for each day spent at negotiation meetings, including conciliation and mediation. Part Time employees scheduled to work less than 8 hours on one of the bargaining dates will receive 8 hours pay and the City will “charge back” to the union the difference in hours between the 8 hours less the hours for which the employee was scheduled to work.
