USA Jurisdiction. Notwithstanding anything contained in this Policy to the contrary, it is hereby understood and agreed that with respect to any indemnification provided under the Policy for legal liability against the Insured to pay damages in respect of any judgement, award or settlement made within the jurisdiction of the United States of America, the following additional condition applies: The Limits of Liability stated in the Policy Declarations are inclusive of the costs expenses, legal expenses and charges for which the Insurer in accordance with the terms and conditions of the Policy would otherwise be liable. The written award of the arbitrator on the merits of any grievance adjudicated within his jurisdiction and authority shall be final and binding on the aggrieved employee, the Union and the Administration, unless either party contests it before a court of competent jurisdiction as permitted by state law.
