USE AND SALE OF DRUGS. The unlawful manufacture, distribution, dispensation or use of a controlled substance on the job or on City property is prohibited. Illegal drug use, or alcohol use which impairs and employee’s job performance and interferes with regular work duties may result in disciplinary action. If a supervisor has reasonable cause to suspect that an employee is not fit for duty, he/she may require the employee to submit to a medical clarification examination by a physician who is qualified to assess impairment caused by drugs or alcohol. The physicial will determine, after a physical examination, whether the employee is fit or unfit for duty. During the examination, the physician may request that the employee provide a urine sample for drug or alcohol screening if the physicial suspects the employee is under the influence of drugs or alcohol. The decision to require a fitness for duty test must be based on a reasonable and articulable belief that the employee is using alcohol or a prohibited drug on the basis of specific, contemporaneous physical, behavorial, or performance indicators of probable alcohol and drug use. Any employee whose on-duty or off-duty conduct leads to a conviction of any criminal drug statute mus notify his or her Department Head of that conviction no later than five days after such conviction.
