Use in Other Media. The primary market for the Picture is considered to be theatrical (whether or not such use occurs). If the Picture is ever released for secondary commer- cial exhibition (including but not limited to Cable or Free Television, DVD or New Media exhibition), the Producer shall make payments for such additional exhibition as re- quired under the Film Musicians Secondary Markets Fund Agreement and that docu- ment is incorporated into this document by reference. Such Payments will be at 1.8% of 20% of “Producer Gross” formula rate described for Electronic Sell-Through (EST) in the AFM New Media Sideletter.
Use in Other Media. The Influencer-Produced Sponsored Content may only be used as set forth in this Agreement. Prior to entering into any agreement with an Advertiser or other party for use of the Influencer-Produced Sponsored Content on any channel or platform or in any other medium (e.g. television or industrial use), Producer or Influencer must notify SAG-AFTRA. If the intended use is in any other media covered by a SAG-AFTRA collective bargaining agreement, Producer must bargain the terms and conditions of use with SAG-AFTRA.
Use in Other Media. If Producer intends to use Covered Advertisements produced under this Agreement in any project other than a podcast, Producer shall obtain consent of the Performer(s) and negotiate for compensation at no less than the terms of the SAG-AFTRA Agreement applicable to the subsequent use.
Use in Other Media. The C4B Content may only be used as set forth in this Agreement. Prior to entering into any agreement for use of the C4B Content on any other channel or platform or in any other medium (for example: television, including free, ad-supported television regardless of the medium of transmission; streaming; over-the-top), Producer or Talent must notify SAG-AFTRA. If the intended use is in a medium covered by any other SAG-AFTRA collective bargaining agreement, Producer must bargain the terms and conditions of use with SAG-AFTRA.
