Use of Mobile Deposit. You must fully comply with these Mobile Deposit Terms, the Agreement and all applicable law when you use Mobile Deposit. If you breach these Mobile Deposit Terms, we may immediately terminate your authority to use Mobile Deposit. You may use Mobile Deposit only for personal, family and household services and not business purposes. Mobile Deposit Unavailability. Mobile Deposit may be unavailable temporarily due to system maintenance or technical difficulties, including those of the Internet service provider, cellular service provider and Internet software. In the event that Mobile Deposit is unavailable, you may deposit original checks at any Telco Plus office or by mailing to: Telco Plus Credit Union, P O Box 3099, Longview, TX 75606-3099. No Warranty. YOUR USE OF MOBILE DEPOSIT IS AT YOUR SOLE RISK. MOBILE DEPOSIT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND AS TO MOBILE DEPOSIT, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Limitation of Liability. WE WILL NOT BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS OR REVENUES RESULTING FROM YOUR USE OR INABILITY TO USE MOBILE DEPOSIT, EVEN IF WE ARE ADVISED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES. No Waiver: No waiver of any of the foregoing terms and conditions shall be effective unless it is in writing and signed by an authorized officer of Telco Plus Credit Union, and no waiver shall be deemed to imply or constitute a continuing waiver or a waiver of any other term or condition. Jurisdiction and Governing Law: You will be deemed to have agreed to the exclusive jurisdiction of the State and Federal courts of the State of Texas, for resolution of any dispute you have relating to the goods or services offered or promoted herein, or to this agreement. Use of Mobile Deposit. You shall follow all Mobile Deposit instructions provided by Bank for capturing and transmitting Check Images and other information. You shall (a) prior to scanning any Check payable to you, restrictively endorse the back of the Check “For Mobile Deposit at Signature Bank Only”; (b) use your Mobile Device to scan the front and back of a properly endorsed Check made payable directly to you; (c) verify that the Check Image, including the MICR line of the Check, are clear;

  • Use of Customer Name Contractor may use County’s name without County’s prior written consent only in Contractor’s customer lists. Any other use of County’s name by Contractor must have the prior written consent of County.

  • Use of sub-processors (a) The data importer has the data exporter’s general authorisation for the engagement of sub-processor(s) from an agreed list. The data importer shall specifically inform the data exporter in writing of any intended changes to that list through the addition or replacement of sub-processors at least thirty (30) days in advance, thereby giving the data exporter sufficient time to be able to object to such changes prior to the engagement of the sub-processor(s). The data importer shall provide the data exporter with the information necessary to enable the data exporter to exercise its right to object.

  • Use of the Card 1. The Cardmember must sign the Card in ink, using a ball point pen, as soon as he or she receives it; the Cardmember must also safeguard the Card and preserve any PIN in extreme secrecy and keep it separate from his or her Card. The Cardmember must not use the Card after the expiration of the validity period embossed on it, and not use the Card after it has been damaged, withdrawn or cancelled.
