Use of Sick Leave to Attend. to Illness of a Child, Parent or Spouse Members of SSA/IFPTE LOCAL 21 shall have the right to use up to half of annual sick leave to attend to the illness of a child, parent or spouse. (Labor Code section 233) 5202 Exhausted Paid Leave When all available paid leaves are exhausted, the employee is placed on “Difference Leave". An employee on "Difference Leave" is paid the difference between regular salary and that paid the substitute. This is paid for a maximum period of five (5) months. The five -month period is calculated from the sixteenth day of sick leave or last day of available sick leave, whichever comes first. When "Difference Leave" is exhausted, the employee with at least three (3) years of service shall be allowed Health Leave; an employee with less than three (3) years of service is placed on a re -employment list for a period of thirty-nine (39) months. 5203 Re-employment after Exhausted Paid Leave At any time during the prescribed thirty-nine (39) months the employee is able to assume the duties of the former position, the employee shall be re-employed in the first vacancy in the classification previously assigned. Re - employment will take preference over all other applicants except those laid off for lack of work or funds, in which case they shall be ranked according to proper seniority. Upon resumption of duties, the break in service will be disregarded and the employee shall be fully restored as a permanent employee.
