Uses Defined. 9.1.1. As used in this Agreement, “commercial” is the equivalent of “non-residential”. When used to describe land uses, “commercial” shall mean all land uses other than non- transient residential land uses. When used to describe development, floor space, or structures, “commercial” shall mean all structures, areas, and facilities not designed and used for permanent residential occupancy or accessory to residential occupancy, provided however, that structured parking garages to serve any use do not count against the housing unit or commercial square footage limits. 9.1.2. For the purposes of determining land use thresholds pursuant to this Agreement and 9.1.3. If a commercial or multifamily building or parking structure is proposed along the southwestern boundary of the Lakepointe Urban Village, the building shall be located at least one hundred (100) feet from the eastern property lines associated with Lots 19 through 23 of the Plat of Covington Park, Division 3. Functional balconies shall not be permitted on the southern or westerly facing side of a hotel building. Any overnight accommodations shall be a hotel with interior lobby and interior access to rooms (as opposed to a motel that maintains exterior access to rooms and exterior stairs) and be designed consistent with current brand hotel design practices and meet the Lakepointe Urban Village Subarea Design Standards (Exhibit P).
