USFWS-Initiated Response to Changed Circumstances. If the USFWS determines that changed circumstances have occurred and that the Permittee(s) has not responded in accordance with Section 8.3.1 of the SLCHCP, the USFWS will so notify the Permittee(s) and direct the Permittee(s) to make the required changes. Within 30 days after receiving such notice, the Permittee(s) will make the required changes and report to the USFWS on its actions. Such changes are provided for in the SLCHCP, and hence do no constitute unforeseen circumstances or require amendment of the Permit or SLCHCP.

USFWS-Initiated Response to Changed Circumstances. If USFWS determines that Changed Circumstances have occurred and that CITY, SUTTER or TNBC have not responded in accordance with Chapter VI of the NBHCP, the USFWS in coordination with CDFG will so notify CITY, SUTTER and TNBC and, as appropriate, direct them to make the required changes. Within thirty (30) days after receiving such notice, CITY, SUTTER or TNBC, as appropriate, will make the required changes and report to USFWS on their action. Such changes are provided for in the NBHCP, and hence do not constitute unforeseen circumstances or require amendment of Permits or of the NBHCP.

The Party will report to the Service on its actions or intended actions within thirty (30) days after receiving notice from the Service and shall make the required changes in the period of time necessary to implement the changes, as agreed to by Service and the responsible Party. Such changes are provided for in the HCP and hence do not constitute Unforeseen Circumstances or require amendment of the ITP or HCP. Provided that Permittee is properly implementing those aspects of the HCP for which it is responsible under this IA, the Service will not require Permittee to carry out any additional conservation and mitigation measures other than those identified in Section 8.2.2 of the HCP without consent of Permittee.

These distributed control capabilities will enable distributed intelligence and control capability to support fast, automated decisions and improve overall resiliency of the distribution grid system.
