Using and Disclosing Personal Information. The Authority must have the written consent of the individual to whom the personal information relates before it can be used, or disclosed to a third party for a purpose other than that for which it was collected, except as set out in subsection 2.2(c). Third party access to personal information should only be provided where it can be demonstrated that the third party has put in place means to protect personal information which are comparable to those of the Authority. If personal information is made available to a third party on an ongoing basis, any revised information will be regularly provided. Parties, representatives and other authorized participants in a Tribunal proceeding are not considered to be third parties with respect to the personal information provided or required in a Tribunal proceeding. Personal information that has been collected by the Authority in accordance with this Policy may be used or disclosed without the consent of the individual only in the following circumstances: If the information is necessary to respond to an emergency; If the information is reasonably required for the Authority to fulfill the Statutory Mandate; or If the information is required for the Tribunal to perform its dispute resolution functions under any Act or Regulations, the Tribunal’s Rules, or a Tribunal order.

Supplier agrees to document and keep these safeguards current and shall make the documentation available to DXC upon request. Supplier shall ensure that only Supplier’s employees or representatives who may be required to assist Supplier in meeting its obligations under this Agreement shall have access to the Personal Information.

  • Use and Disclosure of Protected Health Information The Business Associate must not use or further disclose protected health information other than as permitted or required by the Contract or as required by law. The Business Associate must not use or further disclose protected health information in a manner that would violate the requirements of HIPAA Regulations.
