Utilities and Services to be Provided by Landlord. Landlord shall furnish usual and reasonable electricity for lighting and for the operation of all equipment (including kitchen equipment) and fixtures, water and sewerage, gas, elevator service, and heating and air-conditioning, all as may be necessary for the reasonable occupancy and use of the Premises by Tenant and its subtenants for the permitted use provided for in this Lease Agreement. The Landlord shall pay for all utilities servicing the Premises during the first year of the Lease Term. Commencing on the first anniversary of the Commencement Date, the Tenant shall pay Tenant’s Proportionate Share of utilities as provided in Section 2.2 above. If any services or utilities to be provided are suspended or interrupted by strikes, repairs, alterations, orders from any governmental authority (other than the Landlord) or any cause beyond Landlord’s reasonable control, Landlord shall not be liable for any costs or damages incurred by Tenant, and such interruption shall not be deemed an eviction or relieve Tenant of performance of Tenant’s obligations under this Lease. Landlord shall provide janitorial services to the Common Areas of the Building serving the Premises. Tenant shall be responsible for trash collection sufficient to keep the interior of the Premises free and clear of debris and the exterior of the Premises free of excess accumulation of trash. Landlord makes no representation that the electrical facilities at the Premises are sufficient to serve a kitchen. If Tenant decides to include a kitchen as part of the Premises, the Landlord and Tenant shall investigate the costs of any necessary electrical upgrades, and Tenant shall be responsible for such costs unless the parties agree otherwise by amendment to this Lease.

Utilities and Services to be Provided by Landlord. As long as Tenant is not in default under this Lease, Landlord shall provide (i) passenger elevator facilities on business days from 8 a.m. to 6 p.m., with one passenger elevator subject to call at all other times; (ii) steam heat to the Premises on business days from 8 a.m. to 6 p.m., and on Saturdays from 9:00 a.m. to 12:00 p.m.; (iii) water for ordinary lavatory purposes, but if Tenant uses water for any other purposes or in unusual quantities, Landlord, at Tenant’s expense, may install a water meter, which Tenant shall keep in good working order and repair, and Tenant shall pay for water consumed per the meter as Additional Rent upon rendition of bills; (iv) air-conditioning/cooling to the Premises from May 15th through September 30th on business days (Monday through Friday, holidays excepted) from 8:00 a.m. to 6:00 p.m.; (v) ventilation to the Premises during the same hours except when air-conditioning/cooling is being furnished as stated above; (vi) freight elevator service on business days between 8:00 a.m. and 12:00 p.m. and between 1:00 p.m. and 4:00 p.m.; and (vii) 6 xxxxx of electricity capacity per usable square foot of space in the Premises.

  • Services Provided by Landlord Landlord will maintain the public and common areas of the Building and the Project, such as lobbies, stairs, elevators, landscaping, corridors, parking lots and public restrooms, in good order and condition except for damage occasioned by the act or negligence of Tenant. Landlord will furnish the water for common areas and with electricity for lighting and the operation of the elevator. It will be the responsibility of Tenant to maintain the leased premises. Landlord will not be liable for damages, nor will Tenant's obligation to pay Rent be abated, for Landlord's failure to furnish or for delay in the furnishing any of the foregoing services, if the failure or delay is caused by accident or conditions beyond the reasonable control of Landlord. The temporary failure to furnish any of the services will not be construed as an eviction of Tenant and will not relieve Tenant from the duty of observing and performing any of the provisions of this Lease so long as Landlord proceeds with reasonable diligence to correct any the failure.

Tenant shall pay for all water (including the cost to service, repair and replace reverse osmosis, de-ionized and other treated water), gas, heat, light, power, telephone, internet service, cable television, other telecommunications and other utilities supplied to the Premises, together with any fees, surcharges and taxes thereon. To the extent that Tenant uses more than Tenant’s Pro Rata Share of any utilities, then Tenant shall pay Landlord for Tenant’s Adjusted Share of such utilities to reflect such excess. In the event that the Building or Project is less than fully occupied during a calendar year, Tenant acknowledges that Landlord may extrapolate utility usage that varies depending on the occupancy of the Building or Project (as applicable) to equal Landlord’s reasonable estimate of what such utility usage would have been had the Building or Project, as applicable, been ninety-five percent (95%) occupied during such calendar year; provided, however, that Landlord shall not recover more than one hundred percent (100%) of the cost of such utilities. Tenant shall not be liable for the cost of utilities supplied to the Premises attributable to the time period prior to the Term Commencement Date; provided, however, that, if Landlord shall permit Tenant possession of the Premises prior to the Term Commencement Date and Tenant uses the Premises for any purpose other than as expressly permitted in Section 4.3, then Tenant shall be responsible for the cost of utilities supplied to the Premises from such earlier date of possession.

  • Services by Landlord Landlord shall be responsible for providing for maintenance of the Building Common Area, and, except as required by Section 10(b) hereof or as otherwise specifically provided for herein, Landlord shall be responsible for no other services whatsoever.
