Vacation Pay upon Termination of Employment. 1. Upon leaving employment, employees shall be paid the monetary value of their earned vacation leave but not exceeding the maximum amount of vacation leave that may be accumulated under the provisions of this Article. 2. If terminating employees take accrued vacation leave immediately prior to the effective date of their termination, it shall not be necessary to keep the position vacant for the equivalent time of the vacation period.

Upon leaving employmenta) If an employee terminates her employment without giving at least fourteen (14) calendar days written notice or if an employee is terminated by the Employer for just cause, employees or during her probationary period, such employee shall be paid receive vacation pay at the monetary value of their earned rate prescribed in the Employment Standards Code concerning vacation leave but not exceeding the maximum amount of vacation leave that may be accumulated under the provisions of this Articlewith pay.
2. b) If terminating employees take employment is terminated, and proper notice given, the employee shall receive vacation pay in lieu of any unused vacation entitlement the employee may have accrued vacation leave immediately prior up to the effective date of their termination, it shall not be necessary to keep the position vacant for the equivalent time of the vacation period.
